  On April 26th, I texted ******* and told him that I wanted to build a fence around my yard. The next day, he came to my house and gave me an estimate. He left, but later that day, he told me that he would build the fence for $8,000, but would give me a deal of $7,500 if I signed with him immediately. I said ok and that same day, he came to my house around 7pm and I signed with him and I paid him $5,000 by check. That was for materials and the permit, not labor. ******* did not provide me with an invoice or a copy of a contract. ******* told me that he would get the permit and call 811 to have the utilities in my yard marked. The permit was approved on May 2nd. My yard was marked on May 8th. After that, ******* kept giving excuse after excuse about why he could not come to work on my fence. He continually said that he would be there tomorrow, but some issue would always come up as to why he could not come. He did drop off materials on May 18 and May 22, but he did not do any work and just left.Two people who worked for him came by on May 24 and removed the old fence. They were here from 11:00am to 3:00pm. They tore it down, but never cleaned up. All of the old wood is still in my yard.By the time that he got around to putting posts in my yard, he put them in the wrong spot. The fenced area was too small and excluded part of my property. His company tore down the old fence, so they should have known where to put the new one. However, he put the posts several feet away from where they needed to be. When I told him about the mistake, he said that it was my fault and I was responsible. When I asked for my money back, he said no, that it had all been used on labor and supplies. I have not heard from him since that time. He did come by to pick up some tools. The only supplies that he bought were 42 pieces of wood and 30 or 40 bags of concrete. I think that he took advantage of me, because English is not my first language.
