    On April 18th, I signed a contract with Messer Lawn Care to perform seeding and topsoil work on my property in the Coeur d'Alene area. The contract, which is attached, outlined the specific work to be conducted. The project commenced on April 24th.However, during the work, the workers used a soil mixture with a high concentration of pea gravel. This deviation from the expected quality of topsoil led to several issues. The presence of pea gravel hindered the proper growth of the seeds and made the area unsafe to mow, posing a hazard for lawn maintenance.Due to this negligence, I am seeking an adjustment to the initial invoice to reflect the substandard work performed. I contacted Messer Lawn Care to express my concerns and request a resolution. They did not respond to my concerns and instead sent me an additional invoice with a 15% upcharge to the intial $1,000 invoice for what they labeled as a "late" delivery, which was not communicated to me prior to the work being completed.I incurred additional expenses in hiring another contractor to repair the work they did. This lack of response, the unwarranted additional charge, and the need for personal investment have left me no choice but to file this claim. I am looking to open a dialouge with Messer Lawn Care so that we can negotiate for a fair adjustment to the original invoice and resolution to the poor quality of work provided.

    I've used Messer Lawn Care for two years with satisfactory results. In the Fall of ****************************************************** the Spring of 2024. In the Spring of 2024 we reinforced that request with multiple phone calls(4) over a month's time. Even with 5 requests, and 5 promises, the service was not provided. When mowing season began in 2024 we signed our annual contract that required 30 days notice for cancelation. An untrained crew arrived April 16th and did a completely inadequate job. I called the company and explained my concern about the mowing and trimming and, again, asking for ********* services. I was promised a crew would do the work by end of day the following Monday. The work was not completed as promised. The next week a different mowing crew arrived and, again, a new and inexperienced crew member completed only half of the trimming of our yard. ******** did not clean up after themselves, left a mess, and departed. I called the owner immediately and told him we could not continue to employ Messer Lawn Care. He informed me that I must still pay for *********************************************************************************************** for unsatisfactory service. Mr. ********************** was unwilling to make any adjustments for the poor services, nor would he cancel the contract. Therefore,I have no recourse but to pay for a months service I do not want based upon totally unsatisfactory service. I've hired a different lawn care company and, under no circumstances, will I ever consider recommending this company to anyone.

    Vendor refuses to complete mowing work on our lawn and behaved aggressively and with hostility when confronted about their incompetence.

    Unfortunately, we have attempted to reach an agreement with the customer prior to the complaint with no success, and do not wish to have any further contact with the customer.

    Our lawn crew was sent to the property to provide a mowing service (which consists of mowing, weed eating, and blowing off driveways and walkways.) When the crew was finished, the customer asked that the flower beds be raked and cleaned up. Our ******* told him he couldn't do that at the time, that he would have to schedule a clean up. The customer called the company where I (Office Manager) answered. He told me the crew wouldn't mow in the back yard because of the leaves and debris in the lawn. I confirmed that that was typically our policy, because mowing over debris without it being cleaned up first could damage our equipment. But I would call our Owner about the situation and get back to him.

    I called our Owner, who was nearby and offered to take a look himself.

    Next thing I knew, I got a call back from the customer who immediately yelled profanities at me about our company. I attempted to apologize, even though I felt I was being verbally attacked, but it only escalated as he began to scream more profanities at our owner in the background, which made me feel extremely uncomfortable so I hung up the phone.

    The outcome was: the mowing service was completed one hundred percent, including the back yard. The customer wanted all of his flower beds to be cleaned up from sticks, leaves, and debris, and would not accept our answer that it would not be included in the mowing service and that he would have to schedule a clean up. Now, he has filed a complaint when myself, our owner, and our crew had done the right thing as far as performing the services that were agreed upon. When the customer demanding extra work be done and we peacefully declined, he lashed out aggressively. Because of the way our staff was mistreated in this situation, we will not be in communication with the customer, nor will we be returning to his property.

    I have attached video footage of the work that was completed, as well as the customer approaching our owner and yelling the profanities while still on the phone with myself.

When the crew was finished, the Customer asked that the flower beds be raked and cleaned up. The customer was informed that the services he was requesting could not be done during the mowing service, as it had to be scheduled separately.

    The customer began yelling at several of our staff, including the crew, the office manager, and the Company Owner. We have attempted to apologize, even though we were being verbally attacked, but it only escalated as he began to scream more profanities. At this point, we will not subject any of our staff to any more mistreatment from this Customer.

    The mowing service that we were on site to complete, has been completed. A lawn cleanup was not scheduled nor agreed upon between the Customer and our company and we will not be returning to complete any further work.

    We do have witness statements from all of our staff, as well as video footage of the incident, which we will provide if needed.
