Do NOT use this company. They will take your money to fund another project and then will give you excuse after excuse as to why they cannot make the appointment. THEN, once you finally have had enough and ask for the deposit back, well, they don't have the money. Tim has yet to honor a single agreement made to our community. He is a liar and a crook. Again, DO NOT USE!!

I understand your review I have reached an agreement with your Hoa and intend on figuring it. Please understand I had a lot of materials already purchased for job and during this time I could not just” come up with full fund” as buisiness has slowed during rescission. I could not build water feature to original plans, and we could not come to a alternate agreement. Certain information was not known or disclosed about area where water feature was going. But I am refunding fully as new agreement. I understand your a board member and Anouther has already posted on here. So I’ll respond as such.

Tim sent 3 young boys. 1 worked & 2 goofed off. Broke slate to waterfall. Tim said he would replace 3 weeks ago has not done so & have not heard from him. They were to fix a waterfall & did not. Charged my 88 year old handicap mother $900 & the pond was still very dirty. This is what she looks at everyday. There website says they are a Christian family. Sounds more like a theif

It’s very hard to clean a pond when mother wants 50% of bottom of pond is mud and Lilly roots that she wanted to stay. We cleaned pond to spotless then added water and dirt in Lillie’s was stirred up. I explained this to mother before we followed orders to leave Lillie’s. And yes someone probably got it cleaner 10 years prior to us coming Lillie’s we’re most likely in pots or not as overgrown.

Tim ****** was paid $9,300 towards a $14k project. Business owner (Tim ******) took payment in October 2021 and advised the project (community entrance water fountain) would be complete at the end of November 2021. After several excuses given from Oct 2021-June 2022, the project has gone no further than a liner being installed for the fountain. Tim ******, the owner, stated that he did not have the $9300 to return the deposit. He requested a payment plan to pay the money back, offered to install a smaller, cheaper fountain, and offered lake management services until the balance was repaid. He also offered a discount if we allowed him more time to complete the project. The “recession” and “materials” were the excuse as to why the $9,301.50 is now gone and cannot be repaid. Stay away from this contractor.

Tim. You defaulted on the very first day of the agreement that was made; and of course, you gave another excuse. You hadn’t purchased any materials besides a few rocks. We know this because you never brought them, nor did you provide proof of those purchases. For 8 months you were not honest about anything in regards to this project. You also stole the items from the property that we had already paid for, and left the site an absolute mess. You can’t purchase items for a job with someone’s money, and then run off with those items when you decide you don’t want to do the job any more. You do understand that you can’t take $9,300 from someone and just say, “sorry, I don’t have the money to pay you back”, right? Your “recession” excuse is laughable, yet quite insulting that you think we don’t know how business dealings work. We are all business professionals here. You were given the money up front, so your excuse of the recession is moot. The certain information that was “not known” or “disclosed” about the job site was what? That there was concrete below the soil? Weird how we also debunked that excuse by bringing in a backhoe and low and behold….dirt. You had to dig a tad deeper than 3 feet, Tim. Regardless if I am a board member or not, your stole 9 grand from this community in which I am a member of. Your word means nothing, and your actions have proven such. You were given many many opportunities to plead a case for yourself, yet you continued lying and ghosting. Please see the Indiana Criminal Code citation below in regards to theft in the state of Indiana: Under Indiana law, a person commits theft by knowingly or intentionally "exerting unauthorized control" over another's property, with the intent to deprive the other person of the value or use of the property. (Ind. Code Ann. § 35-43-4-2 (2020).) What does it mean to "exert unauthorized control" over someone's property? According to Indiana law, unauthorized control includes taking, obtaining, concealing, or transferring property: without the property owner's consent by creating a false impression or making false promises by threatening to damage the property or injure the rights of another (sometimes called extortion or blackmail) in a manner the property owner did not consent to (such as embezzlement or misappropriation), or while failing to disclose a legal impediment that impacts the ability to use the property as intended. The term "property" is also much broader than it appears. Indiana defines property as "anything of value" and includes real or personal property; money; labor; services; trade secrets; extension of credit; contract rights; public utilities (electricity, gas, oil, water); captured or domesticated animals, birds, and fish; human remains; and data. (Ind. Code Ann. §§ 35-31.5-2-253; 35-43-4-1 (2020).) Level 6 Felony Theft A person commits a level 6 felony by doing any of the following: stealing property valued at $750 or more but less than $50,000 A conviction for a class 6 felony includes a fixed term of six months to two and a half years' incarceration (with an advisory sentence of one year) and a fine up to $10,000. You can find all of this information via www.in.gov if you’d like to research a little more.
