Berman's Infiniti sold me a certified used car that I found out later had structural damage. Had I known, I would not have bought the car even for a reduced price. Berman's put me & any passengers in danger for selling me an unsafe car.Business response

I hope this email finds you well. I am writing to bring to your attention an issue regarding the title of the 2021 Q60 that was sold to Ms. ***** by Berman Infiniti of Chicago.
At the time of sale, the vehicle had a free and clean title and was certified, with ****** miles on it. The title was updated and issued on 08/21/2021.
However, subsequent events have led to the title being branded as salvage/rebuilt. According to the Carfax report, there were several incidents reported after the sale, including accidents on 09/16/2022 and 02/25/2023, as well as the vehicle being reported stolen on 07/03/2023. Ultimately, on 10/02/2023, the vehicle was declared a total loss and a salvage/rebuilt title was issued. I have attached the Carfax report for your reference. Please note that while we sold the vehicle with a free and clean title, the events that transpired afterward were beyond our control. I wanted to bring this matter to your attention so that we can work together to address any concerns or questions that may arise from this situation. I am rejecting this response because:Berman's is taking no responsibility in selling me a 'certified' used car that had previous strutural damage. The accident they are referring to in their response was a minor fender ****** which was also verified by my insurance company, ********, who would not pay for the $3500. for suspension damage repair because they stated itbwas not a result of the minor accident but was from a pre-existent condition. I also paid for a 3rd party car expert analysis of my car who found structural & suspension damage to my car that.had weakened & altered the car's frame. (Pls sed attachment.). In essence, Berman's charged me the full price of a 2018.Q60 knowing the car had structural damage which put me & my family at risk. I feel their business should be investigated for their questionable & unscrupulous sales & business practices.

Unfortunately, we have yet to receive this information. I am rejecting this response because Bermans had prior knowledge that can be seen on its car fax that there was possible structural damage which the suggestion on the doc is to have the car examined **** ******** expert, as evidenced on the work hisory of the car, was Not done yet they sold the car to me as certified with the same price of an undamaged/uncompromised vehicle.I do not have pictures of the damaged suspension but my expert's analysis talks about the car's condition before & after my minor accident which in no way was responsible for any structural damage whichbis why ******** would not pay for structural work because they decided it was not a result of my minor accident & why do they need the name of the company that examined the car? That info.will be revealed if/when a lawsuit is filed against Berman's

I purchased a 2017 XQ 50 from this car dealership December of 2020, which the car was a total loss, ********************* paid the *** off, I had an extended warranty on the ***, When I called the warranty to have the check issued to me for the amount of $2,483.00 the warranty department informed me that the check was issued to the car dealership and since the car was a total loss that the car dealership should've issued the refund from the warranty back to me. I have an email from *************************** informing me the amount of the check from the warranty, but also mis formed me that i could only use the warranty payment towards a new purchase or i would forfeit the warranty check and lose the money and that i could not be issued a check from the amount of the warrant. This car dealership is defrauding customers. I have asked the company for a copy of my bill of sale to reflect my down payment still haven't received that information. To Whom It Might Concern:
Customer did cancel the warranty and we issue the check on 04/20/2020. Every time that the total loss occurs the cancelation has to be issued to the lienholder and in this case that was Infiniti Financial Service. They cashed the check against the payoff.
I'm attaching the copy of the cashed check that I obtained from our back. Customer should reach to IFS to find out more.

I am rejecting this response because: I never received the check and I never canceled any warrantees on the **** the car was a Total loss. The insurance company paid the car off, so any warranty payments shouldve been issued back to me directly and no the dealership . I would follow up with my local General states attorney to file a complaint regarding my concerns with this car dealership.

Hello,
when the total loss occurs any product that is cancelable gets canceled by the lean holder or the insurance company itself. Insurance will not pay for something that haven't been used and can't be used on the vehicle that is total loss.
Berman Infiniti of Chicago send the check to the lean holder and it was applied to the loan payoff therefore Berman Infiniti of Chicago is not at fault here.

