In Feb. 2022 we signed a new pool contract with JE Clear Pools (JECP). According to the contract the pool was scheduled to take approx. 5-7 months to complete (see ATTACHMENT 1). As of Sept. 2023 only the gunite pool shell and pavers have been substantially completed; yet we have paid 95% of the total contract value to JECP. Construction was initially progressing rapidly after signing the contract but construction practically ceased a few months later around April 2022 after principle payments had been made. Since then JECP has only provided an endless series of excuses and unfulfilled promises/ deadlines. JECP has demonstrated an utter lack of substantive communication, disrespect and disregard for customer concerns, and employee turnover. The alleged owner of JECP, whose initials are a part of the company name, has repeatedly promised to restart construction only to miss deadlines and then make excuses (see ATTACHMENT 2-10) There has also been allegations from other JECP customers via social media of similar experiences to what I just advised above (see ATTACHMENT 11-14). According to SunBiz J.E. briefly relinquished being the Authorized Member of JECP only to reverse the decision in Aug. 2023 (see ATTACHMENT 15-19). I am gravely concerned about JECP ability to complete the pool project I have paid them for. According to the Hillsborough County permitting office JECP has approximately 20 on-going construction projects and over a dozen permits have been reissued because of the amount of time that has elapsed going back to 2021. At this time we are requesting immediate substantive work (hardware, electrical, and pool surfacing) commence with a clear and timely completion date, and verified vendor payment, or a full refund.Business response

We were extremely affected by big delays in the chain of supply of materials and equipment during the pandemic. We are a small company with over 6 years in business with over a hundred happy customers and finished projects but unfortunately the delay in materials made many of our projects got behind. We apologize for all these delays and inconveniences you have faced during this construction process. The equipment for your project has been already installed, and we have scheduled the electrical part for this week. Then, the interior will be done next week. We will call the final inspections after that, and the pool will be ready to swim by the end of this month. The screen enclosure will be completed in October. We understand your frustration for these delays, and we appreciate all your patience. Your project will be completed within a month.

I am rejecting this response because there are too numerous of inaccuracies made in the builder's response to thoroughly address them all in the time allotted. Suffice to say that the project is currently proceeding at this time, after 9 months of inactivity; and even though there continues to be missed deadlines (the hardware was delivered but as of 9/20/23 not completely installed), poor communication, and excuses. So long as the pool is swimmable by the end of September 2023 and the enclosure by the end of October 2023 then I will consider the matter closed.

Both the pool and cage are as of 10/11/2023 not complete. In response to the initial complaint filed with the BBB the builder advised the pool would be completed by the end of September and the cage by the end of October. The project has moved forward since filing the initial complaint but there have once again been repeated delays and excuses given by the builder. There has been no mention about the cage by the builder since he advised he would complete the pool first and then address the cage. I am writing this response at work and am unable to attach supporting document job that I have in abundance.Business response

We have been in contact with customer and had some delays due to inspection, inspector wanted an extra device for alarms when they never had required this before. Customer was informed and we had to go back out and take another device for the alarms to pass inspection. I informed customer that we could not do pool interior until safety barrier inspection passed. Inspection has passed and we can not do interior because of weather and will need to wait for a couple of days to do interior. Unfortunately I can not control Mother Nature and can not control inspections. Customer stated that we did the inspection delay on purpose. We do not want to pay an extra fee for inspections and we had to pay for inspector to come out again. Please understand that we are working hard to get your pool done and it will be plastered by Monday if weather permits. Thanks for understanding.Customer response

