    I rented a house July 1, 2020 from ***** " Welcome home sales and rentals". I am actually still in the house, making preparations to move and be out by 15 July. The only reason I am moving, 8 mos. ago ***** called me by phone stating that I was on a month-to-month lease and I had 30/40 days to move. She said she realized that it was the worst time of year with it being Christmas, but the owner has to sell. This put me in a panic. I am ** years old and on a fixed income, my Son Has paid my rent from day one. I was on a yearly lease that I and the owner both signed June 2021. My son contacted ***** and told her that they had to honor my lease. but still having to move come July, Being ** years old and having a ******** daughter, being on a fixed income There was nothing available, My only option was to be put on waiting list. So for the last three months I have sold all my furniture to be able to afford to move. We have been sleeping on the floor on mattresses and living out of a suitcase. Hoping that something would become available. The only option that has become available was moving 11 hours out of state with One of my brothers, leaving my son and my grand babies here. So that's where I'm moving, but it won't be available until mid July. So I put my 30 day notice in, saying I will be out July 15. Since then A lady came to my door saying that she was renting this house after I move. Not buying, but renting, for $**** a month. So, the owner is not selling as ***** said. Nor was I given the option to stay for $**** a month. She's Lied, Been deceptive And very unprofessional. The least she can do is honor my 30 day notice and give me till july 15 to move. I will pay through July 15th. That's the least she can do.

See attached. Not July. On Dec 3 owner stated via email he wanted to sell at beginning of year. I told him I understood and explained the legalities. I did a market analysis and he said he wanted to proceed. I explained they had a lease till June 30th and he had several options. Sale as an investment, sale with it known renter has legal lease till June 30 or compensate her to move for 5 months early. He said ok. I told Ms ****** on Dec 23rd 2021 that he was planning to sell. Not only did she come at me sideways her son was furious as well. This did not mean she had to move. This was not a notice to vacate, it was a considerate heads up that she needed to have. See text. She was upset despite her age and circumstances that has nothing to do with me, I understand renting and then owner deciding to sell is scary. After the first of the year owner decided to wait till her lease was up June 30th 2022 to sell. See emails. I even told him we could put it in market July X XXXX. Legally that's what we should do. Did another market analysis and we got a game plan to sell July X XXXX. Everything in f else was fine. On March XX XXXX my assistant ******* ****** XXX-XXX-XXXX) and myself went to do a quarterly walk through inspection on the property at 510 sands drive for Ms ****** and owner. We arrived and there were boxes everywhere. She had stated she was moving to ******** with her daughter, son and grand babies. They ALL were relocating. She was getting out by June 30th prob before she said. We both took note and said we will set up a move out walk through per *** (******** Real estate statues) June 30th 2022 and I could release her deposit at that time so she doesn't have to wait for us and can go ahead and get on road since it was a holiday weekend. All parties shook heads thanked us for everything the past year and we left. Per email with owner (see attached) april18th 2022 and. April 19th,,, he asked me again price to sell for. We coordinated back and forth for a month on an amount. This is all also knowing Ms ****** was moving across country with her family and was vacating June 30th 2022. May 4th me and owner we discussed further about his options. On May 5, 2022 ***** ****** the owner requested a time to chat. Again I was under the impression that he was going to put it back on the market for sale July 1. After our conversation, and his conversations with his accountant he then decided that he would rent for another year or two and it would not benefit him to make a bulk amount of money and pay capital gains. I understood and concurred. In that conversation he told me to rent it for $**** a month see email he gave me explicit instructions on what to do. All wow we knew that Ms ****** was moving and would be out as her lease ended June 30th 2022. See extension again. So when I got the email from her saving that she would be out July 15 this was completely not acceptable I had already had an approved applicant for $**** a month and was ready to move in July 1. I explained to Ms ****** this was unacceptable. I apologized but told her things had changed on behalf of owner and he was now renting it July X XXXX to another couple. She was furious. I apologize several times but as you can see in the emails she would not take no for an answer. So I contacted the owner and I contacted the new tenant and let them know what was going on because I understand moving across country is definitely overwhelming. I was trying to be accommodating, the new tenant understood also and agreed to move in July 15 instead. In saying this I changed everything in the computer prorated Ms ******'s rent and told her we had to do walk through on July 14th 2022 to move new tenant in and get her deposit to her. Her her email she said that she would be out possibly even before. I never said that she couldn't stay after I talked to all parties involved her lease is