To Whom It May Concern,I am writing to formally file a complaint regarding Manheim Texas Hobby for their failure to return my license plates after I attempted to retrieve my repossessed vehicle on January 17, 2025. During my visit, I was informed by a representative that my license plates were not available, and I was instructed to purchase new plates. Upon further research, I have discovered that this action violates Texas law, as license plates are considered personal property and should be returned to the vehicle owner during or after repossession. I also have no money to buy new plates. Manheim Texas Hobbys decision to withhold or dispose of my license plates was not only unjustified but also caused unnecessary inconvenience and expense. I have since learned that it is the responsibility of the repossession agent or auction house to return all personal property, including license plates, to the rightful owner.Details of the Incident:Date of Incident: January 17, 2025 Location: Manheim Texas Hobby, *******, ***** Issue: Failure to return my license plates and subsequent disposal without my consent.I request that Manheim Texas Hobby take immediate action to address this issue. Hello Team,I hope you are doing well!This is Nawaf Yafaei from STC Auto Sale - Auction Access# (*******- *********) in ******, **. I bought a 2022 Mercedes S-Class S 500 (VIN: *****************) for $62,315 with a 4.6 CR from Manheim Texas Hobby in *******, **, on December 20th and received the title on December 27th.I bought a car for my brother overseas and planned to ship it immediately. However, due to the holidays and storms in ******, I couldn't pick it up until January 11th, 2025. I was shocked to find several major and minor issues, including an engine problem. I documented everything with pictures and videos and showed them to the security team, who advised me to leave the car.I left the car at the location and drove 4.5 hours back home. I subsequently submitted an arbitration report detailing the 19 issues I found, along with the pictures and videos (attached). On Tuesday, January 14th, 2025, I received a call from the arbitration team informing me thatmy submission was deemed out of the 10-day window and that the car is now mine, leaving them unable to assist further. I was not aware of a 10-day window; I believed it was 30 days. Additionally, the severe weather during the holidays made driving very difficult for me. I also noticed that the website allowed me to submit the arbitration report even outside of the 10-day timeframe, unlike the **** which was closed for 7-14 days on the last day of the window. I expected a different solution from the Arbitration team. I have always believed in Manheim's condition reports and pictures, but this one was misleading me! I have reached out to the General Manager of that location, ****** *****, who said, "I cannot help with this claim."I hope you understand my situation, and I would really appreciate your help in resolving this issue. I am rejecting this response because:
The car's listing was MISLEADING as it didn't reveal the true condition of the vehicle. The car has a history of attempted theft; please see the attached video for evidence. Additionally, there are signs of flooding,as there is mold inside the car. The car was listed as a green light car while it shouldn't. It is not in good condition due to an engine issue and other ** issues:
1. A weird and unusual sound is coming from the engine; it is not normal. (Engine problem - which shouldn't be a green light car)
2. The trunk buttons are not functioning, and the trunk does not open and close automatically. (Signs of flooding)
3. The passenger window trim has cuts, dents, and scratches inside and outside. (Signs of attempted theft)
4. The rear right window curtain is torn, and its opening does not close completely.
5. The plastic cover of the rear right door is loose and has cuts and broken clips.
6. The chrome pieces outside the passenger and rear right windows are scratched.
7. The seatbelts show signs of mold. (Signs of flooding)
8. There are broken pieces and cuts on the black plastic components underneath the car. (Signs of a forklift or accident!)
9. The radar plastic piece is faded and worn out. (Signs of flooding)
10. One floor mat is missing.
11. The rear right window has a scratch.
12. There is dirt and mold in the interior of the car.(Signs of flooding)
13. Mold and rust are present under the sides of the hood and around the windshields. (Signs of flooding)
14. There is a yellowish **** on the driver's seat.
15. There is a cut on the bottom chrome piece of the driver's seat.
16. The sunshades and headliner are dirty.
17. There is a scratch on the rear left side of the bumper.
18. There is a scratch on the left side of the car.
**. The right-side rims have scratches.
The ONLY ISSUE that was revealed on the condition report was issue# **. (See the attached Manheim Condition Report)

