The Job was a restoration for a water heater leak that turned into a remodel Job started around 8/23 We have paid $70,000 towards the completion of the project.During the first stage of demolition, the subflooring in all rooms was accidentally removed we were assured that the subflooring would be reinstalled with the new flooring. This did not happen until after the flooring was originally installed and the issue was pointed out. The reinstall was completed incorrectly leaving the new floor damaged. This also set a chain of events that factored into the cabinet and countertop installation.When the ceiling fan installation in the bedrooms was performed, the radiant heating in both rooms was damaged beyond repair.All damages were pointed out repeatedly to the Contractor. Each time the damages were pointed out we were met with promises that everything would be brought up to our expectation but no follow through.On February 5th, Canyonside Construction submitted our final billing with no offer to repair damages. At this point, we responded with a letter spelling out our stance that no final payment would be submitted until the damages were repaired. Seeing that the money owed is far less than what it will cost to repair, we were outraged when informed that ******* believes it is not Canyonside Construction's responsibility to repair the damages that occurred. We were told to reach out to our insurance company and file a claim. I have also requested disclosure of all subcontractor payments, permits for electrical and plumbing work, and contact information necessary to to confirm.The matter remains at a standstill with little to no correspondence.Business response

To Whom It May ********************* the renovation project undertaken for *********************, I wish to provide a comprehensive overview. We commenced work on August 8, 2023, following a water heater malfunction that caused significant damage to his residence and that of his downstairs neighbor. Initially, **** informed us of his prior engagement with Elite Restoration, who abruptly terminated their services due to apprehensions regarding mold.
Before commencing work, we ensured clarity and mutual agreement by signing and dating a comprehensive work authorization document,wherein it was clearly stated that subcontractors might be engaged for specialized tasks, with full responsibility resting on them for the quality and outcomes of their work. For the mitigation of water damage, ******** &Brothers Construction (RCE *****) was engaged, operating independently with their own equipment and personnel. Despite clear instructions provided to ******** & Brothers regarding the scope of workspecifically, the limited replacement of underlayment in designated areastheir crew proceeded to remove the entire underlayment throughout the property against our directives. Despite our efforts to rectify the situation, discrepancies persisted, leading to dissatisfaction with the flooring installation. ( Its important to note that **** approved us moving forward with the flooring installation despite the extra layer of underlayment that had been removed) Subsequently, various additional modifications were requested by *********************, including adjustments to the flooring height, relocation of appliances, and electrical upgrades, all of which were duly accommodated.
Prior to cabinet installation, **** wanted Magic Team (#ELE-C-33843 #****** #****** #C-1048 #******-AA-4 #*******-5502 #M-451) to move his washer and dryer connections to another wall. **** also wanted us to change the light fixture in the kitchen and hallway and install two fans in both bedrooms and a new fan for the bathroom, as well as new outlets and switches which was done by ******** & Brothers since he told me that he also carried a licensed Electrician. However, significant issues arose with ******** & Brothers' workmanship, including improper installation of baseboards, crown molding, and the barn door system, leading to damages to the radiant ceiling heating system and shower facilities.
In response to these challenges, ******* Handyman (RCE *****) and Aqua Best LLC ( 051531) were engaged to rectify the substandard workmanship, while **** from 5 ************* (******) ensure and corrected the electrical connections and made sure it met requisite standards. Despite our concerted efforts to address the issues, ****'s abrupt cessation of verbal communication and insistence on solely email correspondence complicated the resolution process. Efforts to seek restitution from ******** & Brothers were met with resistance and his insurance declined coverage,ultimately necessitating recourse to our insurance. While my insurance adjuster, ************************* from ********************** has confirmed coverage for damages to the radiant heating system, ****'s conduct has regrettably hindered the smooth resolution of outstanding matters.
In light of ****'s uncooperative demeanor and unwarranted escalations, we have extended considerable leniency, including waiving the final bill so that he can cover the costs associated to the flooring install like removing cabinetry, and so that he can replace his range that he claims ******** & Brothers construction caused damaged to. However, cooperation is contingent upon **** signing a release of liability form. Regrettably, due to ****'s behavior toward myself and my team, we will end further coordination for cabinets detach and rest and flooring installation he will have to coordinate them himself. In summary, despite our utmost efforts to rectify the situation,****'s conduct has impeded progress and necessitated formal measures to resolve outstanding issues. We remain committed to reaching a satisfactory resolution and trust that **** will cooperate accordingly.
To make things clear, we will be covering the flooring installation bill only which we will make out to ***********************. Our insurance *********** will be covering the radiant heating damages. And we will be waiving the remaining balance owed to us for the amount of $6,069.12 so that he can cover the cost of removing the cabinets and re-installing after flooring has been installed and all other damages that he may claim.Contingent upon him signing a release of liability form.Customer response

I will coordinate and schedule all work to be completed.
