    I purchased a home through Loan Depot and bought a house that was in foreclosure from my fathers estate. My lender, Loan Depot, seperate complaint forthcoming, refer me to Title ************* to do the title closing. So many mistakes happened with this horrible experience and the owner ************************* and ********************. But the main issue was they were to give a clear title with no outstanding liens or taxes due on the property and they failed to do a basic online computer search with the county for the outstanding taxes of almost 4K and escrow was not collected. The estimate for the taxes was online since August of 2022 before I bought the house, and of course my dad's wife *************************, threw the bill away. It was not until have I closed that ****** came back saying I owed the taxes in cash to the county. I have already spoken to the tax county office extensively and they informed me that the title company neglected to search online and chose just an easy number of last years taxes. This is a title insurance claim and/or the responsbility of the title company because I don't have the cash to pay it, there is no escrow and Loan Depot has not been helpful to advocate for the mistake of the title company and I am seeking payment either through a title insurance claim for the amount due the county or the title company to take responsibility for their error. This has happened to them before, and they acknowledged their mistake on your website and paid the customers taxes. You would think they would have learned their ******* ************************* the owner, refuses to be a man of integrity even after I presented them with the actual physical letter, which is attached to this complaint, that the information was online well before I even bought the house, much less closed on Oct 7, 2022. He is forcing to file a lawsuit against him for his mistake. I don't have money to hire attorneys, so this appears to be fraud to me and I am also filing FTC claim against his company.

    ******************** was advised at closing that the tax bill for 2022 was not out yet, so we collected taxes based on 2021, he was advised that we would send out the collected amount as soon as the tax bill became available and was also told that it was possible that the tax amounts could increase, and if that was the case we would contact him and make him aware of this and that he is solely responsible for the taxes and any unpaid amount.  see attached affidavit signed at closing stipulating to this fact.

    I am rejecting this response because: he is dishonest, this form he provided was a stack of 100 forms. He spent most of the time discussing his personal life, not explaining taxes. The county has confirmed in writing that the tax bill for 2022 was in fact on file and he neglected to do a basic search on the internet that was of public record. I am seeking a title insurance claim against him he is a very dishonest man and his business is under investigatio with the *** as well as Loan Depot for an entire audit. This is one of ********************** the closing. He will not give me the title insurance information to file a claim. And again, NOTHING was explained about taxes at the closing, just continued handing me papers to sign.

    I amI am glad for this opportunity to respond to what happened for the public as this will be a matter of record. For whatever reason in a disorganized mess the closing was supposed to occur on September 30th but because of the hurricane it got postponed by one week as a result of that there were about four to $6,000 in fees as well as a lawsuit that came in from the mortgage that was on the home that was in foreclosure that I purchased I don't know this for a certain fact but the night before my closing on October 6th I was asked to wire in transfer the next day three times the amount of money in cash to make the closing happen when I arrived at the closing on October 7th I did not have that amount of money to pay in the end the closing Title Company put together a whole harmless agreement excluding the back taxes from 2022 from the prior owner as well as going to such extent and trouble to exclude those taxes specifically on an owner's title insurance policy that they did not ask my permission to either sell me or to discuss any of the exclusions anything that this company says in terms of discussing these taxes to me at that closing is absolutely false it never happened. What it appears is that they ran out of money and then to ensure that they all got paid first and to make the closing happen they came up with this way of not getting those back taxes from the prior owner at the closing because they knew enough to exclude them through a whole harmless agreement as well as specifically excluding them on a title insurance policy making it near impossible for me to come back and file a claim for the $4,000 that was actually the prior owners tax bill this is what happened and I'm glad I had this opportunity to write this out so that the public can be warned to avoid this title company at all cost moving forward. It is expected that the title insurance company will decline my bill I have been back and forth with the county assessor's office and was able to lower the higher assessment but it will not help me with the 2022 taxes from the prior owner I'm stuck with them I had no assistance either from my lender loan Depot who's also had a file complaint against them which they have chosen not to answer so they left an exposure to themselves as well as to Me 2 weeks after the closing actually occurred when the owner or whoever he is ************************* contacted me to tell me that I owe this amount of money a *************************************************************************************************************************************************** the insurance policy which means that they knew that these taxes were out there and did not assist me in trying to collect them from the old owner or escrow them or borrow it or whatever I needed to do to not be burdened with the out-of-pocket expenses that they now have become to me this is a matter of record and unless they pay the bill or assist me in some way this will never be resolved as far as this complaint goes with the Better Business Bureau you will always remain open and a dissatisfied customer with how they handled this not to mention all of the stress and heartache that they put me through

    Again, ******************** filed a claim with our Underwriter so he needs to communicate with them on this matter.
