in May of 2022 I sign a contract with Bay Display to have an advertisement for one year at a local gym.the cost for the year was 358.00. for almost the past 2 years they have taken out that amount every month for a total of 5,728.00. I also did not renew my contract when it expired in may 2023 i have sent numerous emails and left messages and no one will respond to my request to be reimbursed for money that was wrongfully taken from my account.

    Complaint: ********

I am rejecting this response because: they still owe me money and they are not even attempting to pay the money that they stole from my bank account. I was only refunded those two payments is because I made a complaint with my credit card company and they refunded it, bay display did not refund it

    Sincerely,

    ******** ******

In March of 2023, we agreed to a contract to advertise with Bay Display for Clustered Spires Golf Course in Frederick, MD. We were charged $458 on 3/29/23 and told in the contract and in the email that the fee is to cover an entire year. We were then charged $458 twice more (once on 4/30/23 and again on 6/2/23), for a total of 3 charges. After the charge on 4/30, I reached out understanding that mistakes are made, and asked for a refund. I received a response that it would be taken care of. Then we noticed a second overcharge on 6/2. Again, I reached out asking for the refund of 2 overcharges. As in the past, I was told that it would be taken care of. I have now called multiple times and sent a last effort email trying to get a refund for the $916, with no avail. She has not responded to my email, or returned any of my phone calls.

Except for "she has not responded to my email, or returned any of my phone calls.," this statement is correct.

    Business response

    Yes.  Yes.

    Customer response

The owner of the business has not addressed how the issue will be resolved and how my money will be refunded. She seemingly has only agreed with the statement of "yes yes" that she has not refunded me. She has not stated whether she intends to refund the money, when, or how. I would like to get the $916 back that I'm due as these were fraudulent charges. From reading other posters on here, it seems as if this is a common thread with her, and I am due my refund. I have attached details to show the signed contract along with a screenshot of the 3 charges, with no corresponding refund.

    09/26/2023

I did respond on September 7th.  Again......except for "she has not responded to my email, or returned any of my phone calls.," this statement is correct.

Donna **** reached out to me in February 2022 to be apart of the advertising display at Benfield Sports Center for $558.00 for the entire year. After my art was approved I was told that my year would start in March 2022, where I have been charged now $558 every single month. I called and emailed Donna and she doesnt ever answer the phone. She emailed back in September saying she'll take care of it. I have followed up with emails and phone calls to see how I am going to be refunded the additional months and she will not return my calls or answer my emails.

Business Response /* (1000, 5, 2022/11/06) */ For the most part, she is correct in her statement. Consumer Response /* (2000, 7, 2022/11/09) */ (The consumer indicated he/she ACCEPTED the response from the business.) I am still looking to see how Donna is going to refund me the additional money

The company I work for was approached in person by the ***** **** from Bay Display to discuss onsite advertising at the Benfield Sports Center in our area. After back and forth email communications, myself and the other office manager agreed to give it a trial for one year at a fixed rate of $558 per year. I have email documentation of this along with the contract, provided by *****. After she got the final ad design put together and I gave approval which I was told would be the start of our contract. I gave my approval of the final ad via email on March 1, 2022. Again, the contract is for $558 per YEAR. Bay Display charged our card $558 EVERY MONTH. Our CFO reached out to her to request a refund and she was very short, just responding "I'll take care of it" on July 1, 2022. Repeat follow up emails have been sent to her along with attempts to reach her by phone and have yet to get the charges refunded or any further response from her.

Business Response /* (1000, 11, 2022/08/25) */ ***Document Attached*** I spoke with Serigne Fall from BBB when he called me. The statement that there has been no response is false. Screenshot of phone call attached. As I told Mr. Fall, the customer has been given a credit. Consumer Response /* (3000, 13, 2022/08/25) */ (The consumer indicated he/she DID NOT accept the response from the business.) Based off of the screen shot to "prove" you have not responded to us, your screen shot doesn't prove anything. There are no phone calls within that screen shot associated with our practice or staff within our practice. So as previously stated, NO you haven't responded to our requests. I am happy to provide the various emails we have sent you from both myself and our CFO where you haven't responded at all. Business Response /* (4000, 15, 2022/09/08) */ I don't understand the complaint. She asked for a credit/refund and that is what she got. Consumer Response /* (4200, 17, 2022/09/09) */ (The consumer indicated he/she DID NOT accept the response from the business.) No we did not get a credit back on our card from you, I am more than happy to get something in writing from American Express to show that we were charged & no credit has been processed back onto the card/account. Not sure how you don't understand that. Business Response /* (4000, 19, 2022/09/16) */ Attached are the documents showing the refund. You need to use them to file a BBB complaint against her bank. The money has been deducted from account.
