In September 2023, we contracted Style Exteriors to replace our roof and gutters. During roof tear-off, they noted damage to the wood chimney surround and recommend replacing it with a steel unit. In the process they removed a section of the chimney flue to our wood burning fire place. In January 2024, we discovered that the replacement was incorrect--they replaced the flue to our wood burning fireplace with a unit that is rated for gas burning appliances. Not only did this put us at risk for a house fire, but it caused damage to the entire fireplace system. We contacted Style Exteriors to work on a resolution. After some initial progress, they became less communicative and four months later they filed a claim with their insurance agency. We have reached a settlement with the insurance company for about half the cost of the estimate to repair the damage. We have contacted Style Exterior to refund the cost (approximately $1000) of parts and labor we paid them to install the wrong part; they have not responded to our request, made 2 weeks ago.

I am rejecting this response because: the insurance company's representative said that they cover the cost of the replacement and repair, but the cost of the original improper work that was performed, per the email quoted below (bolded for emphasis):*****,
Can you give me a bit more information the inspections for $200 each?
In addition the original work that was performed and
money paid out for the same would not be covered under the insured's
policy. The policy kicks in to cover replacement of the incorrectly
performed work only, unfortunately it would not cover the original costs
paid out.

Hello,
We have had communication with the Insurance Adjuster, our Broker and Attorney over the last few days. You will be receiving communication from the Insurance Adjuster and our Attorney regarding next steps in order for monies to be released to you for replacement of your fireplace. We are in agreement on additional payment for chimney cover, but will require the General Release and Non-Disparagement Clause to be signed.