Bought a Infiniti QX60 2018 in April 2023, and I cannot buy a plate sticker according to the state of ******** because the Infiniti dealer messed up my paper work and changed my title to my car to the month October mind you the car was was paid for in April and so the title should not be for October and now i have no access to the plate sticker that is passed due and I was never informed of a changed car title for a car that was already fully paid for.Business response

We got the title from ****** and it wasn't the most recent one so therefore the date is wrong. We are waiting on the most recent title so we can send it to the state and they will update the customer's record. I filed a complaint against Berman Infiniti last month inregards to not completing a paid in advance repair service for my 2014 q50. I closed it out because the company Berman Infiniti responded and said they would fix the problem that wasn't handled on august 25th 2023 . I brought my car in on November 18th being under the impression they were going to fix the issue that I did not receive 3 months ago.They did another inspection stated my car is in critical condition when in August he stated I don't have much wrong and it's a easy fix. Now I believe they have done something to my car so they can make extra money off me. I am in a loan right now that I have to repay for service that wasn't completed when I paid in August.I experienced auto theft and right after I got ripped off by this bad business practice. I just wanted my car fixed but now I want them to refund the company ****** that gave me the loan. This loan was $1383 round about. Please help me with this matter.Business response

Hi,
Per her last open BBB, we have refunded the customer her diagnostic charge like she requested. We also agreed to inspect the vehicle at no charge which we did on 11/18/2023. The customer had significant damage caused by an impact. We understand that the customer is a cautious and safe driver. We are also realists and understand that accidents happen, especially given the conditions of the roads (pot holes, road debris, etc.) We explained and showed the client the damage to the rim, fender lining, and under the vehicle. Her only rebuttal was she is a careful driver and that there is no way that she damaged her vehicle. This BBB is not warranted. If the customer likes, she should contact her insurance company to pay for the damage that we found on her vehicle during our most resent inspection.

I am rejecting this response because:The reason I am going back in forth about the matter is because the advisor ***** did not complete the job like I completed the payment up front by taking out a loan that I currently have to pay for. I came to a certified dealership because I thought I would be taking care of,clearly someone dropped the ball and will not take ownership. The director **** of berman has been fair even though he had no insight but the advisor ***** requested money about a service that should of been fixed in August I just don't get it. He has not been honest or helpful. I paid for another service that was partially done I overlooked it and said I won't worry about it but now my safety is at risk because someone maliciously added more damage to my car when I left it for service for the 3rd time with no results on nov.18th and I called off work.I am not looking for anything free I just want to recieve the services that I paid for or cancel the agreement that I have with ******.also i want to include the director of infiniti did refund me a payment in the amount of 195 as promised for the car inspection. now I just want my car to recieve the services I paid for which was to stop the noise. because that's what i told ************ was concerned with and he told me it was completed on Aug.25th 2023. The thing is i noticed that the noise was not taking care of and I called and asked him to take a ride to hear it.***** got in my car he told me it's my tires. But that was something he told me could wait so I'm confused which one is it?he told me my tires were not bad but be sure to get some thats all . I am not sure if the better business bureau reads the complaints and responses to help save all parties time. Once again, we have refunded the customer the $195.00 diagnostic fee. The customer left, hit something, came back and had her vehicle diagnosed. We have now found suspension issues (new damage) caused by something the customer hit on the road. At first, the customer stated she is a careful driver. She claims there is no way she could have hit anything. Now, she is claiming we purposely damaged her vehicle. We have refunded the customer her initial diagnostic fee, placed her in a loaner, diagnosed her new problem at no charge, and now we are awaiting her response on whether she wants to fix her vehicle (new damage) with us.Customer response

I am rejecting this response because: The only valid information posted in the response is the director of infiniti made sure I was refunded the inspection fee which let you know what's wrong with the car and after bringing the matter to there attention about the car had the same noise was because the first diagnosis was not done correctly or the problem was missed by who ever handled my car for repair .I did receive a loaner because I was told I would get my car fixed for the 4th time nothing has happened as of yet. I have a email stating they will fix my car and bring it in on nov.18th I'm still waiting for my car to be repaired and it's dec.6th. The problem is no one want to take ownership that someone dropped the ball. I am asking for either my car be repaired or cancel the agreement I have with ****** who allowed me a loan to take out to get my car repaired. Once again I'm scheduled to pay back a loan for the car repair that should have been taken care of. I'm not looking for anything free just what should have been done initially and that's to remove the noise.

I am rejecting this response because:I am not asking for free service I'm asking for the service I came in for to be complete like the advisor ***** told me it was completed. he did the inspection and he said the matter was taken care of but after findings the noise that I came in with was still present. I am not the person who dropped the ball.only solution to this matter is fix the brakes and remove the noise and I'm saying this respectfully. It's not fair that I have to pay for a loan for repairs that was not taking care of and if the repair was done we would not be having this issue that's a big concern of mines what if it was your vehicle put yourself in my shoes.