We signed a contract for an enclosed pool to be built in December 2021. The contract stated estimated completion between 5-9 months. It has now been 19 months and not only is it not finished and we haven't been able to use our yard this whole time, but the part of the work that is there needs to be leveled and redone because of poor workmanship, and it is also deteriorated with the time its been sitting unfinished. We have a raw cement hole filled with nasty mud, mold and who knows what else is down there surrounded by a deck with weeds growing through. We have paid 90+% of the money per stipulated on the contract, and have made each payment when we were supposed to, yet they have not kept their part of the agreement. The communication has been been poor the entire time with new timelines, excuses, or they don't respond at all. While we have been patient, and even given ***************************** (the owner) the benefit of the doubt over and over again, he continues to promise and not deliver week after week. It is now very obvious that he has been feeding us untruths week after week while he continues to take on new projects and leaves ours unfinished. Last fall he told us that he could finish it up, except for the screen enclosure (that was delayed) but since we didn't have a fence that wasn't possible. He said that the screen company was the culprit of our project not being finished. Earlier this spring he told us that he finally got the screen situation handled and said they would be all finished in May. Well, while the screen just got installed last week (August 2023), it turns out that now his excuse is that he's supposedly waiting on equipment to arrive. More lies! What began as a dream project for us, has now turned into a nightmare because of the extreme lack of professionalism and dishonesty they have shown in this process. At this point, he has used every excuse in the book and we've enough. We just want our pool to be finished as promised NOW.Business response

Unfortunately, we have been experiencing delays in not only in your project but other projects as a result of the delays in the chain of materials and equipment supplies during the pandemic. The problem has been solved and now we have been working very hard to catch ** in all our projects. We have been in business for over 6 years now with over a hundred happy customers with their pool project finished and that will be the case with your project as well. The equipment install has been completed in your project and we have scheduled to finish the interior of your pool and the electrical part next week. After that we will call the lasts inspections and your pool should be completed during the first two weeks of October. Below is my experience in a timeline format but here is a quick summary. I am currently from time of permit, 7 months half completed. From the contract date I am closing in on 11 months. I mention this because **** is very quick to use contract language to his own benefit. He claims that timeline is from point of permit issuance, and he also says that its an estimate anyway. Unfortunately, he is correct about estimate, although there is nothing about permit as start date in contract. In February, I received a call from the gunite company, threatening a lien on my property due to a bounced check from **** as well as not being able to reach him. **** also in June received a check from me for thousands of dollars, which he cashed to actual currency immediately. I received a call from the bank as it was suspicious to them. Again, not illegal, but not common. **** will not contact you unless you call him and continue to put pressure. 9/19/2022: Contract Date 11/17/2022: Permit received (delay is normal in Pasco County)12/7/2022: Excavation (release of first payment ~1/4 of total project)12/17/2022: Gunite Shell (release of second payment ~1/4 of total project: JE Clear pools has ~50% of pool cost)February 2023: Call from ************** threatening lien due to bounced check and lack of contact with ****. For December of 2022 to April of 2023, my pools sat with no activity except for in February, after repeated calls, I practically begged **** to send out someone to remove the dirt from the excavation that was already paid. I also, not realizing that this would be this would come out to be a bad experience, signed a change order to extend my screen and pavers. **** resumed activity in late April and has only sent staff approximately once to twice a week. I signed my contract with JE Clear Pools in November 2021. At the beginning, everything went very fast. They pulled the permit in 3 weeks or less and were digging right away. They shot concrete within a month from digging. Basically they do the steps to collect as much payment as possible. Once the easy part of the money, you can forget about getting a response from ************ is now May 31st, 2023, and we are nowhere near the completion of the project. My deck is not complete, my equipment has not been installed, my interior of the pool is not complete, my screen cage is not installed, the plumbing is not finished, the electrical is incomplete, my retaining wall is not finished. **** has already provided me with 3 revised timeline and not once since he has started revising his timeline has he sent anyone over. My Pool has been untouched since November 2022 (6 months). We are not receiving any response when we call, text and in the rare cases we do, we are lied to saying they are on their way. Of course, all of the communication has been documented. The pool contract was for $155K and we made our payments according to our contract. We have a balance of approx $20K, yet we have received proposals from other Pool companies ranging between $80-100K to complete our Pool. I urge anyone to stay away from this company. At this point, we have no hope for our pool to be completed, even though when **** reads this comments, he will say that our pool will be completed. This company has no shame and has a Ponzi scheme. Obtains payments to either complete other pools, or will eventually keep the funds and close their doors. I signed a contract with JE Clear Pools for them to install an in-ground salt water pool, screen enclosure, and heater in July 2022. They told me it would take 4-6 months to complete the project, which they began at the end of July. Ten months later, I have paid over $70,000 in 4 installments, and owe another $5000 when (if) they ever finish the project. So far, in 10 months, they have dug the hole, put in the concrete, done some plumbing, and have dropped off the pavers. That's it. Every time they do something that triggers a large payment, I don't hear from them again for weeks. Most of the time that they tell me they are coming to work, they don't show. Then they'll text to tell me they'll get the schedule to me "tomorrow" for days at a time, and the schedule never comes. I have called the office and requested to speak to the owner / manager, and never get a call back.Business response

