    I paid for a dumpster from ****** on January 12,2002 for $500. I paid from my ***** Fargo account using ****. I have used him before using my credit card however for some reason he requested that I use **** to pay for the dumpster. He came to pick up the dumpster on March 21st. I received a text that the dumpster is heavy and that I would need to pay him an additional $300 before he takes with him. I was in a meeting and couldn't return his call immediately. Because I did not respond to him, he just dumped the whole 40 yard dumpster of trash on my property and just left. There was another contractor there working as well who witnessed the whole thing. I have his contact information if needed. I tried to contact ****** however he has not returned any of my calls or text. ****** received my money for the dumpster however did not complete the service by dumping all of the trash he was provided to take. I had to pay for someone else to remove the trash and provide another dumpster. A photo of all the trash he dumped is below. I also have a video of him picking up the dumpster and dumping it all out.

    Regarding ******************* argument, when it comes to the container rentals our policy is a 10-day rental and after the 10 days are up. there is a 10$ fee applied for each day after.

    *************** had the container from January 11th all through March 20th, we did not charge *************** for that.

    We are located in Marietta, the container was in ********* it was overfilled and if it would have been hauled away there would have been a possibility of something falling out on the way to the landfill, it was a bit difficult to place it on the truck because of its weight. 

    At the time of pick-up on March 20th the driver, which was me, I personally went to pick up the container and I have been in this business for quite some time now that I am able to eyeball and know when a container will be too overweight, I called *************** as well as my office administrator to notify *************** that the container was going to exceed in overweight.

    We were only going to charge *************** $300.00 to haul it away, the container was going to estimate a little over $800.00 just in overweight fees that the landfill would have charged, we attempted to work with *************** but unfortunately, we did not get a response from ***************. At ************** we always strive to work with our customers when it comes to charges, that we understand sometimes aren't planned for.

    If for example: we hauled it away container overweight estimated 14 tons over, we provide customers with a 4-ton limit that would have meant that *************** would have been responsible for the 10 tons it went over. We were only charging her $300.00 to haul it away and take it to the landfill, nothing more would have been charged.

    The payment was completed through Zelle, it is an option of payment that we provide to our customers it is optional. *************** had no issue processing payment through Zelle for the container at the time of rental.

    I am rejecting this response because:

    1st- I paid you for the dumpster which was $500.  Because you dumped all of the trash onto my property means you did not complete the service that I paid you for. Therefore a refund is warranted.  You can't expect to be paid for service that you did not complete.  Just dumping all of the trash onto the customers property is very unprofessional. 

    2nd- The dumpster was a little over in weight before.  You went to the yard and sent me the receipt of what was charged for the extra weight I and simple paid you for the extra weight fee.  You simply came up with a figure of an extra $300 without going to the yard.  How did you come up with that amount?  You basically came up and a dollar amount and if I didn't pay it you were just going to dump the items out which is criminal behavior and theft.

    Bottom line is I am due a refund because you simply did not complete the service for which I paid you for.

    The container was paid for , you're correct.

    The first time the container was able to be loaded onto the truck itself to be hauled off, there was no issues there. the over weight was very little.

    The second time around, it was not able to be completed because it was not able to be lifted onto the truck because of its overweight and there was a chance debris and or materials would have flown out from the top because it was overflowed. That could have caused an issue with drivers and a possibility of debris and or materials falling out 

    I understand your point, but It wasn't a number that we generated just because, it goes based off the experience with roll off's and what the landfills charge also, what I was charging you it was just me working with you because I knew it would be very overweight. 

    This isn't criminal behavior nor theft, there just isn't an understanding.

    I am attempting to have you understand that the container itself was very much overweight, We were trying to work with you and requested the $300.00 and if at the landfill it would have exceeded more than that we wouldn't have charged you for it.

    We always try to work with our customers and we understand that sometimes budgets are made and sometimes with the containers , the overweighs could exceed those budgets and from my experience we understand overweight's are where it gets expensive, we were just trying to work with you. 

    We did attempt to call numerous times at the time of pick-up, this is a reason we sometimes request someone be at the site when containers are being picked up. 

    You were a consistent customer and that is also a reason why we attempted to work with you with the overweight fee.
