    I am writing of my horrible experience with Mendieta Roofing Company on the roof job that started 6/10/22. From the beginning they have had nonexistent or inconsistent communication. They showed up at the house the day before they said they would come when we were at the hospital giving birth to my daughter. They started the work without our consent and caused damage to our car in the driveway.Then they installed the wrong color shingles and I was the one to notice and texted them and they blamed it on the supply company, even though their men installed it anyway. They had to come back to uninstall them and in doing so they re-installed it incorrectly on a day we had a torrential downpour. We started getting leaks all over the inside of our home because of this. We called the owner and he did have someone come out and paint the ceiling. Because of this, we had to find somewhere to stay for a few days until the paint dried since I cant have my newborn around paint fumes.We ended up using a financing company for this project and when we received the final paperwork to sign, Mendieta increased the price by 50% (the contract price was $10,700 and they increased it to $14,790) without our knowledge and forced us to sign and pay and threatened to put a lien on our property if we didnt, although the owner explicitly stated this increase terms are not in our contract and we obtained proof from the city and their supplier that there is no reason for the increase. The supplier he purchased the plywood from said that plywood costs $84/piece. The contract did state that the first 2 pieces of plywood are free and we would have to pay $120 per piece after that. He replaced 16 so if we pay what is on the agreement, $120 X 14 = $1680 in order to adhere to the contract, which we agreed to pay in addition to the $10,700. He disagreed to go below the inflated price of $14,790 and threatened a lien on the property if we dont sign.

    We here at Mendieta Roofing Corp., have over 40 years of experience without incident. At the start of every journey with our clients, we educate and communicate all aspects of different options in order to better help our customers to make the most of an educated decision. It's part of our work culture and our company's ethics. We pride ourselves in showing up on time and on the reputation we've built. The disinformation that sometimes distorts the credibility of a company can be easily discovered when the company has contracts in place. Once the contract is signed, both parties agree. The contract ensures that all parties are well informed at the time of signing. Mendieta Roofing Corp., in our contract it clearly states that we will not be liable for liquidated damages or delays caused by materials suppliers, manufacturers or any other event beyond our control. The challenge was when the customer had to be charged an additional amount due to the material that was installed on the property. We finished the job 100% to the best of our ability. We passed all inspections, including the final. We never received any complaints about damage to a vehicle. After the job was completed, the client never contacted us again regarding their concerns. The two parties in communication were the financing company and the client. Mendieta Roofing is not at fault. Any doubt, please contact us.

    I am rejecting this response because:

    The company is not following the contract we signed (copy attached) where we agreed to the price of $10,700. I also have screenshots of them admitting via text message (attached) that they are charging us fees that are not stated in the contract, and thereby not adhering to the contract that we signed.
    They increased the project cost to $14,700 and submitted their updated invoice to YGrene Financing directly, without any prior approval or notice to us. Furthermore, they lied to ****** and stated that we have been informed and agreed to this new price of $14,700, neither of which happened. The only documentation that was signed by us (as you can see attached) is the original contract. There was never any communication of any increase in price.
    The contractor states above that the increase in price is due to a new building code and that he had to purchase new material to follow this new code. He sent me a copy of the work order from which they purchased the extra plywood pieces. I contacted this supplier (and feel free to do so yourself) and they verified that the cost of the plywood they purchased is $84/piece. The contract did state that the first 2 pieces of plywood are free and we would have to pay $120 per piece after that. He replaced 16 so if we are in compliance with what is stated on the contract, it would be $120 X 14 = $1680. The total project cost would then equal $12,380. After we noticed this sudden increase in price from YGrene directly (we were never notified nor did we agree to this new price before they submitted without knowledge to the financing company), we tried to communicate with the contractor via text messages that we agree to follow the contract pricing and would pay $12,380. They threatened to put a lien on our property and forced us to pay the greatly inflated price of $14,700 without any justification or documentation of proof of this increase in price as I already proved via the supplier that it costs even less than the price per piece stated on the contract, which we agreed to pay.
    My husband and I visited the City of Wellington to obtain more information regarding the roof work, permit and building codes that the contractor claims was the reason for the increase. The company states they have been in business for 40 years, however the building code that they claimed is new has been in effect for several years. The City of Wellington advised us to seek legal action and to file a formal complaint with the BBB as they have not experienced a contractor grossly increasing the price of the project and materials,especially without our knowledge. They never even submitted this new pricing or invoice to the city. The only documentation the city obtained was the original contract signed by us.
    Additionally,I have text messages from the company stating that they would arrive to begin the work on Thursday, June 23rd. As you can see in the text messages, on Wednesday June 22nd I notified them that I am in the hospital giving birth, yet they showed up unannounced the day we were still at the hospital, asking us to move our car yet we were unable to because we still had to get discharged from the hospital and an hour away. As you can see in the text messages, they chose to begin the work anyway without our consent and stated that they are not responsible to damages to the property or the car. The contractor states that I never told him we experienced damages to the car, yet I have screen shots of my text messages to him stating that they damaged our car.

    The contract that they attached included quotes for two different projects and they combined the contract into one. I previously attached the contract that we signed when we first met them for the $10,700 to replace the entire roof. When they arrived to our home we received two different quotes: one to fix specific parts of the roof and not replace it completely, this quote was for the $2100. The other quote was for $10,700 is for a new roof replacement. Why are they trying to state that they are combining the amount that they previously quoted us to repair the roof into the total cost to replace the roof completely? This doesn't make sense and the proof is that it doesn't even add to the total amount that they charged is in the end which is $14,790. If you add up the quoted price to repair the roof plus the total roof replacement cost that they are trying to add to the contract above, it adds up to $12,800, not the amount they charged us $14,790.

    Additionally, I called the supplier they purchased the "special" fire-resistant wood from and the cost of that wood is $84/piece. This means if they purchased 16 pieces, the extra cost they incurred would be $1,344 + the quoted price of $10,700 = $12,044. Please feel free to contact the supplier yourself to confirm this. So there still is no proof for the difference between the original quoted price of $10,700 and $14,790.
