  On 4/27/22 my tractor and trailer was loaded with roof shingles for BNSF Company. Myself and the driver parked the load on the side of some apartments for rest. The trailer was unhitched with a lock in it. When we returned we noticed the trailer was missing. A police report was filed in reference to the trailer and cargo. I notified my insurance American inter fidelity in order to file a claim. In the result American Inter Fidelity denied the claim stating unattended vehicle. After checking my policy I did not find anywhere stating that I could not file a claim for this. The company forwarded me some information showing I could not file a claim on this,however, that information was not on the original policy nor did the agent or anyone from the company inform me of this. I have had this policy since 08/2021. Which renews annually. All payments have been made on time. I would like to have this matter looked into thoroughly because I feel that the insurance company is trying to get out of satisfying my claim. Load

  This claim for the trailer and cargo were denied under the unattended vehicle exclusion.  We do not provide the coverage on the trailer.  Per ***** at AAOO the carrier that he has the trailer insured through also has an unattended vehicle exclusion.  I have attached the policy here; the exclusion is on page 32 and 33.  This is a flat bed loaded with roofing shingles.  This insured was practically advertising for a theft.

   I am rejecting this response because: I do not find your decision acceptable because as you say the vehicle was unattended. If that is the case would your policy cover the trailer had I stepped inside a truck stop to buy gas, or any other services. Would it cover if I had parked at a truckstop designed for truckers to leave their trailers for an overnight stay at a local hotel. These are just questions because these are routine actions for truckers that used trailers to haul items. So therefore to my understanding from your wording my trailers would never have been covered under your policy if I were not physically with them. This should have been thoroughly discussed at the time of the policy purchase. As before I operate A legitimate reputable business the load was not an intended target for theft due to the fact I have use this location several times in the past to unhook. And according to FMCSA, I am allowed off the road time and with that being the case where do you suggest or how do you suggest I would have handled the situation to keep my trailer from being stolen.  

  
  

  To conclude this statement there is no way that I would ever agree with your ruling due to the lost that I suffered from this theft.

  This particular circumstance included a voluntary decision to leave the trailer unattended.
