Offered us $4500 for a bike at the end of riding season and $4900 at the beginning of the following season. Went back to sell at the beginning of the season and wouldn't give us more than $3800. KBB's for $4500 stock and it isn't stock.

    Business response

    04/01/2022

Business Response Unfortunate situation where the customer assumed that an "alleged" offer (nothing in writing on either side) approx 5+ months earlier still stood the next year to buy their motorcycle. I tried patiently to explain how much less wholesale book value is and how their figure must've been an answer to what the bike was possibly worth (retail) and not what we would buy it for. Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.) Whether or not the owner chooses to remember stating that if we returned at the start of the following riding season he would purchase for $4500+, he did. He offered to purchase the motorcycle that day for $4500 (again, whether or not he chooses to remember stating that). When we returned he tried to offer us NADA retail stock ($3800), then when we showed what it was worth with the additions we've made ($4777 NADA retail), he started his story about wholesale. He's shown deceptive business practices and other potential customers should be warned before being scammed out of money. Business Response Dear BBB Case Agent, No deceptive business practices here at all. We're super proud of our clean record and it's what has built our business with tons of repeat happy customers within our 1154 bike sales plus parts & service customers for over 11+ years now. The following cut/paste is the post-discussion I had with Ms. *** after she felt necessary to give me a bad review on Facebook.. I called her fiance immediately afterwards to tell him how unfair that review was and he was VERY surprised to learn she had done that. He and I had very good long conversation about the deal that day and he understood the circumstances about what may have happened and why I couldn't pay $4500. ($2237-$3437 is dealer) Ms. *** and my phone exchange only lasted 30 seconds later that night. Quickly after that the bad review was posted. Also note that there was zero contact for however long ago the original chat took place. (5+ months) Nothing in writing on either side with no notes in my logbook about a potential buy etc. whatsoever which I always do. Mar 2, 2022, 10:38 PM **** *** **** *** I'm ***** ********* fiancé and just wanted to share this with you. If you're going by NADA, then the $4500 you offered him in the fall is low. It is worth $4,777 with all of his options according to NADA. Feel free to give him a call tomorrow. If you follow through with the sale I will edit the reviews you're concerned about to say that you did so. Mar 3, 2022, 5:46 AM Hello ****.. got the pics & it's a real nice bike with a lot of cool extras! However.. I hafta buy at dealer wholesale not at retail.. I'm not sure what was said that long ago (6 months..?) but I would assume that we discussed about what it was worth to an end user if we were talking $4500ish back then.. Any other shop would probably only want to pay $3000ish.. please accept my apologies if you were offended.. **** *** No, you offered him $4500 for his bike that day (and no, it wasn't even 6 months ago) or more if he waited. You have put us in a bind by going back on your word, as we have been shopping for motorcycles with your offer in mind. But he will sell it for what it's worth and you will not be receiving our business again, and I will share our experience. **** *** Also...you offered him $3800 based on the NADA value stock, when you had not asked about the additional options. If the NADA value increases to $4777 based on options, why offer him less than that? That contradicts your statement that you're basing your offer on "dealer wholesale". Mar 3, 2022, 7:23 AM I wished you guys would've just called me and asked we could've avoided this problem b ..before making plans. **** *** ??? he did call you and you refused to extend the same offer. In multiple phone calls. But you're right, we shouldn't have trusted you to keep your word. Our mistake. We won't make it again. No contradiction on nada book value. $2230- $3437 is dealer. **** *** We are not trading it in. KBB and NADA value it higher than he's asking. And even if they didn't, it wouldn't change the fact that you deceived us for months with your offer then took it back. If you didn't want to pay $4500 for it, you shouldn't have offered it. The only way to make it right is to follow through with your word to buy his bike for $4500. If you refuse to do so, my reviews and complaints stand, and you can stop messaging me and contacting him. ***** and I discussed the deal more thoroughly on his first call to me yesterday which I wish you were able to hear so I think if u had then this wouldn't be as big an issue.. **** *** He may not have been as vocal, but he is also extremely disappointed that you went back on your word. $700 may not mean much to you, but it does to us when you are trying to offer us that much less than we were told, and almost $1000 less than the bike is worth. We have been sitting on your offer for months, as you stated it could even increase at the start of riding season. I'm sorry if you've chosen not to remember that, but we're not liars. If you will not give him what he's asking, which has not even increased, then you lied to us. Like you pointed out earlier, maybe we shouldn't have trusted you, but we did. We will not give you the bike for less than it's worth, so like I said, you can either follow through with what you stated, or you can stop contacting us. Let us decide how "big of an issue" it is. Mar 3, 2022, 11:06 AM Ok.. sorry this deal went completely off the rails.. my intentions are to notify u when I get in a Roadking or such that we can trade on that would be a better deal & bike for all and redeem all the trouble I've seemed to cause. **** *** Thanks for the offer I guess, but we've found a bike to purchase. We'd told the seller all we had to do was take the bike to you and we'd have the down payment for him. We've now informed him that you went back on your offer, and we are scrambling to figure out how to sell quickly to get the down payment this week. We wouldn't trade it for less than it's worth, anyway. So if you want to "redeem all the trouble" you've caused us, then you can purchase the bike for the $4500 you offered him. Otherwise, we don't need to have any further contact. Seen by **** *** at Mar 3, 2022, 11:15 AM Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.) The owner continues to tell blatant lies about the situation. My fiancé was aware and contributed to the reviews, and he would be happy to tell you that. He told the owner as much when he called to harass us after the reviews were posted. He also remembers the $4500+ offer by the owner and is disappointed that he deceived us, and, again, would be happy to tell you that. I never communicated with the owner via telephone. Again, it is not our fault as potential customers that the owner failed to document his offer. I did have to report the owner to Facebook because he continued to harass me after I requested he cease contact via messenger, as he has shared. I do not accept this "proposed resolution" because there is no proposed resolution here. We are not happy that the owner continues to lie and deceive, but we are allowed share our experience. The only resolution is for the owner to tell the truth and complete the deal. Otherwise, there is no sense in this back-and-forth. The reviews and opinions will stand and we/our family/our friends will take our business elsewhere. At this point, more than anything, we want to warn other potential customers so others are not victims of this business' deceptive practices.
