Dear Better Business Bureau,I am writing to file a complaint against Kramer Partners, LLP, for their mishandling of my critical immigration document issued by USCIS and their subsequent failure to take responsibility for its loss.On July 10, 2023, I hired Kramer Partners, LLP for legal assistance in changing my **** status from F-1 to H-4, for which I paid $500. My change of status was approved on September 29, 2023, and the firm agreed to mail me the original approval notice and I-94 document, essential for legal status verification.By November 8, 2023, I had not received these documents. Upon inquiry, the firm admitted on November ********************************** transit. The **** tracking number (**********************) indicated that the item was never received by ****.Despite my follow-**** the firm confirmed on December 27 that the document had not been located. This loss has already caused issues, such as during my driver's license renewal, and may lead to more problems. On January 10, ****, Kramer Partners, LLP insisted that I pay $465 for a replacement request with USCIS. This is unacceptable as the loss occurred under their responsibility. My email on the same day, highlighting their accountability and the financial burden on me, has been ignored. As of today, January 22, ****, there has been no response from the firm. Their negligence has caused significant inconvenience and potential legal complications for me. I request immediate action from the BBB in addressing this matter. Kramer Partners, LLP should cover the replacement cost and expedite obtaining a new I-94 document.Thank you for your attention to this issue.*********,*********

    Business response

Kramer Partners, LLP has been providing expert legal assistance to immigrants before the ***** for over thirty years. We understand that the **** process can be stressful for our non-citizen clients, and we strive to provide clear explanations and empathetic handholding throughout the process. I am constrained by the rules of the State Bar of Georgia from responding in detail to the allegation of incomplete representation.  As a matter of policy, we do not pay ***** filing fees on behalf of our clients without reimbursement. We remain committed to ensuring that the complainant enjoys the full benefits of the **** status we capably helped him to obtain and stand ready to respond if he has any problems. Please consider that the State Bar of Georgia provides a more suitable forum for the resolution of attorney fee disputes.

I am rejecting this response because:

The issue here is not about their general policy on USCIS filing fees but specifically about rectifying a mistake made under their watch.

It is important to highlight that the loss of the **** document occurred while in their possession or control, as evidenced by the **** tracking information. This loss is a direct result of their handling and not a typical scenario where a client is responsible for filing fees. In this situation, the cost of replacing the document should be borne by Kramer Partners, LLP, as it arises from their mishandling.

Their reference to the State Bar of Georgia and the suggestion to use it as a forum for fee disputes does not address the crux of the issue: their responsibility for the loss of an important legal document and the need for its replacement. This is not a fee dispute but a matter of professional responsibility and client service.

Kramer Partners, LLP states they are committed to ensuring I enjoy the full benefits of my **** status. However, without the original **** document, which is essential for legal status verification and various administrative processes, my ability to fully benefit from my **** status is compromised. Therefore, I respectfully insist that they fulfill their commitment by facilitating the replacement of the lost document at their expense.

I urge Kramer Partners, LLP to reconsider their position and take appropriate action to rectify this situation by covering the replacement cost of the **** document. This would not only resolve the current issue but also uphold their reputation for client service and professional responsibility.

    Sincerely,

    *********