I was unaware of the 10-day deadline to initiate an arbitration claim regarding my purchase. There was no clear communication with all dealers about this 10-day period, beginning from the purchase date. Considering the holidays and winter storms in *****, I believe there should be some exceptions and flexibility in this policy. Additionally, a representative at the location advised me to leave the vehicle instead of picking it up after he acknowledged the significant unlisted issues.
I hope someone from the BBB reviews the attached videos, which show undisclosed engine problems, signs of attempted theft and flooding, as well as the misleading post, and takes appropriate and fair action. Hello team,
While reviewing arbitrations information on **************************, I discovered that the eligibility for arbitrations guideline is governed by the National Auto Auction Association (****), which is responsible for protecting buyers and sellers and helping guarantee fair and ethical sales - ********************************************************************************. (See attached screenshots)
The ****'s Arbitration Policy, effective August 5, 2024, states that the arbitration time period is 30 days for cases involving Stolen Vehicles/Theft Recovery (including history), Flood Damage, and Stolen Vehicles that are Active/Open Theft. Additionally, there is a 120-day arbitration period for Flood Damage History. Please refer to the attached doc, page# **, Arbitration Policy - Appendix I.
Based on this information and the images and videos provided in the original message, I would like to clarify that the vehicle arbitration has been submitted within the ****'s guidelines. Several of the 19 major and minor issues I outlined in previous messages are indicative of Stolen Vehicle and Flood Damage History. Below are some of them.
1- Engine noise. (Engine problem- signs of flooding)
2. The trunk buttons are not functioning, and the trunk does not open and close automatically. (Signs of flooding)
3. The passenger window trim has cuts, dents, and scratches inside and outside. (Signs of attempted theft or it's been stolen)
7. The seatbelts show signs of mold. (Signs of flooding)
8. There are broken pieces and cuts on the black plastic components underneath the car. (Signs of a forklift, accident, or a stolen vehicle!)

09-29-2024 I purchased a 2009 Pontiac Solstice through Autotrader ****** miles no accidents and no service or mechanical issues. Many documents detailing a clear service report from the primary service provider used *** ***** in ******** and ****** reports on the site. I purchased for $18,522, On Nov 27 I took the vehicle to *** ***** and was told *** Internal failure and could not be fixed. I called autotrader and was told they wouldn't do anything although they and their site states" We verify vehicle registration as well as the seller's identity, confirm the vehicle has a clean title, and provide a FREE vehicle history report by AutoCheck on each listing. ************ stated they have not processed the check yet either but would apply a note with my concerns to see what could be done on their side. ********** sold me a vehicle that has major issues. On November 19, 2024 a payment of $4,002.00 was paid to reinstate my Motor Vehicle Lease Agreement with *************** Services. On November 21, 2024 a payment of $15.00 was paid to City of ********* PD for repossession receipt. The same day I went to Manheim ***************** for release of the vehicle and was advised they did not have the property; rather it was located in ********** at a ****** location named Extreme Adjusters. An appointment was made at 11:45am on November 22, 2024 for release of property. Upon arrival of the appt. I was advised the property is in FACT being held at Manheim *****************. A phone call to ***** Commercial Team confirmed a release was emailed/faxed to Manheim SF property at that location. Manheim SF does not acknowledge release and property. Car was repossessed by finance company. Car was sent to auction 3 days after repossession, overdue amount was paid to finance company the same day (11/15). Manheim closes at 12pm, would not make an appointment without release papers. Called this morning to set up an appointment for tomorrow or Wednesday. Was told that even if the car is releases, I cannot pick it up for 8 more days due to their lack of appointments. In what world is it okay to hold a familys only vehicle hostage for 11 days after **** is paid? I asked them what I am supposed to do for the next week, after dealing with it for a week already, and they told me it was not their problem.Business response