August 25th? None of the recommendations we are recommending to you on this most current repair order have to do with what was repaired on August 25th. Four months ago we replaced the rear brakes, performed an oil change, replaced a key fob battery, and replaced your map light bulbs. On this most current repair order we are recommending a right front wheel bearing, both front fender liners, both rims on the left side, tires, and time and mileage based preventative maintenance services. On August, you had us inspect your brakes. On this repair order, your concern was that you are hearing a whine type noise that gets louder with speed. You also had a concern that the vehicle was not accelerating and unable to get to highway speeds. There is no reason to continue to communicate through the BBB as you were not mistreated and like you are implying, stolen from. We addressed the concerns you had in august and this most recent repair order has totally different concerns.Customer response

I am rejecting this response because: The only issue I'm concerned about are my brakes and removing the noise. the other findings Ill handle when time permits I don't want this to be about repairs you decided that I need out the blue . I just want the service I paid for which are my brakes and to remove the sound causing the whooping noise . I have never been this stressed out before I can't believe this. On August 25th at ******* miles we inspected your brakes and made a recommendation to replace your rear brake pads and rear brake rotors. You approved the recommendation and the work was performed. Present day, you have no issues with your brakes. We are recommending front fender liners, a right front wheel bearing, four tires, and other preventative maintenance items. Why are you communicating through the BBB platform? I have called but can't leave you a voicemail because the mailbox is full. I have texted and the messages go unanswered? You hit something. Why should we pay for your mistake? You have no issues with your brakes. Your vehicle needs a wheel bearing, fender liners, and tires as a result of impact damage. These issues were not present when you brought the vehicle in on 8/25/2023. I will not replace the bearing, fender liners, and tires for free. The images we took clearly show impact damage. Since this is the only way of communicating with you, I need my loaner car back.Customer response

I am rejecting this response because: my car report in August is why I'm here now it was listed about all the things that were needed but the wheel barring was not a concern that was brought to me or it wasnt in my car inspection report. I am aware that I would need tires eventually and pricing were discussed. I was told about what's needed to be done to stop the noise . I was under the impression it was resolved with the repair ***** said was needed which were the brakes and rotors nothing else was critical. because if I knew I would of told them to complete it. Once again I reported this the same day and i was told by the advisor ***** that it was probably the tires that's keeping the noise but I knew it had to be something else. I rescheduled a appointment to find out it's now the wheel barring something that wasn't pointed out during the inspection and now a new charge is required for something that was missed. I feel its not my fault I'm only the consumer not the mechanic who dropped the ball and i paid them to find the problem which is the most disturbing part. By the way I will definitely return your loaner that was granted until my car was repaired because clearly I won't be getting my car fixed I been there 4 times missed work and everything my car in the same condition this is really stressful I wouldn't expect this from a certified dealership.

On august.24th 2023 I was a victim of auto theft I reached out to Berman Infiniti for services to get my car back operable on aug.25th 2023 . upon arrival ***** was the representative who took my car in to be serviced. He mentioned that a auto theft inspection was needed to rule out anything undetected with my car. that service costed $195 and it would identify any issues my car may have so I bought it. now after a 3hr wait and my car returned I noticed my rotors and brakes have not been completed $550 was taking from me. not to mention I paid for a oil change for $115 also a $285 deposit to get the loan started. now fast forward I am in a installment loan agreement with ******* for service i did not receive and the part That is unacceptable is they are not willing to fix the problem.This is a bad business and I cant believe they took advantage of me because I am woman.I just would appreciate a refund for my inspection because clearly Berman Infiniti did not hear that my rotors and brakes needed attention still , and of course brake and rotor fee they charged but did perform what i paid for.The total of reimbursement is $745Business response

A I bought a 2018 Q60 Infiniti in 2021. The car history stated the car had been in a minor accident in 2019 which is why I paid about $43,000 for it. Fast forward almost two years later I am about to get on a Chicago expressway when a loud cracking sound happened & I started having difficulty trying to drive the car. After having the car towed, the shop started there was other damage in the car. Berman's has denied this & meanwhilw I am left driving an unsafe car. I have now retained an attorney in order to get this all settled. Had I known about the true condition of the car, I would not have bought it. I am a female & a senior.Business response

I am rejecting this response because:The car fax states the car should be checked for possible structural damage & I do not see anywhere that was done.after the 2019 car accident by the first owner. I would not have paid a blue book price for.a damaged car & I did not sign that document. What American crosses their number seven with a line across? I also had an independent expert look the car over & drive it. He determined the car is unsafe & damaged. Part of his report is attached.