June 30, 2022 she was supposed to be out so given her 15 days was generous of owner. I contacted her via email and told her that everything has been updated on her online portal to pay her proration online by the 5th as usual. Please note today is the 5th and she still has not paid her proration of $******. She is also not contacted my office for a final walk-through next week which is imperative to the new tenant moving in. I explain to her that the owner changed his mind which per ******** real estate statutes I have to give notices and follow Lease, Property management contract, and ** Real estate law. Everything that has been done in the past six months has been done legally. There has not been any deceit, lying of any kind or undo stress put on Ms ******. Her lease is up on June 30th 2022 and we expected her out. Period. I have done everything the owner has asked and followed my lease in place. Per contract. I can not help if owner sales property, re rents it or decided to pull his home from me completely. All of that is his decision to make. Per emails attached. I did just that. I let Ms ****** know everything that was going on from the moment the owner told me what his plan was. Whether she wants to move across town or to another state that's nothing to do with me. The fact that the $**** rental was not offered to her to stay it's because she made it very clear to me in my assistant mini mini mini times on top of her son telling me that she is moving to ******** to be with her family and her grandbabies. I completely respect that and understand since her lease was up anyway that she was going to move never did she say that she was trying to find another rental never did she say that she was going to remain in ********. The offer for $**** a month was only offered to new tenants,, after owner decided not to sell and after she gave us notice several times of her moving across state. Yes she has agreed and has given me to July 15th to move, and I appreciate that, but I do not appreciate the lies and deception during this whole process, from her initial notice that I had to be out by January 1st 2022, then finally giving me until my lease ran out 6/30/2022 after my son stood up to her and had to threaten her to get her to honor my lease. And this was not settled until the end of Dec to the beginning of Jan. Mind you I still was still thinking I had to be out in Jan, because she initially gave me notice in mid NOv. (see attachement) She first contacted me in mid Nov of 2021 saying that I had to be out in 30/40 days and there was nothing she could do about it. She tried to get me to believe that I had signed a month to month, which I had not. Also her saying that I was very angry with her (sideways).I have never been anything but polite and cordial to *****. She said I came at her sideways. I did not. I immediately called my son because he was the one paying the rent for me to live there in exchanged for me caring for his 3 children while he worked. I asked him why would she say that I was on a month to month when I had a copy of the lease the owner and I both had signed. He of coursed called her. I was very upset with having to move with such short notice but I was never sideways or upset while speaking with *****. It was not without my son threatening her with taking her to court and suing for damages that she finally no longer was forcing me to move, but several weeks had passed *** I had already sold a number of my belongings to pay for the move and my Christmas had been ruined. I not knowing what to expect just was counting the days before I had to be out. The walk through that ***** mentioned that she was present at, yes I did have boxes packed, and did say I was moving, but it was only with my daughter, and I mentioned it was very difficult having to leave my grandbabies who have all lived with me since they were born. but I was not angry, I by then had had months to except and plan for it. ***** before the end of the walk through said to let her know if we needed to be out before the 30th or little after. (see attachment) Concerning the pro-rated rent, *** from her office called me on Thursday 6/30/2022 wanting to know if I would be coming into the office, turning in the keys. I told her that I have until July 15, 2022 to be out. She was very polite and apologized for calling. I right away sent her a copy of the email where ***** said that I had until July 15th to move and that she was pro-rating the rent. She said that was fine, ***** just had not passed **** information on to her. (see attached text) ***** mentioned as well about my not mentioning looking for another rental or wanting to stay in ********. By then I had already sold all my furniture, was on every waiting list for subsidized housing there was. If I could have stayed close to my grandchildren I would have jumped at the chance. But it was too late. My brother in Ok had already started construction on an addition for my daughter and I. Things have worked out for us, but not without going through a lot of stress, expense and heartache. ***** mentioned that I had not been in to pay the pro-rated rent, nor have I contacted the office to schedule the final walk thru. That doesn't surprise me. She failed to communicate with her office about her extending my move out date to July 15th, and I just assume that *** has failed to communicate with ***** my communication with her on Sunday 7/3/2022 about my being out of town, making my first trip to ********, moving my belongs, and that I would not be back in town before the 8th, and that I would be in to pay the rent or would pay it electronically. She responded "Okay sounds good thank you. And she also said that she would be contacting me to schedule the last walk thru, not expecting me to contact her.