    On January 27, 2024 I was driving westbound when I hit a huge pothole. The pothole caused me to have a cracked rim and flattened tire. I had to get it towed and get rim replaced and tire fixed costly a total of $2450. I then filed a motor vehicle damage claim with the city of *******, which resulted in third party responsibility.

    We are responding to the complaint received January 6, 2025. The complaint states that ***** ****** was driving westbound on an unnamed street and hit a pothole. The incident caused damages to the vehicle and a claim was filed with the City of Chicago. The complaint further state that the claim "resulted in third party responsibility."

    This is the first we are hearing of this claim. What typically happens is that a motorist has an incident on a City of ************** resulting in property damage to the vehicle. The claimant files a claim against the City of ******* and the City investigates the claim looking for contractor that may be responsible due to having a permit during the time and related to the location where the incident occurred. The City then sends a letter to the claimant stating that the City is denying their claim. The City then references a third party company, like Bigane Paving *** working in that area at the time of the incident and references a permit number. The City of Chicago does not forward a copy of the complaint filed to the third party. The letter also indicates that the claimant should contact the contractor named for possible resolution of their damages. 

    As I am on your website to respond to this complaint I am for the first time seeing the letter from the City and the receipt for damages. Upon review of the letter, I can state that we were not copied on this letter. The letter lists our company name and address, but makes no reference to a permit number. Ms. ****** made no attempt to contact our office for resolution of this issue. Furthermore, the City of ******* does not forward the claim details to our office for follow up. The responsibility for further pursuing the claim rests with the claimant. 

    We suggest that Ms. ****** contacts our office with the claim documents filed with the City of ******* so that we can review the facts and circumstances related to the claim so that we may determine if in fact Bigane Paving ** is the party responsible for the damages incurred.

    I am rejecting this response because: I spoke to Mr. ***** I submitted all necessary documents including picture of fixed pothole, original accident report submitted to the city, the city's response illustrating Bigane Paving as the responsible party, along with the receipt of rim. I am awaiting response from Mr. ***** at this time.

    My car was parked in front of my house, when I returned back home that night. I noticed that my car was covered in tart. There were no signs nothing showing that they had laid fresh oil down. The following day I walked up to one of their workers and told them that happened to my car and said they can't help me i reached out to my aldermen who then spoke with ******************* and he stated there is nothing he can do to *** him if i wanted to. All I want is to be reimbursed for the car tailing that was done to remove the tart of it. I have pictures that there were no signs and how my car looked
