    I paid $8000 cash (10% down) and agreed to take over payments to purchase a food truck from ********************* of DP LLC/*************** Restaurant, now renamed R Jawaiian Jerk. He needed to sell it because he was opening a store at ****************. ***** needed cash, and wasn't able to make the finance payments, so I agreed to buy it for $80,000 and take over payments. I delivered cash to his store on February 1, 2023, and handed it directly to *****. I was told by ***** the truck was in 100% working order, and all I needed to do was get a food permit. I had eaten at the truck so I knew it was once operational, but I was not able to do an inspection of the truck before paying the money because ***** was begging for the money immediately so he wouldn't get evicted from his house. When I went to the truck, after he got the money and gave me access, there were burned wires everywhere, and lights out, and the truck would not start because the starter and batteries were bad. The truck had been severely mechanically neglected and abused, and was completely inoperable. I tried to have it worked on for several months. ***** purportedly sold me a working food truck, but several mechanics were unable to get the truck running. ***** played dumb every time the attempts to fix the truck failed. I also purchased a $1770 grill and rice cooker which are still in the truck. *****'s store at ********* closed in July 2023, and he opened the food truck back up, serving the same food as before, but under a different name, R Jawaiian Jerk. By starting a new LLC he tried to erase all prior debts he owed and refuses to refund me. I'm not a personal hedge fund, or creditor, and didn't agree to lend ***** money. He elicited money out of me by fraudulent inducement, claiming to sell me a working food truck, but the mechanical problems were innumerable, and he knew it was not operational, therefore I was never able to take physical custody of the truck. He doesn't respond to any requests for repayment.

    First and foremost, I want to clarify that the sale of my food truck has absolutely nothing to do with my previous company, ***************, or R Jawaiian jerk seasoning. I entered into an agreement with **** to sell him my truck for a total of $80,000, with a 10% down payment and monthly installments of $2,500. **** received the keys to the truck upon making the down payment.

    Shortly after the sale, there was an issue with a cable to the starter, which was promptly fixed within two weeks. However, despite the repairs being made, **** chose to leave the truck parked in a space that I was personally paying $50 a month for.

    Moreover, I had to personally guide **** through the process of obtaining the necessary paperwork for his permit. I also assisted him in pricing his menu and even helped him find a credit card processing company to work with. Additionally, I went out of my way to find him a suitable location for the truck to operate from. However, despite all the support and assistance I provided, **** procrastinated for a staggering six and a half months and failed to take any action or make any payments towards the truck.

    Throughout this time, I had to turn down numerous offers from other potential buyers, as I had already made a commitment to ****. Despite his complete lack of responsibility and failure to fulfill his obligations, I continued to bear the burden of paying $50 a month for the parking space where the truck was left abandoned.

    Given these circumstances, it is clear that I owe **** nothing. His inaction and negligence have caused significant inconvenience and financial strain on my part. I have fulfilled my end of the agreement, and it is only fair that I am compensated for the losses and inconveniences I have endured.
