    On 7/17/23 I paid Coldwell Banker ******* for ******* on a home. I did this through the ******, ** office but I think they did it for *****************. The home seller promised a new HVAC which they did not provide by closing. They also promised the roof would be repaired by a roofing company which was not done by closing either. The radon was double the legal limit and this was not fixed by closing either. Weeks after the closing date this still was not done and I have been calling and they refuse to talk to me or address anything. The home relisted and sold on 10/31/23 and they are still keeping my ******* money for some reason though they did not fulfill the contract. I would just like my money refunded as they did not keep the closing date or the things they promised that I have proof of in emails and texts

    . The contract was AS-Is and then the buyer requested significant repairs anyway as you can see in the attorney request. You can also see the seller attorney respond about the AS-Is and the request and they still offered a credit to the buyer being the seller lived out of state and could not do or orchestrate the repairs. They buyer then sent a cancellation and ******* release request which was submitted and the check was cut by accounting and it was mailed to the buyer back in July.

    I have included a copy of the front and back of the cashed check of which the buyer received and cashed at his local bank, *********************** with his signature on the check August 4th, 2023.

    Both attorneys have been informed of the buyers false complaint to the BBB.

    I am rejecting this response because:  Check my screenshots of texts and emails and you will find that they agreed to things they did not fulfill.  Last I knew I was asked for my signature to release the ******* and I refused so how did it get released?    I tried many times to attach 3 pdf files that are only 5 mb and it will not load them.   Your site is not working.  Is there another way to send them?

    Again, once a contract is put together, I am only allowed to follow the direction of the attorneys as to the required steps per IDFPR regulations. The client and his attorney requested the cancellation of the contract in a legal document and also requested the return of ******* money which was returned, received and cashed by the buyer as requested. 

    There is nothing further we are able to do as the client and his attorney cancelled the contract and requested their money back which was received and cashed by the buyer at his own personal bank despite accusing us of not returning it. We have completed the process as required by the ************************************************************* as requested by the client, there is nothing further we can do once the client and his attorney cancels the contract as the contract is nul and void. If the client has further questions or need further assistance he should contact his real estate attorney *************************** who represented him in the transaction.

    I am rejecting this response because:  This says There is nothing further we are able to do as the client and his attorney cancelled the contract and requested their money back which was received and cashed by the "buyer" at his own personal bank(  I am the buyer and I did not receive any check at all)  despite accusing us of not returning it.   I did not receive my ******* back.   It was 1000.00    Since now they are saying they returned it and I cashed it please show me the cashed check ??
