            I hired Rayco Construction **** (*******************) for foundation replacement repair and egress window installation on May 11, 2022. Rayco had difficulty with this project as can be seen from the change order dated June 24. He also had issues with labor. He finally had ****************** complete the project as can be seen from the final invoice dated August 5th. On August 20th, I discovered a waterline leak at the foundation floor from project excavation. I contacted ******************* regarding the leak but he did not respond. I had the leak fixed August 31st, by ****** Concrete. On September 1, I learned that Rayco Construction failed to pull a building permit for the project. I texted ******************* about his failure to secure a building permit but he did not respond. I had a permit issued September 12th. On September 21, *************************** ( Senior Building Inspector) inspected the project. **** cited two ********** city code violations regarding the work. One, proper insulation was not installed around the exterior of the windows for freeze/frost protection and two, the south window header was not installed correctly. I texted ******************* that *************************** wanted to meet with him on site to discuss these issues. ******************* has not responded back. I had ****** Concrete complete the work for exterior egress window insulation on October 11th. I will have 911 Restoration fix the window header yet this fall.

                ****, ***************** here sir,  first of all I cannot find where to go to respond to the complaint on the BBB. But I do want to address several items " Incorrect information put forth by ********************," I was merely a Sub Contractor on the job brought in by 911 Restoration & Mr. **** was under the impression the permit had pulled long before I got on-site by the General Contractor, as the majority of the Tornado damage to the home was complete.

                 Next ****************** said I did not respond to his request ? I personally actually fixed the { Only water leak present while I was anywhere near the site and Mr. * was present when this was done. " He Did However, Contact 3 weeks after the project was completed and " Apparently Satisfactorily as he paid in full.But as stated he did contact me via text about a potential new water line leak on his may I Note: Old &  Antiquated System ? " a feeder to the barn out back or well ? whatever the case.

                  Next Item,  the south egress could not " without extensive Brick Facade { Wall  Face of The Home / Brick Wainscoat } have a traditional header placed so due to this fact,  Mr. * chose, " Yes it was his choice not to spend anymore money or risk a collapse," So as stated He Chose to have us Solid Core the ***************** Walls on Both Sides of said window for More Than Code Load Bearing. And Secure a Weatherproof Cosmetic but Structurally Sound top closeout of the egress. This is perfectly legal under **** Building. }

                  Next, Item:  I Installed Seal Seal Weather Barrier along the entire egress window outline as per code. He only contacted me AFTER he apparently had the so-called water leak fixed and this weather proofing thing done and asked for a $500 refund.  In order to try to appease my client for the delay we did " admittedly incur," I agreed to pay this refund to him. And I will do so Immediately upon his retraction of this unwarranted complaint. I worked night and day to get his project done and brought in help as he admitted to at My Own Personal great expense.

                    ****, furthermore sir, I am in shock quite literally to see this complaint. Reason being, On our last night there, we worked until after dark, " approximately 9pm," And he and his lovely wife { ************** his Wife *********** right there on-site and invited my son and I to eat dinner with them on their back patio/deck. So I am quite shocked as to have not heard back from him after I agreed to his request to pay him the $500 he wants. " I have his text requesting the $500 refund and my response agreeing to it. Yes sir, I saved it and can provide you with a screenshot if you;d like..

                   So hopefully this complaint has simply arose out of a miscommunication. I will as stated, Issue him his refund as he asked for if he retracts this complaint so my A+ Rating with the BBB remain intact.

                PS, This is the first time / thing I have heard from anyone of regarding whatever this frost protection item is around the egress window? I placed," as stated," a complete surround of said egress windows with seal seal, " this is the required barrier between masonry and wood etc.

            Rayco Construction was not a subcontractor. There is a contract for foundation replacement and egress window installation dated May 11, 2022. This contract was between Rayco Construction **** and ****************************. There is no mention of 911 Restoration as the contractor. I specifically asked ***************** if he was going to pull the Building permit or should I. ***************** said he would pull the permit. I was informed by **************** that it is the contractors ultimate responsibility to secure a building permit. The waterline leak in question was not discovered until August 20th because I had limited electrical service on the property. This leak was from the well to the house. I did not get power restored to the well until August 20th. The waterline that was fixed was from the house to the barn. At that time, the water was supplied from the city. 

            I specifically asked ***************** about the south egress window header. It was not installed like the other two egress windows. ***************** told me that it was not a supporting area, that the header was purely cosmetic. Due to the brick faade, **** struggled with this window. I understood the issue, however I did not choose to have the header installed incorrectly. ***************** chose to install the header without proper support, and not follow city code. **** did apply a seal weather barrier on the foundation, however he did not install proper insulation around the egress windows as required by city code.

            Finally the drain tile supposedly installed in the northeast window well was purely cosmetic. The tile was just at T that drained no where and placed in the window well to look legitimate. If I would have been aware of Rayco Construction's failure to follow city code regarding this project, I would not have paid him in full. 

