    5-7-24 - Deposit of $4914 was given to Peke (Ryan B****) contract signed section (3b) stipulated from the time of deposit (installation start time would be 2-4 months). 8-7-24 - Documentation received from Peak indicated they needed approval from our HOA for our door installation in order for them to place the order. We communicated to Peak on 3 occasions that our HOA didn't have any specific guidelines that pertain to entry door replacement. We expected our entry door replacement to have been completed mid August 24, With our order not started as of 8-7-24, the installation would be approximately Sept or beyond. 8-19-24 We received an email from Ryan B**** indicating that his boss (Jonathan S********) had attempted to contact us via voicemail. There is no evidence that he did.

    The customer and I spoke for 45 minutes today and I did everything I could to come up with a middle ground and mutual solution that doesn’t involve them breaching their contract and/or being taken to court nor me giving the deposit back for a job that I have no legal obligation to do so. We did not come up with a resolution but I suggested the best one I could come up with. They were very resistant to finding middle ground. I’m sending them something to review in writing in the next few days. If they agree then this can be closed out as we would be proceeding with the project. If they say no I’ll have no choice but to enforce the liquidated damages clause in our contract for contract breach. I can upload the document once it’s been created and sent.

    Yes I uploaded the details June the 7th I meet with the representative of Peak Remodeling Ryan B****. He measure and talk about lots of option and pricing and the company and other companies charge more and aren't as good. Three prices other companies and it matched with the regular stucco price I gave him. He had me signing one contract and then I guess the other contract we have currently. He was suppose to be telling me what I was supposedly signing. This contract he never told me I would be responsible if I didn't qualify for funding. I didn't have to accept the deal we were just checking to see if the funding was available but I didn't have to accept it if I didn't like the terms, was my understanding of Mr. Ryan B****s explanation. He at one point said he might lose his job if he didn't get this one! Maybe he should. Please help

    This customer contracted with us for a siding project on 6/7/24. He also filled out a credit application as he would be paying for it via financing. He was not approved for the full contract amount with the lender so we reached out to discuss either revising the scope or working with him as much as possible to do the project for the max approval amount from the lender. We ended up offering a price reduction to help the customer get the contracted work performed, with no change in scope. This would allow the customer to get the project completed as contracted for approximately $13,000 less than he had already agreed to. The customer since then has stopped responding to all communication with our team. As the contract was never cancelled in rescission (or at all) and the customer is preventing us from proceeding by not signing required documents or returning phone calls or messages, we have since pursued the matter as a breach of contract situation. We would happily proceed as contracted for the exact contractually agreed upon scope, send an addendum to be signed reducing the contract amount, and have the lender re-send the loan documents. Once all necessary documents are signed we would be able to measure and order the job.

    I am rejecting this response because:
    They solicited my business initially.  it was explained to me, we were just trying "to see if I qualify for the 12.9% "or better!  Well his reduction in price and raising the interest rate is more expensive in the long run.  This will also prevent me from qualifying me for another loan to finish the house.  I have too much debt now to take on any more debt until some is paid down.  Especially at 15.9%  Can i see the other contract that i signed as well and the three prices we talked about?  He solicited my business I never called them initially, do have any work for them.   He is trying to bankrupt me He said he spend 3.5 hours with me if that what is takes to do an estimate ok but to pay him $20,000 for 3.5 hours and get nothing out of it is not what I can do.  Where's the other contract I was signing for along time before this contract came about.  If he reduced the price to what was being financed why is he charging me % for the higher amount?  If he explained to me no matter what happens with financing you will be responsible for paying for this!  I never would of signed it.  I haven't gotten a pay check all year and explained that to Mr B**** say to myself I probably shouldn't have said that.  But it didn't phase Mr B**** cause he said lets just see if your qualify.  So I didn't and I thought that would be the end of it as was explained to me at the time.  If I can get Some good financing But with my credit score and owing $300k already in credit cards it not going to happen.  I am sorry for that the practices of the Peak company doesn't spell out that this is something you will be responsible for no matter if we get you financing you like or not!  I feel I was scammed by the sales practices.  If I don't qualify for a loan how can I do the job? I gotten no pay check from the first of the year what bank will loan money to someone who wasn't getting paid?  Their are more bills coming in in September and it is not advised for me to take on any more debt at this time.  If a lender knows your not getting a pay check and they find a loan for you anyhow, isn't that preditory lending?   I need to get my funding in order and have the rates come down before I move forward on anything.  Once that is achieved I will think of the siding but need 7-8% not 15.9% loan.

    I hired Peak Custom Remodeling to replace my roof. They damaged my stone veneer siding from putting all their shingles on one side of my house on a Friday the week before installation. Nearly all the weight of all the house's shingles was put on one peak of my house. This caused cracks in my mortar and stone veneer. Howard W*** of Peak Custom Remodeling acknowledged that they were at fault and said they would take care of it. He asked if I had a stone guy which I did. He said to send him the bill. When I sent him a bill for $3,600, he replied: "I'm sorry to say that the owners have told me that they will not pay this invoice." This was a job that was over $30,000. This company damages your property and does not stand behind their word. Howard literally admitted fault and said they would cover it.
