Dr. is not complying with the 60 day mandate to refund credit balances and I believe this would also fall under the ******* False Claims Act. She claims pymts were applied to deductible. This is a deflection and excuse! This Dr. has been notified including written documentation from the insurance company that she owes me $245.80. Since receiving those notices, she has manufactured two "no-show" appointments, showing charges of $50 a piece. Now, she has sent three emails stating she is charging me three late fees for $30 on my account for the fictitious no-shows. Her account summary does not show my payments. Only her no show appointments and the three late fees. That is illegal. Reviews show this is a common practice. In ** she has 60 days to return the payment. It has been over two years since my appointments with her and she continues to ignore the insurance company and my own requests for the overpayment. This is her standard practice:1. She demands full payment up-front.2. She does not account for or document the payment already received when she submits the claim to the insurance company so the insurer does not know the patient has already paid and sends full payment to Dr. ********************** 3. This results in her GETTING PAID IN FULL FROM THE PATIENT AND THE INSURER BOTH. 4. ********** then refuses to return the overpayment when brought to their attention keeping the credit balance and committing fraud. My appointments were 2/8/21, 3/3/21 and 3/22/21. She also did not have me sign the necessary HIPAA forms before "treating me". She actually made me much sicker by changing thyroid medicine after every six weeks. Her office manager (husband) has no medical training and yet, told me to lay down and put a cold washcloth on my head. It turns out, I was in stage 4 hypertension and should have been referred to the *** This business exists to take people's money, not to treat them medically. They refuse to cooperate with specialists and will not send medical records.

I was seen in the office Sept 22 22, there was a copay of 20 dollar that was paid at visit.I just received a bill February 2023 with late fees (2 @30 each) and was not aware there was a balance as I have NEVER received any correspondence indicating a balance due. No phone call, no e-mail, no postal mail until now. I do not owe anything to this business and cannot believe they conduct business in this manner.

    Business response

    03/21/2023

This response was taken verbally by BBB:

Every customer signs a payment/credit card authorization form as well as a cancellation/no-show form when they become our patient. We have both of these signed forms on file for this customer.

When front office staff takes a co-pay payment at the desk, it is posted to the account with the credit card authorization transaction number. I cannot find any documentation of a payment for the September 22nd appointment which is why the customer was charged the late fees. Statements went out on:

    October 18th
    December 6th and
December 19th (after the first late fee was added)

    Additional statements went out on

    January 17th and finally
January 25th (after the second late fee was added.).

The credit card on file was charged once all attempts to collect were exhausted per our signed policy documents. If the customer provides proof of payment for September's visit we will be happy to revisit and refund the late fees.

The customer also has two no show appointments for August 23rd and October 24th. We waived the first no show fee, but the customer is responsible for the $50.00 October no-show fee.

Upon receiving notice of this complaint from BBB, I attempted to call the customer to resolve these issues but was met with hostile behavior and hung up on. We are unable to assist a customer who cannot treat our staff with respect.

I am rejecting this response because: There were no other Appointments made after this visit and 1 follow up was cancelled within 7 days of the initial visit. I owe nothing to this business. also this business needs to be investigated for their unprofessional practices.

    Sincerely,

    Business response

    03/23/2023

Front office staff contacted the patient and tried to resolve the issue amicably. The staff members were both respectful and professional, yet the patient shouted at the staff, disrespected them, and hung up the phone on them. The staff members once again called him back in order to resolve the problem, yet he continued with his disrespect.

His behavior and verbal abuse is unacceptable.

    Complaint: 19431492

I am rejecting this response because:

******, this case response  is far from the Truth. The only correspondence to me regarding this matter was statement i received in february when I made the claim to the BBB. There were no phone calls and no email correspondence up to that point, wilth late charges that i was not made aware of because the copay had been paid at the time of treatment. and i have receipts. This provider is claiming fraudulent actions that did not occur. My only reason for being unruly on the phone was due to me being threatened and my reason for hanging up. They called back and continued to threaten me because i would not take down a post made on the BBB. And  I did not use foul language when dealing with them and only got loud and forceful about their mistake. This business is fabricating all of theses accusations when they are not true and others need to know this.when i received a statement (only one I ever got) it showed a past co-pay which turned out to have been paid at the visit and 2 late charges, there were no other charges to my account, nothing about no show fees, this only came about as result of me contacting the BBB. all of this is a retaliation for my my post to the BBB. Please be advised this the truth about the this matter there is no gain for me to report this other that to inform others of this business and it billing practices, And that is not to mention the office visit and why there was one, and why i sought another practice. I dont know if this will change anything, but it needs to be known.

    Sincerely,
