    We currently lease a 1000 gallon underground propane tank that is buried on our property. We entered into this lease when we built our home in 2013. Since that time we have been trying to purchase the tank that we are leasing so that we could have the option to shop around for the best rate on propane. The initial lease had a buyout option. When we went to exercise the buyout option we realized that before the initial lease expired they re-wrote the lease and took out all options for buyout. We thought we were simply signing our yearly lock-in rate renewal in 2017 when, in fact, they re-wrote the entire lease to eliminate the buyout option during the lease period. Interesting that they re-wrote the lease one full year before the initial lease period ended. On numerous occasions from 2017 to date we were told that (and have emails) that 30 days before the lease expires, in Nov 2022, we needed to notify them in writing that we were not renewing the lease & we were given the purchase price at the prorated amount for a 9+ year old tank. We were even given the amount that that price would go down for every year past year 9. We provided Matheson gas with written notification that we did not intend to renew the lease & that we were asking for an invoice for the prorated purchase amount. We are now told that "the proposal for selling of the tank has expired. Matheson has no desire to sell the tank" and "alot has changed in the world, so we have zero interest in selling the tank at this time". Despite being told that in November of 2022 this transaction would take place we are now left with minimal time to find a new provider who can do the installation AND Matheson says we are responsible for paying for the removal of the tank they have buried on our property but refuse to sell to us.