(see attachment). It is now the 6th. Due to the trip and moving taking it's toll on me, due to my health issues, I will not be making the trip back to ********. My son will be paying the rent for me before loading the last of my belongings and bringing them to me. I had not given an official move notice until June 15th. I understand that the norm is having people move and be out by the 1st of the month, but the situation ***** put me in was by no means the norm. I am dependent on my son and my brothers to help me move, and I truly believe I deserve that after what I have had to go through. The recording of the last walk through she states how I have always been a great tenant, contrary to what she has said to you. Reading the lies in her response, just makes it even harder for me to believe anything she has said. Her apologies don't mean anything because her lies proves there was nothing sincere about them. I just couldn't see letting it slide. She should not be allowed to do this to people. Who knows who she has cheated and mistreated in the past or who she will abuse and mistreat in the future. I had signed a year extension of my lease that the owner had also signed. She deceitfully and intentionally tried to get me to believe otherwise and tried to trick my son into signing a month to month, which she had no right to do because the lease was in my name, not his. Is this behavioral that should be tolerated? I don't think so. Business Response /* (4000, 12, 2022/07/07) */ Per all of the emails that I have provided from the owner I apologize to Ms ****** but I was very forthcoming when the owner told me his plans changed,,, I gave her her options just like I gave him his. To protect her I told her as soon as the owner told me to give her notice I did. Even though her lease was up June 30 the owner still has the right to sell the property if he wanted to. But lol I cannot stop an owner from selling. I did tell her market is very good and owner could sale to another investor or homebuyer. Either way I have to let her know these things because people will come to the house as soon as I post it for sale. It is chaotic market and def stressful for sure. Again Despite her age and situation or time of year for that matter. I try to be upfront and honest with all of my clients and let them know as soon as I know something that way there will not be any surprises for them when the time comes however this seem to have backfired on me. I was very honest. Very upfront even if the devastating news I had to give to her less not what she wanted to hear. Her son did pay the rent for her however I always try to contact her because she is in lease,,,even her son James stated she won't answer for you in a previous text that I uploaded. I understand that the move was causing her stress but again the stress and nature of renting is and always will be stressful situation not knowing what the owner is going to do. I did tell her that it was going to be for sale she had every right to stay and purchase it. Per the emails the timeline worked out so perfectly that the owner said he didn't want to sell it at the same time that she was already planning her move to ******** again I cannot do anything about time frames or when the owner tells me his plans. She had already told me that she was moving and the big addition was coming along, my girl was there when she said she was moving with her son and grandbabies. So when the owner told me that he wanted to rent it I didn't even think twice about asking Ms ****** to stay she had made it very clear she was moving! Nothing left for us here she stated. She also was polite but then in text and emails that she was very upset with me and my office,, hated how we had treated her. Her son did pay her rent every month but he still was not legally On the lease for me to discuss anything with him. I told him exactly what the owner told me to tell his mother. I again can apologize but Timing had nothing to do with my company or me. As far as her proration of rent,,, yes every employee in my office gets my emails, in the office but ***'s job is not finding out when tenants move out,, ***'s title is the account manager,, she told me this morning that she did not talk to Ms ****** at all however my assistant ******* said that she had talk to her because originally we go by the LEASE and it says plain as day lease ends June 30th 2022. We don't have to give official notice she had already gave it to us in may but the docs state she had her out on June 30th 2022. That's WHEN HER Lease legally ended,, I had changed it in the computer for Ms ****** way before she made this complaint to the 15th and told her she could pay her proration of rent online, for the 15 days and NOT be late. She then told my assistant she would be back in 8th to get last load. Well per lease that still makes rent late! After the 5th there is $** late fee. This is nothing new, pre printed in the lease and has been like that the entire lease. Nothing changed because she's moving to ********. She has and obviously is staying till 15th period after owner and new tenant agreed. I do not lie nor A deceitful person. I would not do that to my tenant at all but if the owner did tell me to disclose something I definitely will. I have also been in business for almost ** years I've never had a complaint not one. I understand situations in circumstance suck sometimes but I follow my lease and the law