We have inspected the vehicle prior to selling it. This was certified pre-owned and if there were any signs of structural damage, we wouldn't be able to certify. We can definitely take the car as a trade in or even buy it back from the customer at the current trade in value. I recently engaged Berman Infiniti of Chicago to purchase a used car they had in stock. After test driving the vehicle and requesting to put in an offer at the dealers sell price the final charges did not align with their advertised price. The dealership added "Interior and Exterior Protection" option at $1,595 that I did not request or require in my purchase of the vehicle. After asking the dealer to remove their added service option they refused and would not sell the car without this added option. Berman Infiniti website offers an online purchase. I submitted a request to purchase the vehicle at their requested price without additional dealer added services however they continued to deny the sale. Over the phone the dealers representatives confirmed the website does not account for the $1,595 in additional service charges. However their website completed a deal sheet at an offer price of $20,434 which I do agree to paying to purchase this vehicle. Attached I have documentation and confirmation of the completed deal sheet at an agreed price of $20,434. Correspondence with the dealer where they refused to sell at online deal sheet price. Their email response stating the offer provided in person price, nearly $1600 more than offered online, is the best offer they would sell the vehicle at. Image of the dealer added service option as it is listed on their website as an add on service. My request is for the BBB to investigate what appears to be false or misleading advertising by this business. I would ask that Berman does honor the deal sheet per their website tool and my request to purchase at their advertised and listed price of $20,434. As this may constitute further perusal under the ******** Deceptive Business Practices and Consumer Fraud Act ("ICFA"). Thank you, *************************Business response

This is my second request first the car that was given to me is not the car that I test drove the car I test drove have 63 miles the car that was given me had 85. Number 2 this car is a lemon I can be driving down the street and the car stalls like it has jumped out of gear the radio cuts out without being touched I have got warning and when taken to the dealership Im being told that its something Im doing or they have never heard of what Im telling them lord forbid if Im going at a high rate of speed and the car cuts stall or cut off all together Ive been to this dealership numerous times and each time Im being treated like something is wrong with me please helpBusiness response

The motor in My power Driver side seat in my 2019 Infiniti QX50 went out. I took my car there at least twice but they couldnt find a problem and its started working when it was at the dealership. But every time I got the car home the seat would stop working again. So I took the car back recently and the found out that the motor in the seat was going out. But now its not covered because the warranty expired. But if they did more investigating they would have found this problem before the warranty expired. I feel like they stalled to get money from me. Replace headlight assembly April 2021 , paying out around $3800.00 , 1 year later and a few days both head light were acting up, berman only replace my left side assembly and refuse to service the right side because the light wasnt acting up at that time . November 2022 the right side light went completely out and the left side that was replace in May 2022 going on and off . Had a service appt 12/2022 and I was advise that service staff member ****** that he will not look at the light as well , the light has to be completed out to be serviced . In addition this is the light that was replace in May ****, he also advise that he will have the Infiniti cooperate office contact me. I final spoke with someone 2 weeks later after 12/1 /22 .. o waited for a mother two weeks and going back and forward about getting my car service , no response, I sent emails , no response. Everyone dont have money to throw away .. Im not rich, I was only able to drive to and from work , leave work early because my car light s are not working, this is dangerous . I ordered my light on **** , and the light was around ****** and I paid 150 for labor .. the light has been working with no problem.. I was advise by the Mechanic that the light was not Properly installed. Berman over charge me for being a black and woman . The same part that was installed by Berman was a fraction of the price . In addition when I had my light replace in May 2022, I had around 600 for labor .. when my light was replace 1/9/23 it took one hour .. I feel as thought I was not treated fairly .. on 1/9/23 I spoke with service *********************** about my concerns , he was truly unprofessional, not understanding, he laughed at me when I was sobbing about the difficulties and emotional distress I experience not able to use my vehicle., unable to be apart and care fir grandmother , she pass away on 12/24/22 .. I am requesting for berman to refund me 700 for the replacement of my right light assembly, in addition to review the over price for the first time paymentBusiness response
