    On July 3, 2024 at 7:00 a.m. in the morning I came downstairs to make a cup of coffee and to take my grandsons out for the day and realize that my whole downstairs apartment was flooded. I put down towels and told my grandsons let's get dressed and get out so that we can be out of the way so that maintenance can come in and fix whatever needed to be fixed. I was not able to spend time with my grandsons for a few days as I usually do and had to take them back home.The maintenance team came in several times and vacuumed up the water but the water kept coming through the floor. and when I spoke with workers at the office on the phone she told me that there was a structure problem underneath the building and that the whole building was flooded then she came in and took video and photos and saw there was water still coming through the floors but did nothing about it. The apartment manager came and looked at everything and walked through my apartment and took pictures and video. All is asked for was my rent & expenses back to move since I paid $1350.00 my rent on the 1st of July and on the 3rd my apartment was flooded and I had to move out by the 11th because my apartment was continuously flooded and I could not live in sewage water anymore. I thought that they would be able to fix the problem and the office manager ***************** said that there was a problem with the plumbing underneath the building and the structure of the building as well was not stable. I called code enforcement and they came out and I'm waiting for their report. I also had to use money to renew a new lease, purchase a storage unit, U-Haul truck, and pay movers to move me out. Also I could not cook in my kitchen because of the sewage that was coming up from the floor so I had to eat out for 7 days.$1350.00 July Rent $1200 New lease $100 Public storage $200 Uhaul truck $150 Food expenses $500 Movers I am asjking for my rent back and all expenes for having to move our abruptly.

    Hello, 

     

    Firstly, I would like to apologize for the plumbing issue that recently occurred in your unit. As soon as we were alerted to the issue we managed to clean up all the water and temporarily fix the issue. After the first instance, we discovered the issue came back and as soon as humanly possible, hired a professional and diagnosed the problem and that it was under the building and fixed the issue in it's entirety. The building is structurally sound, you may have been confused with the description of the issue by Management. I have spoken with code enforcement about the issue and they have also determined that the building is structurally sound. Plumbing issues are very common, especially with apartment communities of this age and Management did remedy the situation quickly and completely as soon as we were alerted to the issue. You chose to vacate the unit voluntarily, with no advisement from Management which violates your Lease Agreement, Paragraph 9: Early Termination 

    "Provided Resident(s) is not in default hereunder at the time of giving the notice provided for in this Section 12 and strictly complies with all of the provisions of this paragraph, Resident(s) may terminate this Agreement before the expiration of the original Term by:
                                Terms and Conditions of this Early Lease Termination Clause
    (a) Giving Landlord a thirty (30) day written notice to vacate. The thirty (30) day notice must be received by management on or before the first day of the effective month the lease is scheduled to terminate; plus
    (b) Paying all monies owed thru the date of termination; plus
    (c) Paying an early lease termination fee in the amount of one (1) months rent; plus  
    (d) Forfeiting the Security Deposit as a term and condition of being permitted to terminate this lease agreement prior to the lease expiration date.  
            Residents election for early termination shall not relieve Resident(s) of his responsibilities and obligations regarding any damage to the Premises. If the notice to vacate is not received within thirty (30) days of the early termination notice, resident will be responsible for the rent of the full term of this lease agreement or until the unit has been preleased, whichever event comes first."

    Unfortunately, you are not entitled to any refund for rent nor any other expenses as you have violated your signed Lease Agreement with Management and you will be charged your full rent balance from the time that you notified Management of your vacating and thirty days after that as well as a one (1) month's rent as your early termination fee (see above Early Termination Paragraph).

    I have attempted to contact REMG CORP LLC regarding being notified by a collection agency that I owe a balance to "*********************." I contacted the apartment community (*********************) directly and was notified that they are under new management, and I would need to contact REMG, which is the previous owner. I knew attempting to get in contact with **** was never going to happen because I had tried to contact this company multiple times while I was living in the apartment from 10/22/2021 - 06/02/2023 to no avail.So I have no other choice but to file this complaint. This is in regard to being notified of a balance owed through a collection agency in the amount of $765. I would like to know details about what caused the balance. I made the last prorated rent payment for my apartment on 06/02/2023 in the amount of $61 (for days 06/01/2023 & 06/02/2023) and also returned the key that same day. My apartment number was ****************** Apartment C. I called the community a month after I moved to check on returning my security deposit and was not notified of any outstanding balance. Please provide additional details on the balance that has been reported to collections.

