    Had 5 contracts with BM Fence aka ****** Martinez. These were to be performed at the same time. 1st one signed in Nov '22 and 5th signed in Jan '23. Company fulfilled the smallest contract satisfactorily. 4 pending contracts. Totalling over $30,000 So far, have paid nearly $17,000 ******, the owner, pretended to know enough English to agree to do work, to sign contracts, to accept payments, promise that he would get licensed subcontractors where needed, and continue to make assurances. Then, all of a sudden needed translators for any and all issues. Acting as though he couldn't perceive issues, or problems, or answer why certain mistakes were made (obvious to layperson), had lame excuses or promises to fix complex issues. When they were simple problems, and pointed out by the homeowner or agent, BM then balked at even the mere suggestion of corrective measures. Several more promises, reassurances, guarantee that things would be done in the order promised.Several texts back and forth, with very little making sense.Disappeared for a wk, came back and apologized, stating out of state family member's illness, then 2 wks of very sporadic work later, did it all over again.Disappeared, made another excuse, this time of personal illness.When told that work pending was delaying other contractors, BM began ranting and texted back.Then apologized once more, promised completion of work on 2 of phases of 2 contracts or return on the down payments of those 2 contracts. He picked up materials purchased by homeowners. 1 wk later, NO WORK except have 2 of his employees completely bury plumbing cleanouts and floor drains in 2" of concrete (minimum code requirements of 3.5". We were promised 4".) Of course by burying we mean they dumped dirt into the floor drains first! Then, poured concrete on top. Thankfully it was only ****psi and only 2" thick.Refused to acknowledge his mistake or take phone calls. His last text: "See you in court," as if we breached the contracts!

    I hired ****** and his crew to do construction work for me. He received $3,500 and he did not finish the work. I have left several messages asking him to return to finish the work or return my money. He wont answer.

    On 9/30/2021 **************** ******** representing BM Fencing as the *** and Owner made a contract with us to install a steel fence with gates around our premises located at ***************************. We paid him a down payment of $2000.00 dollars at the time of signing the agreement. It now has been ********************************************************************** February of 2022. We made numerous calls and texted him but always had excuses why he hadn't returned. After months of trying to reach him, we begin to do a background check on his phone number and name. that is when we got his information by searching businesses in the ****************. Once we found where his office was located we went there to only find out that he runs it from his home. We also found that he is licensed through the *********************.We then went there and meet him and he was totally surprised to see us. He then claimed that he would ve there on that Tuesday and finish it by Friday. Once again that never happened so we went to visit him again in June he claimed that he was waiting for the material to come in and that he would be there next Tuesday .Again he failed to show up but sent a couple of his guys to install two more posts they stayed a couple of hours and they left because he never showed up. So once again we called him and texted him and he said that I'm not worried I'll come there soon I'm tied up doing another job but I have my lawyer and he will take care of any suits against me. Last week July 12th we called the **************** Code enforcement and made several complaints against his company. He keeps saying that he will be there next week and finish the job but he never shows up.
