On January 6, 2018, David C.P. Chan dba Fellows Construction (Respondent) entered into a Settlement Agreement with Regulated Industries Complaint Office (RICO), resolving RICO complaint CLB-2013-446-L.
Respondent allegedly did not have a complete written contract prior to starting work on 2 projects in possible violation of HRS § 444-25.5 and HAR § 16-77-80.
The foregoing allegations, if proven at an administrative hearing before the Board, would constitute violations of Hawaii Revised Statutes.
Respondent entered into settlement agreement freely, knowingly, voluntarily and under no coercion or duress; Respondent voluntarily waived it's right to be represented by an attorney.
Respondent do not admit to violating any law or rule but acknowledges that RICO has sufficient cause to file a Petition for Disciplinary Action against Respondent's licenses.
Respondent agreed that this settlement agreement is intended to resolve the issues raised in Regulated Industries Complaint Office (RICO) investigation into complaint CLB-2013-446-L. Respondent understands that this settlement agreement is public record pursuant to Hawaii Revised Statutes Chapter 92F.