We contracted with JE Clear Pools in October 2022 for a pool and deck remodel. After extensive delays considerably past our promised start date, they came and drained the pool and removed the coping. 1 guy for 4 hours work, and nothing else for 3 weeks, even after repeated calls, texts and promises. I cannot count the number of times I was told they would be at the house to continue, with nobody showing up. Finally the travertine coping stones were delivered, and after almost all were installed I came home to find almost half were cracked or chipped.This was mostly resolved, then fast forward through more delays and the pavers for the deck were delivered. They were not the brand, size, or color that was in our contract. No communication regarding this, only that they were delayed due to supply issues. After numerous calls and texts to the owner, we gave in and settled with what was delivered just to get things moving.More errors later, due to lack of worker supervision and communication, they finally did the pebbletech resurfacing. This was extremely sloppy, substandard work, but again due to months of frustration and stress I just wanted it done.When the 2 guys came to acid wash the pebbletech(at 4pm, they were clearly already exhausted), they spilled muriatic acid all over the travertine coping, ruining almost all of the stones.After filing the pool, the finish is terrible, with white spots and streaking all over, not to mention the jets were left as cut off pvc pipe!Another day later we notice a MAJOR leak, 6-8 inches per day without the pump even running.With again no presence after promises to show up, I hired another company to do a leak detection test to find the issue. They determined that the ** guys who supposedly prepped the interior, jackhammered around the old jets and damaged the feed lines as well as compromised the integrity of the pool itself in these areas. Again, with still nobody from ** showing up to resolve or even assess this, were looking at paying another company at least $5000 to repair the leaks, a different company to sand and refinish the damaged travertine coping, and the interior is clearly a hack job that looks terrible.All after spending $30,000 with only a small amount owing to **.This company should be ashamed of the hardship, stress and financial burden they cause.Business response

