Recently sold my house and 8:05 North Marlin Avenue in Essex. The company had some people that they hired to remove the remaining stuff out of the house they did let me come over to the house and get whatever was in the Attic but during that time frame I did not have enough room to get everything so I requested that if they could hold on to it until Halloween weekend 2022 that I would be there during that time frame to remove the remaining stuff from the property and a freezer washer and dryer and they said they would hold on to it. But when I came down during Halloween weekend to get the items from the attic and the remaining stuff like that washer dryer and freezer they told me that the people they hired to remove the stuff put it in the backyard and that they think that the county took it but they said that they would hold on to it and keep it safe until I got down and they did not they put it in the backyard where everybody could steal it or take it. I proceeded to ask the people that I have been dealing with from their company and they said there is nothing they can do because it was outside apparently two weeks prior to me coming down on Halloween weekend and the only thing I'm requesting is if it's possible to get reimbursed for the washer the freezer and the dryer because they put it out where anybody could steal it and they told me it was going to stay safe until I came down I have text messages stating that they were going to hold on to it and it was going to be safe until Halloween weekend and they did not keep their end of the deal. I have tried to get a hold of the main guy Daniel but still no response back from him at all about this and they're telling me there's nothing they can do about it I am just requesting if anything $2,000 for the loss of the washer dryer and freezer and let the rest of it go.

    Business response

    12/09/2022

Business Response /* (1000, 5, 2022/11/08) */ Jacqueline we at HK Equity Group apologize for the confusion with your personal items. In our contract it states that the property was being purchased as is with all fixtures included, however, if the seller chooses, they may take the washer, dryer, and freezer as well as any personal items that are located in the property. We agreed to meet on 9/25/22 at 11:30am and we brought and paid for three people to help you move ALL your personal items, but as you stated above you were not prepared with a box truck as you said you would be. Closing was set for 10/10/22, however, it had to be pushed back to 10/14/22 as the tenants were not out of the property yet and one stipulation in the contract must be delivered vacant. The contract was signed on 9/14/22 giving the seller's a month to remove these items. Lastly, we have all the texts, emails, and pictures of the items being placed outside underneath the carport just as we stated they would be post-closing. Unfortunately, we do not have a warehouse where we can store items for all the sellers we work with for free. At HK we pride ourselves on helping sellers with a smooth transaction from start to finish and we 100% believe we upheld that throughout this process. Consumer Response /* (3000, 7, 2022/11/08) */ (The consumer indicated he/she DID NOT accept the response from the business.) They told me that they would hold on to the items including the washer, dryer and freezer until Halloween weekend of 2022. I never said I was going to have a box truck. If they weren't able to hold onto them like they agreed to I would have tried to make other plans, the people that were placing my items could have placed them in a safe place that was not where everyone around the neighborhood could see and I was told over and over again that the items including the washer dryer and freezer were not going to be outside until the Halloween weekend of 2022 and they were out side apparently a week to two weeks prior to that weekend. I was unaware that they put it out so early or I would have arranged for someone to come pick it up since I'm out of state. And I have tried to talk to Daniel by email text message and phone call and no response back. I did understand that if it was not out by Halloween weekend that they would not keep a hold of it but I was there on Halloween weekend by the time frame that I was told which was 10:30 but I was there a little after because they said anytime after 10:30 I could pick it up and it would be in the carport but unfortunately it was not there they'd already apparently weeks beforehand put it out there for everyone to see and did not tell me anything about that. I'm like before I have text messages stating all this information and showing what the property look like when I pulled up that day. So I'm only wanting $2,000 to cover the washer dryer and freezer.