I bought a 2022 ******* Venue SEL (*****************). I find the car has unannounced damage with dashboard light of lane departure and other codes in scanner. This complaint is in regards to a unit I purchased on OVE via the Manheim app. It is a 2016 Jeep Renegade VIN# *****************. When purchasing this unit there was no announcements of DMV fees or expired tags etc. which are required when listing a vehicle. Especially since it was sold my a 3rd party seller. Well the vehicle had Dec / 2024 tags that were fraudulent since the tags were expired Dec 2023 according to ***. Due to that issue the California Highway Patrol towed the vehicle which was parked in the street for expired plates 6 months +. When I then checked the Manheim app there was no announcements of this as I mentioned earlier. It is the 3rd parties responsibility to cover those fees when selling on Manheim platform. They failed to announce that and they violated the law by putting a fraudulent 2024 sticker on the plate itself. This now has cost me several hundreds of dollars which I should be liable for ! This is Manheims fault and they should be the ones paying for all these fees since it was their mistake !! I paid $393 to get it up to date and be able to take the vehicle out of impound I must know pay the police release another $300 and also the tow yard for pick up and daily rate of $450. In total $1,143 in money I dont have especially when it is not my fault !! I demand Manheim reimburses me this money and either admits fault or charges the seller for their mistake and fraudulent acts. If not addressed I will contact an attorney and file litigation against Manheim for this issue.Business response

Manheim's management team was not aware of any issues regarding *********************'s purchase. An arbitration claim was never filed for *** fees. The consignment dealers are not allowed to announce the *** fees only the bank lanes. The *** penalties that would have been due are $141.00 which includes penalties for December 8th, 2023-December 8th, 2024 ($126.00) and a $15.00 repossession fee. Also, Manheim does not guarantee that license plates left on sold vehicles are good plates. A dealer's tag should be used when parking in public areas when buying wholesale vehicles.Customer response

Over the last 10 years Manheim has stolen from me on numberous occasions. From selling me non-runners, listed as runners, not following **** Guidelines, to undisclosed blown head gaskets (even on green light vehicles), The 3 most recent are as follows. 2008 Chevrolet Suburban - Took to ******* Location for Sale - after a no sale, the security personel broke the *** Port on the vehicle. Also while picking up noticed the driver side mirror cracked and broken. Manheim *********** refused to do anything about the vehicle damage, including discuss with the auction. Local Auction Phone Number just transfers to Manheim *********** unless you want to speak to Arb Team. 2007 ****** Solara - Didn't Sell at Carvana OVE Auction - I wanted to put a bid in after missing the auction ending. *********** informed me that its impossible to put offers in on vehicles after the auction. The vehicle launched the next weekend and sold for $1000 more than the starting floor. Manheim *********** was of no help. 2006 ****** Solara - completed the auction with the highest bid - Called into *********** who informed me they wouldnt do anything about the offer on the vehicle and i would have to speak to the local auction on monday to resolve anything. After trying to reach manheim oceanside **** with no success, i reached *********** ****** which did not return my call. Again *********** refused to help after numerous calls. I was told just to keep bidding on the vehicle until I win it. this has gotten out of hand at manheim. there is no customer service or anyone that will even help you in any way.Business response

I am rejecting this response because:Ive attached the SEVERAL TIMES ive reached out to Manheim *********** and to the Auctions to voice this concern. My complaints fall on deaf ears. None of the problems ive had, over the last 8 years ive been attending auctions, have been fixed. ALL of the numbers not blacked out are MANHEIM NUMBERS OR THE SELLER.
We want to speak about Manheim Oceanside, why don't you ask them why they wouldn't release a vehicle i purchased at ACV that was in manheim oceanside? 2014 ****** Camry LE VIN: *****************. The failure of them to release this gate pass caused me to miss the *** Deadline at *** and I got stuck again with a vehicle with a blown engine. About the 2006 ****** Solara - I've called and even emailed Manheim Oceanside, reached out to the seller directly and Manheim *********** none of which answered or even returned my calls.
Manheim Phoenix wont respond because the manager of Arbitrations hates me and my company for issues regarding the FIRST vehicle I got screwed on (almost 7 years ago). I've voiced my complaint at the gate and to manheim phoenix the following monday. Again it fell on deaf ears like every other time over the last 8 years. I had a customer purchase the vehicle and had no choice but to pay and fix it myself.
The Carvana Vehicle, i got no response other than I wont be helped. I was told to go directly to ******* and talk to them and Manheim would do nothing about it.
I have no problems contacting ******* and pull my phone records if nessessary all the way back until last year. Ive got everything documented!

