    On 11/03/2022 I ( *********************** ) signed a contract to purchase a property ( ********************* ) .Which it was two unit building , I gave a downpayment of $5000.00 ( ******* money ) by ACH transfer .Payment was made to *********************************************** .Deal was approved by the lending bank , but when the bank made an inspection on the property, they found out that SELLER was using the basement as an Illegal Unit , which had utilities installed. And that was never disclosed on the contract . The bank decided not to move forward with the closing of the property and the deal was cancel between buyer ( myself ) and seller .******* money on the amount of $5000.00 should be returned to myself but closing company does not want to give me the money back , even though it was not our fault for the deal not to close .They want to keep our money , which unacceptable. The seller lied on the contract , and title company wants to keep ******* money .I have been buying / selling properties for years and this is totally illegal .I will be attaching emails and other supporting documentation such as contracts and inspector reporte of the property .

    Baird &Warner held this money as escrow agent on behalf of Claimant, as Buyer, and Seller who were parties to a real estate contract that was terminated.  Our client is the Seller.  The Seller has offered to split the ******* money and ************** did not agree to this.

     

    Under the ******** *********** License Act, ********************** & ********************** cannot release the funds without joint written direction of these parties, which we could not obtain.