    On 9/28/23 I informed my landlord or many issues in my apartment. Such as , leaking pipes which has a huge puddle in my hallway. No drawer in kitchen. Doors dont close to big for their frame. Kitchen sink pipes keep falling. Pipes leaking by hot-water heater. And I have called , sent email and went to the office. No one has been to my apartment at all to repair any of these things. I was told when I first moved in that everything was ready , and brand new. This apartment has electrical issues. Leaky pipes. And the maintenance team is terrible. The management is even worse I havent seen the property in 2 weeks

    0 stars for this company management, The first day we moved into this apartment,( **************** ) the ** unit was not working, we was without ** for at least 3 to 4 days. They came to inspect it and said they ordered the unit and are waiting on it, there is no form of communication and we have to keep in touch with them just to make sure it was fixed. The whole apartment is in a bad shape, the kitchen cabinet doors do not close , the barn doors are off the tracks and you have to fight with the doors every day to open and close them. However the bigger issue is the flooring of the apartment is horrible, it feels like you are on a mini roller coaster ride, we had a ticket in to take a look at the corner of the floor as it was sinking , took them a week an half to come out , he took a whole week to get it fixed, we had a hole in the living room , the reason it took a whole week was first excuse needed the card to purchase items, 2 excuse was he was sick and he cant complete the job. He finished the job in one week. We had another ticket for the bathroom as the water does not drain, We have to drain the water manually every time we take a shower and the floor of the bathroom is sinking day by day. Not fixed till this day. The management came out to tour the apartment along with the contractors to see the issues, we have been calling almost every day for an update but all we get was, we only have one contractor and they are in Alabama now and we have to wait for them . Basically everything is a waiting game, nobody is able to take this seriously or have any sense of urgency on how important this situation is. It is pulling teeth to get anything done here in this apartment. We are not asking for any kind of compensation but to just get the floors fix and for us to be living comfortably in here and not worried if we will fall right through the floors when we walk or take a shower.

    *** told them multiple times about my AC . It does not work properly because it keeps leaking they told me if I break my lease I would have to pay or it would be on my credit but at this point this is not a good environment for my kids. I would actually like to take legal action because I dont think ************* are even certified to work because of so the problem wouldve been fixed last year. My carpet is super wet &smells like its molded Im constantly using my towels to dry up my floor. I would like to know the next steps I should take because its not fair to me to continue paying when this is unacceptable

    I understand my lease termination fee , but as soon as it breaks again Im sure I will have the same issue I shouldnt have to fee a termination fee .. but Ill purse a lawyer because Im sure I will need it

    I have been complaining about rats since the beginning of February and the company has done nothing to solve this issue while I was still paying my rent on time. *** asked to have my rent reimbursed for this month so that I can vacate this rat filled apartment to find a new place, days later this is their response. Its like they are doing me a favor by waiving the early termination fee, when its their negligence caused this issue. *** missed worked, stayed up at nights paranoid hearing rats walking caused emotional stress along with anxiety. This is not how you treat your tenants, how would you feel if you had to sleep with rats with your kid? when you complain they ignore your issue and the only response you receive is to leave in less than 2 weeks. What about the rats that I have to live with right now? What about my moving expenses? Are you reimbursing me for my food and lodge? I cant cook in a kitchen with rats. I will have the health department involved I have a 3 year old child here.

    Management's concern is with your inconsistency on your plans for tenancy. From what I have learned from the property, YOU were the one that made several attempts to renew your Lease Agreement. We're perplexed as to why you would renew your Lease Agreement with our community if it caused you so much "emotional stress and anxiety". We JUST sent someone over to your unit to work on your concern and you told them to leave. We are holding firm on our decision to only waive your early termination fee should you vacate the premises, remove all belongings from your unit and return keys to Management by the 31st.

    see attached tickets starting from February why nothing was done in February? I did not reject anyone the exterminator actually came inside my unit and looked at the fixes that was made at my expense I have cameras inside my house and I am more than happy to play it back that they were inside my unit it was 3 of them The neighbor next door was also present if you need a witness.  Honestly, I want an answer to my question, why my tickets from February is now being addressed? You all as a management company did not hold your promise to make fixes in a timely manner or offered a solution at that time it was ignored until now because I have a recording of the rats. You are correct I renewed my lease in a good faith, I came and talked to the leasing manager face to face and stated all the issues and she assured that it was going to get fixed then I signed it. This is the reason because I trusted you all to get it done. Also, its very inconsiderate to say my best option is to vacate in less than 2 weeks. Who is going to pay for my moving expenses if I have to take off from work? I have to find another daycare for my child as well and pay the registration fees again.. this is a selfish and very inconsiderate . Lets also talk about why the tenant stayed here before moved out of here because of the same reason - rodents! ******* came by to pick up his old mail and showed pictures of his couch destroyed by rats, this is nothing new to this management. If you look up ***************** bbb complaints you will see another tenant posted a one in February of this year complaining about raccoons(rodent) being inside a unit and the management did nothing about it.