september/26/2024 6.160.00$14 day psi ( pre-sale inspection )To ignore the car's faults.The business is making no effort to resolve the issue.I purchased the vehicle as a green light and paid an extra $170 for a pre-sale inspection. They provided a 14-day auction guarantee for this vehicle. The car was towed to my business, and there wasnt a single drop of coolant in it. I added coolant, and it leaked out immediately, as if pouring from a bottle. The rear main seal was leaking oil, and the rear differential was also leaking oil. Since I had the right, I sent the car back and opened a file to initiate an ARB. They got back to me on the last day of the legal period and informed me that they did not accept my claim, stating that the oil leak was inactive. They did not provide any explanation regarding the differential. For the coolant leak, they claimed it was a very inexpensive repair. I wanted to send the vehicle to the authorized dealership, but *** manager D.B. refused. I also requested that they share the *** report they conducted, which I paid an extra $170 for, but they refused that as well. They told me that I had no rights at all, but I know very well that I do have certain rights. Despite this, their non-compliant behavior has become unbearable. I am tired and frustrated by their unjust treatment. Someone in this position should behave more fairly, as the opposite only reduces trust in the company, leaving the impression that it is an unreliable firm in the eyes of customers. I will take the vehicle to the authorized dealership at my own expense and obtain a report regarding the faults. I will also share this report with the relevant authorities. It is necessary and important for those in charge of decision-making and management in such auctions to act more carefully and responsibly.Business response

CTN Motors purchased a 14-day PSI on their unit, and opened an arbitration within the valid arbitration window on day 3. The vehicle was inspected and found to have seepage from the rear main seal and the rear differential. Manheim Texas Hobby did find a coolant leak from the coolant cross over pipe.
Per the NAAA guidelines, leaks classified as seepage are not an arbitrable issue, and mechanical issues must be over $800.00 to qualify as a valid claim. Manheim Texas Hobby found the coolant leak to be $612.47 (quote attached). Manheim Texas Hobby contacted CTN Motors on October 4th and explained fully the reasoning behind their decision on each part of the claim.

I am rejecting this response because:
A vehicle with such a significant coolant leak could have been without coolant for a considerable amount of time. For example, if the vehicle was running for about 30 minutes before its turn during the auction process, as you mentioned, the lack of coolant could have led to overheating, potentially causing damage to the engine, such as a blown head gasket.
The probability of the head gasket being damaged is indeed high, especially given the circumstances you described. With the vehicle running without coolant, the engine would likely overheat, increasing the chances of the head gasket being compromised. A head gasket failure can cause further engine damage, leading to costly repairs.
Regarding the Pre-Sale Inspection (PSI) that you paid $170 for, it is critical that the mechanics perform specific tests, including a cylinder head gasket test, especially in a vehicle with such a major coolant leak. If this test was not performed, it would indeed raise questions about the thoroughness of the inspection, as this test is crucial for evaluating the engine’s future performance in such conditions.
As for the rear main seal leak, you are right to ask if the oil level was checked. In a vehicle with an active oil leak, ensuring the oil levels are correct is critical for verifying whether the engine has enough oil to function properly. Similarly, the differential oil levels should have been inspected. If there’s no oil in the differential, it could lead to a failure that may not manifest as an active leak but still indicates a serious problem.
Regarding the NAAA explanation about oil leaks not actively dripping, you correctly pointed out that this requires an inspection of the oil levels in the mentioned components. If those components are running dry, it would explain why there was no active dripping, but that doesn't mean there’s no serious issue.
Lastly, you are justified in questioning why the PSI report, for which you paid, has not been sent to you despite multiple requests. Since you paid for the inspection, you have the right to access the full report. It’s important to insist on this, as it provides vital information about the condition of the vehicle and the accuracy of the inspection performed.

I am rejecting this response because:Unfortunately, none of what the auction claims is accurate. The authorized dealership has stated that the PSI report conducted by the auction does not reflect the truth. This is evidence that the auction's ARB and mechanics have conducted an unfair arbitration.I know that the auction officials will not request the authorized dealership's report, but I still find it appropriate to include it. The authorized dealership also sent me a video explaining the issue, but I can't upload it here because the file size is too large.

on August 28th I picked up my car from the repo lot after paying $1,100 in full. When my car was returned to me it was not returned in the original condition. While on the lot, my car was severely damaged. License plat was bent, front window cracked, rearview mirror removed, armrest leather cracked. damages were proven to be done onsite after before and after photo verification was completed. I was informed to follow up in 3 weeks to allow the company to order parts. At this point I have not herd from the business regarding getting my issue resolved and my car repaired.Business response