We contracted with JE Clear Pools on 12/26/23 to resurface and upgrade items on our pool. There was an understanding that they would start in mid-January and we made the initial payment on the contract, which was supposed to cover purchases specifically for our pool (as stated in the contract). They did not show up to work at all in January or most of February. Finally on 2/26, we got **** to commit to a timeline to get the pool done that was in alignment with our HOA rules. His staff didn't start work until 3/3/23 and then they did not work steady. They would show up for a few hours a day and get almost nothing done. They violated several key items in the contract and continually misled us about the issues, reasons, etc. We asked me to clear up the mess that was made, and **** said they would, but no one ever showed up. The pool sat for 2 weeks with no one showing up to work and finally, a tile installer started to install tile, but it was not the tile specified in the contract. When confronted about this, **** told us it was the same tile by a different manufacturer, but it did not look the same. Despite our protests, he had his tiler continue installing the wrong one. By this time, we were worn out with all of the mistruths we'd been told by ****. Because it became clear to ** that **** either didn't have the knowledge of how to finish the project or was just ripping ** off, we fired him from the work for breaching the contract and installing the wrong tile half way around the pool.We have since found out that he sent unskilled laborers to do the pool demolition. Because they didn't know what they were doing and were unsupervised, they removed too much of the pool's finish, which will cost ** extra to get repaired. We offered to reimburse, based upon paid invoices, for materials specifically purchased for our pool, but **** wasn't able to come up with any materials or invoices, breaching the contract once again. JECP understands **************** frustration and have been in touch with him to resolve these issues. We have explained to him that this project was also affected by the delays as a result of issued coming after the pandemic. We have been in business for over 5 years with *** happy customers that are currently enjoying JECP quality work. But we have to understand that not all human beings are the same or have the same personality and in this it has been a difficult situation to deal with. JECP have done additional work at no extra charge on this project and tried to explain **************** the issue with the materials but he was very difficult to reach an agreement. The contract he signed states about the possible delays we could have, as it happens in any construction project, but **************** did not want to conciliate and find a solution to finish his project. I am rejecting this response because:1. The contract does not have a provision for the company to miss their timelines. In fact, the contract specifies that the pool would be completed within 100 days of the contract date and a $1,00 penalty assessed for every week they were late after that. JE Clear Pools didn't start the project until day 66, so they left themselves very little time for delays. A copy of the contract is attached.
When we gave JE Clear Pools the initial check to buy all our materials, they told us they would be starting the 3rd week of January. They didnt actually start until more than a month later on March 3,2023. They worked a couple of weeks doing demo but between March 18 and March 31, they didnt show up at all. They did call some days with excuses (an entire week was lost to a work van that wouldnt work), but there was never any effort to make up the lost time with additional staff, longer days or working weekends.
I do think that JE Clear Pool's response clearly demonstrates the companys lackadaisical attitude toward keeping their commitments. It is clear from their statements that if keeping to the dates stated in the contract doesn't work for them, that they perceive that they have no obligation to deliver to the agreement. Apparently, in their ethic, just notifying the customer that youcant do it is sufficient.
2.JE Clear Pool says that he tried to explain the problem with the tile to the customer, but again, he misrepresents the situation. JE Clear Pools purchased and began installation of a tile (******* Blend) that was not what was clearly stated in the contract (Sparkle Blue), without first advising or seeking our input or permission. It was only after it was partially installed that we realized it didnt look right and did some further iinvestigation. . We found that the box did not have the name of the tile that we had selected. When confronted, **** (owner of JE Clear Pools) never took ownership of the issue, but instead tried to blame it on us and pressure us to accept a tile that wasn't what we wanted or had already paid for. He doesnt seem to understand that if it is in the contract, that he has a obligation to either install what is in the contract or discuss the situation with us first. The tiles that were partially installed had a greener cast to them than the ones we had selected, which had a much bluer tone. **** did not offer to change the tile. It was ****'s argumentative behavior and missed deadlines, on top of all of the mistruths thathe has told us that led us to terminate the project.
3. JE Clear Pools owes us a refund of the money already paid them, as they did not complete the work contracted and the work done was done incorrectly. We have paid them $17, 200 and they have offered us $3,400 refund, which we have refused. We refused it because JE Clear Pools did not advance purchase any specific items for our pool, as required in the contract, with the exception of the tile, which turned out to be incorrect. In addition, they are trying to expense things to the project that we never agreed to pay for such as sales commission, gas for company vehicles, the incorrect tile, etc. Finally, we will incur extra expense to fix the pool surface that they damaged with their unskilled labor during the demo.
We have offered to reimburse the JE Clear Pools for any materials that they purchased specifically for our project, if it was delivered to our home and an original purchase invoice was provided. JE Clear Pools has never delivered any materials nor any invoices.
The only investment that JE Clear Pools has had in our pool is about 100 hours of labor (between 2 employees who intermittently worked on the demo of the pool over the course of 2 weeks). Figuring the average rate of $20/hr for unskilled labor based upon local averages, we feel that we're *********** a refund of $15,200; however, when you figure in the additional expense that we will have to pay to get their mistakes repaired, $1700, they end up owing us $16,900.
JE Clear Pools does not dispute that they owe us a refund, they are just not taking any action to make things right. After we refused their ridiculously low ball offer, they simply stopped replying to our emails and letters. They refused to sign for the certified letter that we sent.
3. In addition to all the other issues, it has come to light that JE Clear Pools misrepresented their ability to install Rico **** loveseat in our pool. Rico **** was the company that JE Clear Pools sold us on as an addition to our existing pool, and even built it in the contract. **** told us numerous times that our rock loveseat would be delivered "sometime this week" and that they would have to have several men there to maneuver it into the correct place. He even said we might need to remove some of the screen on the porch to get it into place.
As it turns out, 2 additional contractors who were bidding to complete the job that JE Clear Pools left in such a mess, reached out to the Rico **** folks to get the rock ordered for our project. Imagine our surprise when we found out that the Rico **** cannot be installed in an existing pool because it requires a specific concrete foundation to support the rock. We strongly suspect that **** knew this, as he had his person go ahead and install the tile (wrong tile), rather than doing the plumbing for the loveseat then doing the tile. JE Clear Pools didn't do anything to start the work on the loveseat (remove pavers to facilitate plumbing, run plumbing lines, etc.)
4. JE Clear Pools has been dishonest from the very beginning of their interactions with us. They lied about when they would start the pool, about purchasing all the necessary items in advance, about having skilled laborers to do the project, about the tile (tried to tell us it was the same tile by just another name), etc. and they're lying now in casting us as the difficult customer that they just can't seem to make happy, even though they have messed up our pool and left us in a mess, without lifting a finger to make things right. I guess blaming us is the last option they have because they certainly can't defend their work or themselves any other way. You only have to look at your recent YELP ratings to see that there are several families in our same situation and that dishonestly is a way of life for them.
This can be settled if they will simply pay us the $16,900 that they owe us. We intend to continue to pursue this to the full limit of the law.