    I HAVE BEEN A RESIDENT AT PARK AT FOUNTAIN LANE SINCE 5-22-2020. THERE HAS BEEN NOTHINGGG BUT PROBLEMS SINCE I MOVED OUT THERE. I HAVE EMAILED, CALLED, AND TOOK OFF WORK TO COME IN PERSON SO MANY TIMES THAT IT IS ABSURD. THEY HAVE SWITCHED OFFICE STAFF AND MAINTENANCE TEAMS SO MANY TIMES SINCE I'VE BEEN OUT THERE THAT EVERY FEW MONTHS I FIND MYSELF EXPLAINING ALL MY PROBLEMS ALL OVER AGAIN. I SPOKE WITH *** AND ***** (THE REGIONALS) BACK ON 10-6-2022 AND EXPLAINED EVERYTHING AND THEY TOOK NOTES OF ALL THE PROBLEMS, PROMISED TO RESOLVE THEM, AND SAID THEY WOULD GET BACK IN TOUCH WITH ME. I HAVE NOT HEARD FROM EITHER ONE OF THEM SINCE. MY GUEST BATHROOM'S TOILET HAS NOT WORKED SINCE OCTOBER 2022, OUR BREEZEWAY LIGHTS HAVE NOT WORKED SINCE 6-13-2022, MY KITCHEN SINK HAS BEEN BACKING UP SINCE NOVEMBER 2022, MY AC STALLS BEFORE IT COMES ON, MY DOOR FRAME IS NOT SECURE, MY WASHER BOX WAS SUPPOSED TO BE REPLACED LAST SUMMER, AND A HOST OF OTHER THINGS. THEY EVEN WANT ** TO PAY FOR INDIVIDUAL LIGHTS TO GO OUTSIDE OUR APARTMENTS BECAUSE OUR BREEZEWAY LIGHTS HAVE BEEN OUT FOR ALMOST A YEAR. I HAVE TRIED TO BE AS PATIENT AS I KNOW HOW BUT I AM EXTREMELY UPSET THAT I AM PAYING FULL PRICE RENT GETTING TREATED LIKE THIS.     I dont have hot water in my unit since the beginning of this year and tried numerous times to get in touch with the leasing office to have it resolved. It is not going anywhere, its almost the 4th month, and I have a small child.

Management has been working with local repair companies to fix our boilers and greatly appreciate your continued patience. Hot water should now be restored to the entire property.     You wrote a false statement because my hot water is not back as of 3-22-22. I still cannot get a response from the leasing office and no one came to d fix the issue, no one reached out. I still do not have hot water since the beginning of the year. I am going to take legal action if this is not resolved. This is unacceptable!

    For 3 weeks I have had no access to my heat or air conditioning unit. I have spoke numerous times with the rent office and only once has someone been over. I recently advised rent office that it was unfair for me to be forced to live in these conditions and that I would not be paying a late fee as I am not getting the ammendities that we're outlined in my lease. My refrigerator has been leaking since January and my back shower I'd not working properly. These are a few issues I am forced to deal with and when I spoke to the assistant manager she informed but it didn't matter if my unit worked or not because it just started to get hot outside. She was rude and continued to get loud with me while over talking me. Since I have moved here in 09/22 I have yet to have a month were there are no major maintenance issues and the office just lies about when it's going to be resolved but still expect payment. I am late due to fact I wasn't going to pay rent if they aren't able to make my living situation comfortable and follow the maintenance policy outlined in my lease. I have called the corporate office several times and left voice-mail yet to hear back.

    Our maintenance techs have been to the unit and replaced the refrigerator, installed a temporary unit for the immediate until we were able to receive our order for the part needed to fix the A/C unit. We made several attempts to install the part for the A/C unit however we were not granted access. We communicated with ************** to set up a time we were able to install the part. We are in the process of installing the necessary part. We apologize for any inconvenience this may have caused and we greatly appreciate your patience.
