    In March 2022, I paid the business a $3500 down payment for exterior painting which he insisted I needed to get to him by the end of the month to secure a spot on his schedule. After blowing through two promised dates, he blamed weather, a heart attack and employee problems and promised he would get to the job before the end of October or he would give me my deposit back. In the meantime, he did complete some interior painting, but only after I threatened to take him to small claims court.In March 2023, I contacted him to see when I would get on his schedule. He informed me that he no longer did exterior painting and would be refunding me my deposit. He never did.After not hearing from him for several months, I contacted him. First his wife responded and said he was in the hospital, but later he responded, berated me for contacting his wife (despite her initiating the conversation), and told me he would pay us with the next payroll. When that date came and I heard nothing, I contacted him again. He told us he'd "never had to give someone a refund" and didn't know how to issue the check. Another month passed. When I contacted him again, he offered a payment plan but never gave me any details on the payment plan.As of December 2023, we still have not received a refund. Meanwhile, on social media he bragging about upgrading his truck, buying a restaurant, and going on vacations (including one that aligns with a period he claimed to be hospitalized). I've never experienced anything like this, but asking around town, it sounds like he does this to a third of his customers. It's a shame, because he does nice work when he actually does the work, but this is not an honest business.

    I will send ******* check on 12/28/23 and the balance of ******* on 1/12/24, we indeed had an agreement and *************** said he was going to have something drafted up that I would need to sign for an arrangement, after some time he saw through social media that things in my life have taking a turn for the better and asked if we could surpass the initial refund payment plan. I hope this is satisfactory for the Kellys

    I have reviewed the response submitted by the business and have determined that the response does not satisfy or resolve my issues and/or concerns in reference to complaint # ********

    It is the responsibility of the business that has not completed the service to return the deposit in full. Deflecting or blaming the client for this delay is not professional, nor does it negate the responsibility of the business to return the deposit.

    Previously the business owner has promised that the check is in the mail, or given specific dates or time frames the money will be returned, but none of these deadlines or promises have been met. This back and forth has been going on for over a year. At this time, I am unwilling to close this complaint until the deposit has been returned in full.

     Businesses and Customers should be civil, courteous and polite in their responses to complaints. It is important to remain professional and productive when participating in the BBB complaint process.

    Paid 50% down payment via check June 23 2022 for exterior house painting job. $4,00 check cashed June 23 2022 with a promise to paint summer of 2022. *******, ******************************* reportedly had a heart attack and has promised to paint *** of 2023. He has not been very responsive and now says it won't be until June or July. He said he would refund me (emails and contract attached), but now that I have asked for a refund he will not. I want $4,000 plus interest from June 2023 refunded immediately. This is theft, and I will file criminal charges if not refunded.

    I understand this customers frustration, not only did I have heart surgery in 2022 , we also had a lot of rain that caused ** to fall behind , like most companies we had a hard time finding help as well! I communicated with her and agreed to do the job in June, I met with this customer last week and discovered heavy amounts of lead on her dwelling and explained that I would need to talk to the town to see what there rules were with lead. Im happy to refund her but she demanded today by 5 pm and Im dealing with a funeral!