May 5th 2022 I signed a contract with JE Clear Pools for a pool that costs me 118,900.00. I have paid 108,166.00 and I have not received the quality I was promised. The work started after the permit was given and it stopped shortly after in August. Once I paid the 108,166.00 no one else came out to finish the job, I have emailed the owner numerous times and all I get is we will change the timeline and still no new timeline or the job being done. The pavers are all over the yard and I live in a community and as noted the lien after each payment has not been issued either. The communication with the owner is horrible. My yard looks horrible with weeds growing all over the place and snakes coming out. Material has been left and has gotten damaged. I contacted the company that builds the pool cage and they told me that this pool company is horrible about paying them. The timeline as promised has not been full filled.Business response

We have resume work and we have been taking care of many things that have not been done as a result of the delays we have in all our projects. Mr. ********** claims that because the payment schedule in his contract, we were not going to finish it, but we reiterate that JECPL will finish all our signed contracts but as a result of all the difficulties, issues, delays we have been facing, all projects are delayed. We will be finishing his swimming pool very soon and the screen enclosure subcontractor will built the screen cage once we completed the last step on the construction process. I am rejecting this response because:I have no reasons to change anything in my complaint. The pool construction can only be completed through work and not with empty promises.
This answer from Mr. Jose E. (manager of JE CLEAR POOLS) comes 11 months after the company stopped the work on my pool and 4 months after my complaint.
This actually says everything about the seriousness and professionalism. I can not imagine what they wanted to say by "taking care of many things". The construction site still looks like in August 2022 when the company stopped the work. The pool construction had to be finished in February, 2023. It does not correspond to the truth that I have understanding about his approach to this project. We have not agreed on a new schedule. We made several attempts to communicate and each time a new reason for delay was presented.
I did not accept the first reason (hurricanes) because this region was not affected by hurricanes and the company JE CLEAR POOLS stopped the works 2 months before hurricanes. After that, other reasons were one after another: Rain, Family and Company internal issues. The reason of pandemic is new, but it is not true. JE CLEAR POOLS has started many projects after the work on our project was stopped (August 2022).
The company is not able to manufacture the pool construction and for this reason I see only the possibility to get the money back and hire another company.

I will try to summarize the facts:Contract design (s. attachement)
Contract Start: May 2022
Contract End: February 2023
Project Price: US $ 118,500.00
Paid until August 2022: US $ 108,166.00
Work Stop: August 2022 (after last payment)
Current status August 2023 is the same status of August 2022 (see photos in attachment)
The company JE Clear Pools has sent only a couple of messages since August 2022 with the promise that they will start work "next week".
I must mention that we did not pay to receive some SMS with promises. These SMS have only the intention to simulate that the company has the intention to work. According to the Florida Legislation, what the company has done is criminal. The company took the money and did not deliver. The company is not able to deliver and must pay back the money I paid.
Your question is clearly answered: my problem is not solved (pool is not finished and I have not received the money back). I cannot consider the SMS with empty and untrue promises as activity on this project.
The company answered my complaint only after 4 months. I did not accept this answer because it is not the truth. My question to BBB was: Why don't you publish this answer from me? More than 2 weeks have passed and it has still not been published.

