    In July of 2022 we closed on a construction loan with Capital city. I had a lock rate of *****% and was told that when the build was complete, the rate would either go down if available or stay the same BUT IT **ULD NOT GO UP. Well come time to modify and they are asking me to sign a lock rate of *****% or they are taking my home!!!! I looked at my contract and it clearly states that as long as I have all final inspections AND my ** BEFORE the lock rate expires, then it can not increase. My lock rate of *****% did not expire until July 2023. I had my ** June 29th 2023. Capital city is saying that I would have needed my ** 10 days prior to lock rate expiration date and fully modified before to July 1st. No where in my contract does it say this. When I questioned this, I was told they were unable to sell my loan how it sits. This is not my problem. They messed up and now my family will suffer. My payments will go up another 280 a month and we can not afford that. We barely could afford our loan at *****%.

    Capital City Home Loan LLC and I *************************************** entered into a one time closing construction to perment loan that closed on 30 OCT 2020. No Ecsrow account was established according to the contract and I was responcible and did pay my own taxes and insurance.On 18 July 2023 I paid of my mortage with a new morgate from Racket Mortgage for the full principle amount plus an additional ******** dollars since CCHL had overquoted Rocket mortage the correct pyoff amount. BLUF CCHL then allegedly placed the additioanl ******** in an Escrow account according to and recorded on thier forward customer facing FINASTRA electroninc servicing system. I never opened an ESCROW account. 1. CCHL Has not produced the Instruments of documentation for the establishment of the Escrow account with both parties signatures.2. CCHL Has not released y excess funds and said they would do so on 18 AUG 23 which is beyond the federal regulation of 20 business days.3. CCHL also holds and additioanl ******** dollars in unappied balance which was taken out of a futre pay ment and additional principle which was placed against the principle and then taken back out of principle which is in violation of the contract.I have contacted the *** *********************** at ******************* ************, who laughed at me, said he and his team of lawyers wrote the contract and there is no way I read the whole document. His arrogance was overwhelming and his lack of concern for customer care was telling of the deceitful and unethical cooperate culture he has created.Remedies: A. My escrow, with the interest rate they were chagrining me and described in the contract of *****% paid by cashiers check delivered to me overnight NLT Friday 28 July 2023.B. A written apologies and formal admission that the company made a mistake in an unauthorized opening of an Escrow account.C. My review of their company posted on their review site of the customer facing site **************************************************** (if you go to it they only post five star reviews and call the average 100% 5 star for over **** reviews The only company that would do that has now expressed thier deciptfullness as no company has every, every recived only 5 star ratings and not to show the others is fraud.
