customer dropped off truck to get a ,misfire figured out with is own diagnostic he said it was a valve which in fact it was not. once the head was pulled we found cracked pistons which the customer was aware off. we told him the motor needed pulled and rebuilt or a new crate engine he was given those options and optioned for a rebuild which was quoted for anywhere between 2-3 months and multiple times of constantly saying it wasn't a rush and he understood machine shops take time. when he optioned for the rebuild I made him aware that was going to need money down to cover parts etc which after a week or two he did. machine work takes time and that is where our time frame extended. I was calling and taling to him because it is hard to text while covered in oils and grease and working on vehicle so yes some texts didn't have answers. he was showing Saturdays and almost always on Sunday both of which we are closed. also if I didn't answer a phone call the very moment he would call he would flip out about and accuse me of ignoring him. he told me if the motor was not finished at the machine shop on a Friday tell them to keep it he didn't want it and that is what I did now he's requesting a refund on a motor that I do now have and am stuck with for he had it rebuilt with custom upgrades. I will not put a motor that he requested he did not want anymore in. I told him I have no problem refunding the motor once I am able to sell it due to not working with a big capital for being a fairly new company. now he also requested to put it all back together the way it was and I made him aware that would be more money to put together for the invoicing was only for removal and motor rebuild, he refuses to agree to that saying I pulled it all apart with out his consent which is untrue, every time I talk to him its something different its either put the truck together or worry about the refund first or both right now or he just gonna take it how it is or flat out just blaming me for his finical hardship. I will not put a bad motor back together with the new gaskets it's going to require and many labor hrs for free when he optioned on a rebuild that knew was going to take time. and also when he agreed to tear it out and apart to have rebuilt. I even supplied a free block to him being his original engine block was to far gone. I also had a conversation with him that he either needs to agree to pay the labor to put it back together which will come off the refund which would be $1800 for gaskets and re assembly to have the truck just as it was. he also has $2000 towards the diagnostics and disassemble and tear down of old motor out of the truck. I told him if he didn't want to pay that it was fine but then he needed to pick up the truck by that Friday which was a week advance notice that Friday being oct 6 2023 via phone call. I made him aware everyday after 5pm of that date it would have storage added to it being he can't make his mind up. he changes his mind on which route and what he wants everyday day. I can't work off of 9-10 different things he wants to change constantly. he was told I would get the refund to him as soon as the motor was sold so I wasn't a hardship he said that was fine and now this the constant slander to my business and not to mention the multiple threats he has made to me over the phone which have several witness to all of this. not to mention he knew my business hrs and close dates so the harassment over the Saturday and Sundays which is not ok at all. so be I have made mistakes my business is not to blame the constant mind changing and threats and harassments have a huge Impact on how things are done and dealt with from there the personal stress and fear from the threats he has made has caused a huge problem for me and my pregnant gf

The in the response to the letter above/email.I ******** ******* disagree with the written statements in regards to his false statements and regarding the repairs to my truck. He have been very inconsistent in communication with repairing my truck and or refuse to work/ service me on the assignment that was paid for. I never requested to have a diagnostic test done. I’m not sure why am I getting charged for that service that wasn’t recommended. He stated that he would sell the motor to give me a full refund in the amount of $7,300 my issue is that when I place my truck in his shop for services it was a functional vehicle, it appears that he was under the influence of drugs based upon his slurred words and body language and his inconsistent story. I will like for my truck to be repaired or my truck to running and a full refund of payment. I’m a certified mechanic and most statements are fabricated about the cost and treats.

so now I have been more then slandered and accused of drug use one of which I do not and never have done I will be reaching out to my lawyer now at this point because mr ******* is requesting a free ride on everything, after the tera down and start or repairs is already done. most of the information I need to prove this has been on phone conversations with mr *******. luckily enough for me I have always had a witness to most every conversation. when truck was dropped off he knew it was going to be diagnosed. so the unawareness he is claiming is not true. mr ******* has made multiple threats to me over phone call and also has harassed me many of times while we are closed with just showing up on days we are closed and days of which he very much so knew. this is coming down to he wants everything done for free and Also knows in order to put the original motor in and done it will require purchase of certain gaskets and parts of which can not be re used and also one it leaves not running right he will accuse me of blowing up his motor of which I did not do. mr ******* is also claiming he had a perfectly fine running truck which he contradicts on himself by if it were in deed running fine then why was it going into the shop? I can answer that the truck blew a hole in the piston. truck was misfiring and barley running when it was dropped of also smoking like crazy. another question I would like to state if mr ******* is a certified mechanic why isn't he fixing his own truck. but instead I am being slandered with accusations of drug user, liar, and thief, I will contact my lawyer and at this point being I have more then enough to file a suit of slander with false accusations and threats for the safety of mine and my pregnant at the time gf. I want to thank the BBB for attempting to resolve this issue but this is a revolving door mr ******* was in no rush when vehicle was dropped and understood everything we talked about even told me he would start sending 1k a week so there was no hold up on his end which he never complied to in some cases I can work past a deposit but in cases of several thousand I can't work past deposits due to fund availability with a new business and mr ******* was aware of this so instead of resolution mr ******* is only after one thing and that would be to take advantage of someone by trying to get free work and labor for a truck he blew up. sounds like a scam in my opinion. also two last things I have a slight speech impediment and have been under tremendous stress with a baby on the way so it has been amplified so appreciate being made fun of for that and the second being this truck was never fully paid for mr ******* had zero intensions of paying the remainder for when the vehicle was done therefore when I caught on now im the bad guy

    Complaint: ********

I am rejecting this response because:

I have never made threats to him or his spouse. I have never met/seen his spouse. I’m not sure why he’s trying to make this consistent factor. Mr. H****** is deflecting from what the facts are by bringing up topics that are not relevant to business such as his alleged disabilities, I’ve (never made a mockery of him). I have supporting documents that shows I have paid Mr. H****** via ***** and by cash per his request to submit a deposit and to pay the remaining after the job was done. However, I paid prior to the job being completed to speed up the process. The problem is the work was never completed. Mr. H****** stated on multiple occasions that the job was completed (by placing the new motor into the truck) me, stating that I am a certified mechanic, basically indicating that I am aware of mechanical malfunctions. I wasn’t able to fix/work on my own truck due to not having spare time and work. How can I scam? if the invoice amount was 8,200 to complete the job. I have a total transaction of 7,300 leaving a remaining balance 900 dollars that I obviously don’t have a problem paying when the work is done. My problem has remained the same to complete the job or refund my money for incomplete work, again I drove my truck to his shop meaning it was functional. I won’t except picking up the truck with no motor in it.

    Sincerely,

    ******** *******

On January 2, 2023, I and a friend name ****** hired Dakota to repair my truck and ****** purchased parts only. I had given him 1725 dollars for parts and 800 for labor. We agreed that the work would be done the following week, along with delivery of my friends parts as well. Dakota had held my truck for over 4 weeks, and only did a portion of the work. He still has a part that was priced approximately 800 dollars. ****** had given him 1210 dollars for parts. We still are unable to get our parts, plus the installation of my part that I've already paid for. He keeps making excuses and most of the time avoids our calls. We're going to file in small claims court soon.
