    On August 21, 2023, we contracted APerfect 10 Fencing to install fence on our property at *********************************. When they installed the fence they installed it 3 ft from the property line. We did not realize this at first. As a result we lost sod that had been installed because of lack of water. When we did realize it, we had them return to change it. They refused to move the fence. Instead they moved the sprinklers so they were in front of the fence. At that time they also damaged one of the posts. They claimed that the damage was done by a lawn mower not them.

    The fence was installed from September 18th-21st, 2023 - per the survey that we have on file (see attached). The ******** (homeowners) were responsible for clearing the property line of trees/ brush prior to the start of installation, in which this was not completed by the time of installation. Our lead installer, *****, contacted the ******** at that point and was informed to hold the fence in, which we did as agreed upon with the homeowners. Even if we were to have been given the correct survey at the time of installation, the fence was held in (as agreed) to avoid the trees/ brush that had not been cleared by the ********. 

    In regards to the damaged post - the damage was about 6" to 7" off the ground at the same height of deck/ tires on a lawn mower. *********************** (wife) approved of the irrigation head being moved inside of the fence and the sod was as green as ever when our installers were completing the repairs for the irrigation.

    I am rejecting this response because:

    Our property was cleared, sod had been laid and the sprinkler system was all ready installed when the fence was installed. 
    My question is why would you install a fence in front of the sprinklers or even inside where the sod was installed. There was no brush or trees in the way because the property had been cleared. The original estimate shows that there was 33 ft from the corner of the house to the property line.
    The only thing we agreed on was on the other side of our property because there was a large tree on that side. 
    There was no agreement that we would clear the brush. 
    We had Perfect 10 install our fence at our former home and we were satisfied with what they had done. They cleared the brush that was in the way of the fence at the time. We expected that quality of workmanship on this home as well.
    The grass was not green because it was not getting water from the sprinklers. The sprinklers were on the other side of the fence. Also one of the sprinklers was inside the fence post as the gentleman who came out from Perfect 10 pointed out to me.
    I did not know at the time the fence had been installed incorrectly which is why I agreed to them moving the sprinklers in. 
    All we wanted was for them to move the fence so that it is in the correct area.

    In 2012 I paid $250 and had my property surveyed and supposedly they used the survey to install my fence. The property at XXXXX ******* **** eventually became a rental property. The investor decided to sell the property thus last year and this year had the property surveyed. Each survey showed Perfect 10 installed my fence on their property. I contacted Perfect 10 regarding this and they sent me a contract and want me to pay about $650.00 to correct the fence because of their error. The house at XXXXX is on market presently.
