On 11/19/2019, you entered into a loan agreement with Lendmark Financial Services. Your original balance was $3,984.81 which was financed for a term of 42 months with a first odd payment of $223.05 due starting on 1/03/2020 and payments of $168.07, monthly thereafter.
Lendmark has mailed a copy of the Disclosure Statement, Promissory Note and Security Agreement ("Contract") with the customer's signature and a copy of the payment history, to provide ledger of account payment activity, to the customer's address on file, to provide proof of debt.

The LendMark Financial Services is calling me repeatedly for an attempt to collect a debt. Theyre leaving voicemails. I am 2 months behind on my payment of $241.00 on an installment loan. The lady transferred me to the Branch Manager (****-I think) and he said they will be filing court proceedings to garnish my wages. I have requested to settle the debt by emailing the Regional Manager but no one has messaged me back at all. They also wont accept payment under $241.00. The last time they went to court to grant judgement against me they never informed me of the court date. I borrowed $6K but the loan shows on my credit for $10KBusiness response

You obtained a direct consumer installment loan with Lendmark on May 20, 2022, in which $ ******** was given directly to you and $3,031.31 was paid on prior loan. As fully disclosed on the Disclosure Statement, Promissory Note, and Security Agreement, (the Loan Agreement) the original amount financed was $ ******** with an interest rate of *****% for a total of payments of $14,563.88 to be repaid over 60 months in $241.43 monthly payments. You failed to make timely payments as agreed to in the loan agreement and Lendmark initiated the collection process on your account and as a result was awarded a default judgment.

Hi I didnt apply for a loan . I called customer service to report it and she didnt care at all. And I received a letter of a credit denial and someone using my ID and information and apply for a ***** loan in my name thank God it didnt hurt my credit . I'm going to generalize a little bit. I initially borrowed 4k from Lendmark in July of 2022at 25% interest, I subsequently had 3 more loans totalling 2k. I called for a payoff quote and after 2 and 1/2 years of payments I still owe $7200. Every time that I borrowed money from Lendmark they charged me over $250 plus I think $35. I was only told about the $35 charge and was never told at the office that on a $500 loan I was paying them around $280 just to get the loan. The gentleman told me I was told that, and I can tell you with certainty that it was not. Maybe in a subsequent mailing but never at the time of signing. I was misled. I would have never borrowed $500 if I knew that I would be charged that amount. I was led to believe it was that nominal fee amount, After the initial loan I borrowed $500 twice and then a thousand and was never told about that fee, I was only told about the nominal fee. 6k in loans and 2 1/2 years paying on the loans and I still owe $7,200. That is outrageous. They lied to me about the fees that were incurred, They said they told me and I'm saying that never happened. They also told me after a year of making payments they would lower the interest rate and after a year they denied ever telling me that.Business response

On June 30, 2022, you voluntarily entered into a precomputed installment loan agreement secured by a 2007 ****** Altima with Lendmark, in which $4,664.60 was paid to ************* on your behalf. As disclosed on the Disclosure Statement, Promissory Note, and Security Agreement, (the Loan Agreement) the original amount financed was $4,823.98 with an interest rate of *****% for a total of payments of $ ******** to be repaid over 48 months in $167.38 monthly payments with a first payment of $ ******. There were thirteen payments made on this account.
On August 25, 2023, you refinanced the previous loan. The amount paid on the prior loan was $ ******** and $1000.00 additional funds given directly to you. As disclosed on the Disclosure Statement, Promissory Note, and Security Agreement, (the Loan Agreement) the original amount financed was $5,521.49 with an interest rate of *****%, for a total of payments of $ ******** to be repaid over 54 months, with a payment of $ ****** per month. There were six payments made to this account and one payment returned by your financial institution NFS.On April 30, 2024, you refinanced the previous loan. The amount paid on the prior loan was $ ******** and $500.00 additional funds given directly to you. As disclosed on the Disclosure Statement, Promissory Note, and Security Agreement,(the Loan Agreement) the original amount financed was $ ******* with an interest rate of *****%, for a total of payments of $ ********* to be repaid over 54 months, with a payment of $ ****** per month. There were four payments made on this account.
On September 24, 2024, you refinanced the previous loan. The amount paid on the prior loan was $ 63.61.07 and $500.00 additional funds given directly to ****** disclosed on the Disclosure Statement, Promissory Note, and Security Agreement, (the Loan Agreement) the original amount financed was $ ******* with an interest rate of *****%, for a total of payments of $ ********* to be repaid over 54 months, with a payment of $221.33 per month. To date you have made two payments to this account.
At the time of each loan closing all terms of the loan agreement were explained prior to you reviewing and executing them. Additionally, if you are experiencing financial hardship, please reach out to the Mentor, ** branch to discuss available options to assist in bringing your installment loan account current as soon as possible.

I am rejecting this response because:
Your company never told me that they were charging me over $250 on a $500 loan. The only extra payment on the loan was $35 for the new loan which was charged the following month. You deny the $35 charge and you just informed me that I knew about the other charges and that is false. I never would have borrowed the money at that rate. No one would, that's why I wasn't told. Deceiving people seems to be the way this company does business. I was also told that after making a year's worth of payments you would lower the interest rate. Your company denies saying that, and never lowered the rate. I would like compensation for all the lying, and deceiving it has done to me and others.

I am rejecting this response because: The business withheld information when talking to them about those small loans. They said the cost for the $500 loan was $35, but is was about $285. That was never told to me and witheld on purpose. How is a person supposed to read all of the documents put forth to him when the salesperson is telling him what was supposed to be in the contract. She just told me all the cost to borrow $500 was $35. So the company is saying don't trust are sales people to tell you the truth because it's all on the contract. That's what they are hiding behind. They are saying they will lie to you to get you to sign and it's my fault for not reading the contract, which is impossible to do while your sitting there. How many companies will allow you to take it home and read it first before you sign because the sales people will lie to you. So it's up to me to know they are misleading me about the charges. Does anyone think that's how a reputable company does business.

I was late on a payment because at the time I did not know my payment was returned so it fell to be behind 30 days. I am struggling financially. This company from the Richmond office attempted to call me they said 6 times and it very well could have been 6 times as I work during the day and do not have my phone on. I only got one message that came through my phone and my husband who is on the loan also (whose recent phone number has been changed so if they called him, he would not have gotten it) they called his company and verified employment and told them they were taking steps to garnish his wages. I called the company at the Richmond office and was told that because they contacted me 6 times and the loan was so "large" (less than ****** with their unfair percentage rate tagged into that number), they had no other choice but to call and humiliate my husband over a payment barely over 30 days late. I completely understand that I am obligated to pay this loan and I have made arrangements to catch the payment up. I however, do not pretend to know the law, but they made it clear to me that because I did not answer the 6 calls they made while I was at work they decided to call my husbands work and make this request of employment to start wage garnishment. I would think that there would be additional measures taken such as a law suit filed? This company uses scare tactics and inappropriate means of reaching out to their customers. This is the second time they have done this and I asked them to not call my husbands office again. As most people we are struggling with the economy and higher costs and we do our best to pay our bills. I have never filed bankruptcy nor have never given this company any reason to believe we would not make this payment. I feel that there needs to be something done in regard to reaching out to someone's employment to verify employment (which was done when the loan was taken out in the beginning with the check stubs provided).Business response
