            It has been 4 months of having sewage spilled into the my backyard. The city has come out and they state it is not their issue but the landlords and the landlord is not doing anything about it.

            It has been determined that the sewer line issue is located 80 ft out from the home. Which means the City of *************** has to make the repairs, as it is on city property. At this time they are working on setting that up.

            We are not allowed to make repairs on city property and not in control of when they make those repairs.

            First off BnD rented me this apartment without a valid permit from housing authority. I was also told it is a 2 bedroom apartment and signed a lease for a 2 bedroom apartment when it is not. It is a really big studio at best. I moved in January of 2023 and have had nothing but problems with them. I told them the day I moved in that there is a window that does not lock, and it needs to be fixed. I was told it would be fixed. I have called several times since to get it fixed and now, I can't even get a response from them about any of my issues and there are A LOT of them. It is now Feb 2023, and my heater does not run efficiently. When it gets below 20 degrees outside my son's room's windows ice up on the inside and his room cannot get above 57 degrees even after the heater ran for five days straight without turning off once. I was told by the maintenance man that the windows would be sealed, and someone was coming to service my heater... it took them 3 days to seal my windows (and they were not sealed properly by the way), and I had to give them my own plastic to do it. They never came back to service my heater which he saw didn't have a filter and it has never had a filter in it. Again, I've been here a year. When I asked why no one has come yet to service the heater, the only response I got about a week later was from the same maintenance and he said that it was out of the kindness of his heart that he would send someone out but unfortunately he has nothing to do with BnD even though, as I told him, I know he is planning on taking over the current property managers job, in which he admitted was true. Also, a screen is missing on another window next to the one that doesn't lock, this is also a violation of the housing code. The place is infested with mice. I've spent hundreds of dollars on traps. All of these issues I have brought to their attention and as of today I have not received a response at all from anyone except to ask for the rent money. The last thing is that the same maintenance guy that told me the heater would be serviced informed me the basement of my apartment is not a part of my apartment and yet all the electric down there is in my name. Plus, there is door leading down into the basement that they always knock on my Apartment door to get in my apartment to access the basement with. I would think if the basement was not a part of my apartment that the electric wouldn't be in my name down their and that a door leading down to it would be secured, in which it is not. It is obvious that BnD has no concern for the safety or well-being of their tenants. I have paid my rent on time every month until now because I don't know what else to do. I have never done anything wrong so I'm just not sure why my 12-year-old son and I are being treated so poorly. I'm tired of being cold and afraid someone can easily break in at any moment and hurt us and it is hard to afford the electric heater running nonstop. It costs me more than half my rent to run it.. It is making me physically sick because of the stress of all this. They do not communicate, and they do not care.

            When renting in ********, **. the property has to be passed inspection by the city before a tenant can apply and get their occupancy permit, which the tenant was able to do. There has never been a record of any service calls for a mice infestation from this tenant, or any other tenant in the building. It is possible that mice are coming in because  she keeps a rabbit in the basement and the food and water would definitely attract them.

            No one entered the premises without permission. Her boyfriend let our service men come in to do repairs. As far as them coming back to fix issues the tenant left 2 harassing voicemails threatening bodily harm should they come back to her apartment. She has one room that is cooler than the others, we offered heaters to help and she refused. At this time she has been served a 5 day demand for rent and has not paid. If she can call and leave threats on the voice mail. She call and leave a civil message for repairs that need done.

            I am rejecting this response because:

             

            almost all the information they have provided is false. I absolutely was rented the apartment and signed a lease before it was permitted to be lived in by the city. 
            I dont not have rabbits. Also they did not respond to all of the issues I stated. I do have proof of the apartment being leased to me before it was ready even though they said online and to me in person it was ready to move in. I just need an extra day or too to get the paperwork from the city to prove the permit was issued after I signed the lease.

            Also I would like to add that I never threatened the maintenance workers. I said if BND cared for the safety of their maintenance workers they would make sure to notify me, as required by law and by the lease, when they are entering my apartment bc otherwise I will be unsure that they are unfriendly. The man that answered my door was not my boyfriend nor a tenant on the lease and had no authority to allow them in my house. He told me they acted as if it was okay and he thought I knew. They had absolutely no right to take his word as proper authority. I will have the paperwork of the permit not being valid when I signed the lease and they told me the apartment was ready to move in. I have to wait almost two weeks and call the housing inspector myself to get the permit to go through.

            i moved out in march and have been waiting on my deposit and they have ever excuse.but this is what they know for.that good I TOOK PICTURES WHEN I MOVED out .because this is some messy stuff when it can be avoided.

            The former tenant has been mailed a check for return of deposit minus cleaning services and the minor floor repair in the bathroom required by the code enforcement of Cahokia Heights IL.
