    Purchased a used vehicle from this dealer. Written on the bill of sale is guaranteed to pass inspection. There was no discussion about a time frame of the vehicle getting inspected. When i got the car registered, the registration stated i had 3 weeks to get the car inspected. After bringing to mechanic and seeing what needed to be done for the inspection, i contacted the dealer and he advised us to bring the car to him in a couple days and his mechanic would look at it. The following morning after i dropped the car off, he messaged me and told me he is not obligated to fix anything with the car because it was brought to be inspected more than 7 days after it was registered. He never had this discussion with me. Never received a buyers guide from him. It clearly states guaranteed to pass inspection on the bill of sale and there is no time frame written on the bill of sale. I feel he owes me the $500 i had to spend in order for this car to pass inspection. Fast forward 2 weeks later and the cars engine seized. This dealer is impossible to talk to so i had to turn to this complaint.

    To Whom this may concern,
    The Vehicle of Ours, a 2013 Kia ****** with VIN ( ***************** ) was sold on 2/9/23 to this customer. As a dealer, we are legally obligated to follow our State Lemon law rules to protect us and the buyer. At the time, our hand written Sale agreement stated the car is guaranteed to pass state inspection, along with a third party warranty we put for the customer to cover 90 days of motor and transmission if something catastrophic were to happen, as long as the car is inspected and passed within the lemon law timeframe. All Sale agreements and contracts were signed and handed to customers. Vehicle had  135,946 as stated on the date of Purchase Bill of sale prior to her taking delivery of the vehicle. After Customer took delivery of the vehicle, the customer stated the car had certain issues, and we informed the customer to come back for us to address them before inspection. The service that was done is attached below with invoicing proof of the issues at the time that the vehicle had that we repaired for the customer. 
    After the vehicle was serviced and picked up by the customer, the customer then informed us the car's Check engine light had returned relating to a sensor and that another repair facility sensor said the car needed miscellaneous maintenance items such as fluid flushed and Brakes on the date of 3/18/23  ( estimate for that is attached below ) and was asking us to be responsible for it, so we informed the customer to bring it to us for us to take a look at the vehicle. We then noticed this car was driven over x miles and over a months time with the vehicle never going to an inspection sticker station, so we informed the customer there wasn't much we can take care of at this point considering the vehicle was well over the lemon law time period of us having to take care of the issues considering the car was driven over x miles and weeks with no proof of the car passing or failing inspection within the 7 day MA Lemon law time period. Customer had then picked up the car after we could not take care of the vehicle's problems, and hadn't really contacted us informing about the engine seizure, or had sent any proof of that happening to the vehicle after the fact. So where we stand at this point after this response, is customer is able to take their legal action if they wanted to moving forward to come to a solution of this matter, as we did what we could in the early moments of the sale agreement and have not had an issue like this before, as we were respectful and responsive during the entire process and never ignored the customer.

    I am rejecting this response because:

    I was NEVER informed that inspection supposedly needed to be done within 7 days after registration. This business keeps mentioning lemon law however lemon law doesnt come into play when the car has over 120,000 miles. I am not looking to get refunded for the car yet looking to be reimbursed for the $500 i had to spend in order to get the car to pass inspection. Communication was terrible. It clearly states on the bill of sale guaranteed to pass inspection. No where on that bill of sale does it state a timeframe.

    Hello, yes we understand that at the time we closed the deal, paper work did not state the 7 days and etc., and Lemon Law and State MA  Used car dealer laws are still in affect regardless, so at the time we did not state on the paper 7 days, but at the closing date of sale, everything was translated to customer. We are a little confused as to why customer is requesting only the $500 refunded to customer since that's what was needed to pass Inspection, but in the complaint customer stated the engine had seized, so we are a little confused on the exact story that happened after the customer had spent an alleged amount of $500 to another repair shop.

    Unfortunately, for what the customer is requesting, due to the amount of miles and weeks the car was driven after the 7 days, we are requesting the customer to please contact a lawyer or small claims so we can happily move forward and have proper Lawyers and court resolve the issue on the customers behalf of the refund request and to leave it in there hands, as we are being responsive at this moment, and would like the customer to please move forward that way.

    I am rejecting this response because:

    As this business stated, they didnt give me any notice when I purchased the vehicle that the inspection needed to be done within 7 days of the car being registered. Had I been notified of this, I would have done just that. I was simply going off of what my state told me and what was written on the registration was by 3/23 it needed an inspection sticker. As far as why I am not asking for the engine to be replaced by you is a simple answer. Your mechanic told you he did brakes all around yet he only did the front brakes and not the back. I dont trust this company or anyone tied to this company. KIA is taking care of the engine because this cars year and model had engine issues so its being replaced at no cost. Thats how you treat your customers when there is an issue!
