    We signed a contract with ************************, which stated that the project would be completed within 8-12 weeks. Considering the consistent delays and errors committed, the project extended well beyond the 12-week agreement. The budget was altered by the contractor to include expenses/fees that were not agreed upon in the initial contract. When/we voiced our concern about the unapproved changes, SMC Builders said they understood and would remove those changes. *** continued to bring updated budgets, including the same numbers as before and even higher. Most recently, SMC Builders was paid draw 3 for $30,633 to complete the master bedroom bath, paint the living room and kitchen, and install the remaining matching flooring in the master bedroom, living room, and kitchen. Although the master bathroom was not completed, SMC builders assume the $30,633 is theirs to keep. I sent a final letter to SMC/***** ******** on 11/20/2024, which detailed what we are owed in returnalso, the letter detailed other issues with the final painting. ***/***** ******** has not responded, which leaves me believing he will not. The contract states that there is a 1-year warranty on all work performed.

              SMC Builders entered into a interior renovation project with the Client  7-13-24. Work started upon deposit funds being liquid 14 days later. Proposed work completion 8 to 12 weeks.

    Project moved along with no issues and positive feedback from Client . Around week 6-7 there were some items of concern by Client regarding finishes and we addressed them. In contract factors

    regarding timely selections by client, changes in scope of work , unforeseen conditions impact budget and timeline. We experienced all of these in this project. Shortly after 3rd draw was received 

    Client stated they could not afford to finish project. We revised the budget to reflect work done and balance of work to be finished leaving a 30k balance of project per the budget. We did what we 

    said we would do even after we received a phone call from Client on 11-12-24 at 4:01 pm stating that " My a** would be taken to Court , My truck would be shot up " and a 5 to 6 minute tirade of

    expletives . My advisors suggest I not return to property. However , my people still finished what I asked them to do.

    I am rejecting this response because:

    Let's focus on the contract issues and not try and make false accusations to cover up unprofessionalism and deceit. My wife works in law enforcement, which ***** is aware of, so the accusations made about threatening to shoot up a truck are ridiculous and false. I suggest Mr. ******** provide real evidence of these accusations or file a police report if he feels threatened. ***** ******** spoke with my wife, who was as upset as I was about how things have progressed since the project began. We met with ***** on several occasions to point out mistakes and voice our frustrations. He and his chain crew had to make several trips to our home to repair issues that should have been resolved since ****** 2024. 

    Regarding timely selections by the client, changes in scope of work, unforseen conditions that could have impacted the budget and timeline.

    SMC Builders/***** ******** had complete access to our home throughout the project. We had to move out of our home for over a month due to the negligence and incompetence of SMC Builders/***** ********. Our bathrooms were reduced to toilets only so we had to seek other avenues to take showers.. At one point, we allowed SMC Builders to work beyond 8:00pm at times and the work still was not completed. If we were not sure of a particular finish or fixture for the home, we contacted SMC Builders/***** ******** for advice since he says he has great experience in this area. There were also occasions when workers refused to complete jobs assigned by SMC Builders/***** ********. The scope was adjusted to allow SMC Builders/***** ******** to complete the work they started. It was not because "we did not have the money to complete the project" as ***** ******** claims. If these instances delayed the project, it was because of SMC Builders/***** ********, not the homeowner.  Nonetheless, the project still remained be behind schedule even before the scope adjustment and unforseen conditions.  Again, the contract that we signed with SMC Builders/***** ******** states "Labor will be warranted 1-year from the acceptance by owner".  I have contacted SMC Builders/***** ******** twice regarding incomplete work and payment since they completed the last job on 11/21/24. It is interesting that SMC Builders "advisors" would recommend they do not adhere to a binding agreement signed by both parties.
