    On June 26th, I purchased a Tasaki pearl necklace from Gallery 63. It took several weeks to get the item. In an email, they indicated that the item was locked up and inaccessible. Later, they called and said it was damaged and had been sent for repair. I eventually received it in late July. The necklace is not as described. It weighs 1 gram (not 1.8 as described). It is approximately 15 inches long (not 29 as described). Copies of the description from the website and my measurements are included. It is missing part of its clasp and is not wearable. I reached out through their website a couple of times (no copy of the request) and once through my email account (scan of email included). I attempted to reach out by voice mail (no return call) and on another day (leaving a voice mail was not an option). I also attempted to contact them by certified letter (refused); a copy of the tracking and the letter is included. I have also provided a copy of the invoice and the page that indicates that it is paid. I have filed a dispute with AMEX last week, who has accepted the dispute so far and credited me. However, I want to get a formal response from this business that they will not submit a new charge or otherwise dispute my dispute. I am happy to return the item if they can tell me when they might be open for me to do so. Thank you for your assistance.

    The necklace you received was exactly the same necklace you purchased. You charged back while being in possession of the item. In *******, this is theft/ fraud. As such, we rejected the chargeback and it was almost immediately decided in our favor. The charge will remains.

    Please read my documentation and my attempts to contact you, including by certified letter, return receipt requested, which you refused. The necklace is not the one I purchased. As you will see in my documentation it is almost half the weight of the listing . It is almost half the length of the listing and it is missing a key component of the clasp after it was repaired. Please reconsider your response and please review my documentation. Thank you.

I CALLEDOFFICE MGR. SEVERAL TIMES AND THEY NEVER GET BACK TO YOU. THEY SAID THEY DON'T AUCTION JEWELRY ANYMORE AND ASSURED ME GALLERY 63 WOULD SENT BACK WHEN THEY GOT MY EMAILED *** LABEL-THEY RECEIVED IT FAIRLY SOON. NEVER RECEIVED MY PROPERTY.     We do not accept unsolicited consignment. You mailed us a package without any prior contact or agreement for us to sell your item. All consignment requires prior written consent and a signed consignment agreement. This is standard for the industry. We can not be responsible for items mailed to us without prior notice.

     

    We informed you that you needed to provide us a return label, and we would gladly return your package. After several months you provided a label to us and we sent the package back to you. Your package has left our facility with the label you provided. At this time, there is no further assistance we can provide.

    The photographs of the auction items are not at all what you'll actually get. For example, their online pics of a Chanel bag show a working zipper with a pull, but they don't show you a pic of the broken zipper without a pull. A Cartier travel bag shows a beautiful, perfect handle, but they don't show you that the underside is ruined. They give false valuations as well. They valued a Cartier bag at $1,200 - $1,400 where the value is $350 for a perfect, pristine one (which this one was not). Absolutely deceptive intentionally. I would like a full refund. I feel so scammed.

    You have already given us multiple bad reviews, and I have responded to all of them. 

     

    First, you purchased several designer bags from ** and baselessly insisted they were inauthentic. I proposed a solution that you could have a trusted 3rd party verify their authenticity. And should they come back as inauthentic, I would reimburse for the authentication and provide a full refund. We sell tens of thousands of designer purses at a variety of venues across the country every year. Gallery 63 100% stands by every bag sold as authenticity, just as I did with the bags you purchased.

    When the bags came back as authentic, you shifted your complaint to buyers remorse. We are an absolute estate auction company. Our very first term of sale that all bidders, including yourself, agree to acknowledges the point that all sales are final. Furthermore, all customers are given ample time to review and ask questions on items they bid on. We start all lots at $100 or less and post our catalog for public viewing/questions for at least a week. In this time, you chose to take no action.

    Now you have fraudulently issued a chargeback, while still maintaining over $2000 worth of designer hand bags. This is felony grand theft, and we have no choice but to get the police involved and pursuit charges.

    I am rejecting this response because: The issues is not authenticity at all -- your response, much like your business practices, is full of deception and an attempt to divert from the actual issue at hand. Please take a look at the attachments -- they show a side by side view of the photo from your auction site of the item, and then another photo showing what the item looked like in real life. 

    I would love to send your items back for a refund. They are still in the box they came in -- as soon as I saw the items were not what I paid for or bid on (according to what I believe to be fake pics put on the site) I packed them right back up. They remain in a back guest room. Believe me, I have zero interest in retaining them. May I please send them back for a refund?
