I had my entire roof replaced on 2/2016 and paid for the job in full. Around October of 2018 I called to advise that i had a roof leak and wanted to know if the repair would be covered under the warranty. They sent a contractor out on 10/22/2018 and he found the issue, patched it up and sent me pictures telling me the work was done. I thought the problem had been resolved and the damage was covered under the warranty. Weeks later I get a call from a manager asking me if I had other work done on the property by another company. I advised him I had my parapit wall repaired by another company. He went on to question me about why I didn't have Nombach to do the repair. I advised him that I had called Nombach for a quote and the price was out of my budget. He went on to say the leak that they repaired was due to the work done by the other contractors and now I owed Nombach $210 for the repair. The leak had nothing to do with the parapet wall or the flashing replaced by the other company. It was a tear in the roofing material and I have the pictures from the Nomach contractor to prove it.I was not notifeid at the time of service that the leak wouldn't be covered under the warranty or that a fee would be charged. I should've been notied before the repair that a fee would be charged and given an option to move forward with the repair. Instead, I now have a lien on my property for $210 plus fees which total more than $600. When I called Nombach after discovering the lien I was sent a copy of my original contract with a section highlighted stating they can charge a service fee for any damage they deem isn't a result of their workmanshop. What the contract doesn't say is that this fee will be charged before you are even notifed if the damage is covered or not. This whole things sounds like a scam from a company that's so peity that they would put a lien against someone's property for a $210 service fee that wasn't even communicated before the repair was done.

On 10/10/2018 Nombach was called out to repair a leak on the roof we did in February of 2016. Nombach actually waived the up front service charge initially because the customer was only a few months past her 2 year warranty period. Upon arrival, we discovered there was a puncture in the roof caused by activity on the roof. We learned that some work had recently been done by others on the masonry walls around the roof. The puncture in the roof was clearly made by those masons while working on the roof. The photo that the customer provided shows that something punctured the roofing membrane. Our service tech sealed the puncture and another area that he noticed on the wall area.

Our service manager then reached out to the customer to inform her of our findings and what the tech had done and that a service charge for his labor and material would apply as this was caused by someone else. An invoice was sent out on 11/1/2018, 11/19/2018, and 1/15/2019 (attached). Finally, a letter of intent to lien was sent out on 5/7/2019 (attached). The homeowner was given ample notice and time to pay for the small repair we did for her.

As a business, we reserve the right to lien a property for service rendered, regardless of the cost. In this case, we were charging for labor and material used at a very minimal cost to the homeowner. The work we do is not free, it costs time and money. The charges to her were more than fair.

I am willing to release the lien if payment of $450 is made to Nombach to cover the service charge, filing fees and legal fees.

    Regards,

I am rejecting this response because: 1st - I never received the lien notification letter.  You mailed the letter to the property where the repairs were done.  This is an investment property and I do not live at this address.  If you look at the signed contract you will see my home address and the property address listed are different (please see attached).

2nd - You admit to waiving the service fee until after determining the damage was done by the other contractors.  I'm not sure how you can be so certain what caused the damage especially since the leak didn't start until a while after they performed the work. Nevertheless, if I would have been advised before the repair was done that the damage was caused by the other company I could have had them come out to make the repair under their warranty.  I was never given the option to get the repairs done myself because your contractor did the repair and left without notifying me of the cause of the damage or the cost of the repair.

3rd - I did not expect the repair to be done for free.  I chose Nombach because I had work done by you guys before ( on a different investement property) and was willing to work with you again. I only called you out to see if the damage would be covered under the warranty.  It's unfair to me for you to do the repair work without my consent and then charge me later because you decided the damage was the fault of another company.

I'm willing to pay the $210 for the patch work.  I would've contacted you sooner if I would've received the lien notice.

I attached a copy of the original contract to show that you sent the lien letter to the wrong address.

    Sincerely,

I am positive the lien letter and invoicing was sent to both addresses listed on the contract. However, in the interest of closing this out, I will drop the fee to $350. Lawyers are not cheap and I will need to pay for the lien to be released once we are paid. I will not accept anything less than $350. We are already eating legal fees as it is at that amount.

If this is acceptable, you may call in a payment via ACH (direct deposit) or send a money order or cashiers check to our office at ****************************************************************. Please make checks payable to Nombach. You may pay with a credit card, however, there is a 3.5% credit card processing fee that will be applied.

    Sincerely,

    Nombach

Nombach Home Exteriors replaced 4 slabs if concrete at my home last spring (2021). The concrete replacement on the west side of my home has become discolored and has several unsightly blotches. Nombach was informed of the problem twice. after the second notification (by phone), two young employees were sent to my home to address the problem. they simply used a water hose in an effort to wash away the discoloration. this is something I had attempted to do several times before notifying Nombach of the problem, I am requesting that the stains be permanently removed or replacement of the discolored slab of concrete with the usual grey concrete normally used.