Hi we are in the rainy season and we had alot of rain the last couple of weeks. We have our bobcat on site to work but due to rain we can’t work. We will be out there as soon as weather gets better and keep working on this project, unfortunately we had to make some changes to staffing and management and this has got us a little behind. We will be out there in the next week to keep working with pool and get done in the next month or 2.Customer response

My answers from 07/16/2023 and 08/02/2023 are still valid (I have no reason to change anything in my answer). In addition, I also reject the last answer from JL CLEAR POOLS (from 08/23/2023).
Company JL CLEAR POOLS has stopped the works for 13 months. There were very many days without rain in these 13 months. Even in rainy season it does not rain every day and if it rained at all it was 30 min afternoon-evening. So the rain cannot be accepted as a reason. I don't want to make an absurd weather discussion; in reality it rained very rarely. This can be seen in photos I sent, how little water there is from rain.
I repeat: I paid for a pool construction that had to be finished in February 2023. The construction is not finished and the money I paid is not refunded. I did not pay to receive text messages with promises and I did not pay to park a bobcat on my property. The bobcat is only parked to simulate that the company have the intention to work.
Possibly JE CLEAR POOLS knows that there will be an inevitable official complaint (by authorities) against him and tries to impress the investigators by this „bobcat parking action ". We have already suspected this and we have informed the investigators. The problem that the company JE CLEAR POOLS will have is that the neighbor will build a fence soon and there will be no exit for the bobcat. But this will not be my problem…and I have doubts that the company JE CLEAR POOLS is able to finish the pool until the investigations start.Initial Complaint

We signed a contract for a pool to be built on September 14, 2021. After many hours of trying to get ***************************, owner of JE Clear Pools, we are still waiting to have our pool finished. Our contract stated 37 weeks until completion at most. We have been undderstanding that there are things unavoidable but he has giving us numerous deadline and none have been met. We gave him our money at the times the contract states. Which was ******. on December 29, 2021. I feel he has used my money to complete many other pools that were started after mine. There is at least another ********* dollars in work he hasn't completed. I would definitely not advise anyone to use his company. I just want my pool completed but he seems to think I not important since he has my money already.Business response

During the last two years, we have been facing unprecedented difficulties as a result of the pandemic. Since the day we started business, JECP have been working diligently to complete all projects within the promised time line but all theses issues we faced, delayed the original time line to all our projects. ************** Project was affected by these delays, but we worked diligently to finish this project. We completed the project recently and the punch list is the only pending task. ************** and family are now enjoying their new swimming pool, and we really appreciate his patient and understanding during this long construction time. JE Clear Pools is now in breach of contract for unfinished work past the contractually allotted time. I'm apparently joining a long list of customers who have complained about the company based on the numerous poor reviews that have popped up on Better Business Bureau, Buildzoom, Yelp, etc. Links below.*************************************************************************************** *************************************************************************************************************************************************** At this point, the optics of the situation looks like a pay-upfront and then run situation. I have paid upwards of $62000 with no hopes of completion or timeline in sight. Since November 1st workers have showed up only twice for a total of 8 hours on the project and I sit with a dangerous hole in the backyard that poses a serious hazard for anyone who comes into my backyard.I signed my contract with them on June 24th 2022 with a completion period of 4 to 8 months. The 8th month ended at the end of February 2023 and the the last time any full time work was done on the pool was the end of October 2022. Any contract and transaction is dependent upon the good faith of each party to fulfill their obligations (customer to pay, vendor to complete and extend good customer service). I'm sorry to say that this is the worst business experience I've had in my life. No customer service, no sense of obligation to meet what they said they would, no qualms about lying to customers about call backs or their ability to fulfill the contract, no work for months, no oversight, no project management, no management of expectations, no follow-up, no communication between workers, owner, project manager, sales, admin. Just another example of a company in complete disarray. You deserve better than this. Pass this company by, run away, and go with someone else.Business response

Hi i have got together with the homeowner and gave him a timeline, we spoke about his issues and they have been addressed in the timeline, also explained to him how things are delayed and having issues with labor. These delays are more in new pools not remodels.