            Rayco Construction failed to do a proper and correct job per the contract. I have incurred significant expense to correct Rayco Construction's failures and I want reimbursed.

                ****, Sir I thought I had already answered sufficiently to the issue / complaint brought by ********************. However, I will say this in addition.  To whom it may concern;  I went to great lengths and Costs " bringing in additional help as " We All Know How The Work Pool is at the Current Time." but as state, I went to great lengths and expense to keep ******************** Happy and Complete the Contract which I did. { I was Not terminated from this contract.} that itself speaks volumes. I am not going to speak ill of ******************** as I appreciated his patience.. However, In Direct Response to his assertion regarding the South Egress Window Header. { He knows and Is Fact that I went to Great Lengths Saving his Brick Facade, even sustaining a serious injury " costing significant delay," He never told you this did he **** ?

                  So I refer to my previous response and willingness to settle this issue. But I Must State Unequivocally that he and I had In-Depth Conversation & Went Over Very Specific Details regarding How to avoid any issues with his Brick Facade. We Spoke In Depth about how we could Solid Core The Adjacent Walls out multiple cores to each side of said window and it was already Solid below window. More Specifically, " The Entirety of the Foundation Walls Completely Surrounding South Egress and out at 5 Cores to each side " Several Feet + ," of said Egress Window as well as below Are Solid Concrete.

                   I also Used { As Per City Code "Seal Seal Insulation, " Between ALL of the Masonry and ALL of the Wood Structure/s " Window Jam/s, Plate etc " so if there is any additional insulation he wanted all he had to do was ask.  Whether this was or is his personal desire I do not know?. But the Bottom Line is as follows -- { After Our Lengthy Discussion He Chose to Solid Core and YES I informed him / assured him that was indeed more load bearing than a simple header alone. And It Is.... }  Kind Sirs, I would have installed " issued an additional change order to deal with the removal " If possible, but without any liability to myself if he chose this route."

                 He Chose to have us use the solid coring throughout Opposing Wall Structure rather than the invasive cut / demo and potential damage to the Brick Facade that was as he and I Both inspected and agreed was Very Fragile and High Risk.....  * Please Note: He and I had already had previous conversation and " Change order issued due to this Brick Facade so it was Not new news,":  Quite Literally, I had a helluva time saving it " But I Did. I am very good at what I do, I do not Cut Corners and although I hate C.O.'s  " change orders," I will use them to protect all parties if Ever needed... } Furthermore, The Solid Coring Procedure we spoke of with a 2x4 header, As We Discussed & Agreed Upon does indeed " as any licensed engineer can verify," Afford More Than Enough Load Bearing for the entirety of the Egress and Wall area/s.  And since we could simply Not Install a Full Size Header as mentioned in detail," We Did indeed Install a Header, It was a 2x4 instead of 2x6 or 2x8. Sizes vary dependent upon width.  But as the method we used was and is indeed More Load Bearing and more expensive than a simple wood header alone It is Not Only Stronger But Has Far More Longevity than standard header with hollow wall alone. Hence my exclusive unmatched in writing guarantee.....

                 I am still surprised /  actually in shock as to the water line leak issue ******************** speaks of that was not found until after I left. I understand what he is saying. But he and I were both in the hole when I / we fixed the leak I found / caused. And We, " He & Both in depth," inspected All of the water lines we saw / could find etc. " I even Hand Dug with my Bare Hands to avoid even careful shoveling potential accident/s."  We did this inspection Out Into Virgin Untouched Soil, Beyond even the excavation area to check for any " Shift Disturbances," He and I found Nothing to indicate any damage or potential damage whatsoever.

                   In closing, As I stated, I am willing to settle this with him for what he asked for a complete dropping of this complaint as I feel and The successful completion and payment for same regarding this project was indeed done and made. Furthermore I would state he suffered No loss due to any delay/s on my portion of the work being done as his home still had a couple months of final construction / remodel and punch list issues still undone as the time of my successful accepted completion. { **** I saved the Text Message of where he asked me for money. } As a matter of fact I have All texts ******************** and I exchanged, Virtually everyone of them showing a complete timeline and communications.}

                   I am sorry that for whatever reason, " someone misleading Mr. * or whatever? for that matter that he seems to be upset with me / us here at Rayco but I choose to no longer argue semantics and opinions beyond this commuinque, other than to say this, And this will be my last statement in regards to this matter..  { I liked ******************** from the day I first met him " I ," Was " Introduced and brought in By 911 **************. But after finally getting around weather, employee shortages, injuries etc. I was indeed so very truly happy, as " I take my business and my work very personally,"  So yes after some delays and worry about being fired, I was Indeed able to, " I thought anyway." make him happy by completing the work I was tasked with being paid and having dinner with he and his wife there on the back patio.   I choose to remember the good things of a job not the bad. But I will never run and hide from either. I will always persevere to find and to bring forth truth and reconciliation if at all possible.
