I moved into ******************* which is a new subdivision in ************* in the spring of 2023. This subdivision is governed by an *** and the property management company is Casa Bella Property Management which is located at ************************************************************************. My complaint is about the ***'s failure to enforce rules contained in the *** bylaws. I have made several written and verbal complaints to the *** about homeowners in the subdivision who are allowing their dogs to urinate and defecate on my lawn which is causing damage to my property. It is an expense for me to have patches of lawn replaced because dog urine kills the grass. The *** has ignored my complaints. I also asked for a meeting with the *** board of directors to address this problem and possible solutions but that request was ignored as well.Business response

The association does not have a board of directors of the Co-owners as it's still under the control of the developer-******** Companies. There is no board meeting per say to address the board unless she requests a meeting with the developer. When a board will be elected a notice of election meeting will be mailed to all unit owners.
All co-owners upon closing of their home are provided a copy of the bylaws of the association. When we receive notice of a home sale/closing we include a form that asks if a copy was provided. This means all Co-owners currently owning homes in the association are aware of rules that it's not acceptable to allow a pet to be unleashed or defecate on someone else's property. If ***************** would provide an address to whomever is responsible for this, a letter would be sent. ************** is not gated and outsiders can also walk through the community which makes it impossible to single out a specific person without knowing who they are or where they live. Upon speaking with the assigned manager, no address or additional information has been provided by ***************** for us to follow up on any complaint she has.
Our management responsibilities are to follow the directives of the developer or board and enforce the bylaws of the association, but we need proof and information to do it legally and properly. If ****************** provides information as to who is damaging her property, we will follow through with sending notification to them.

I have sent 2 emails to ******************* who I believe is the manager for this subdivision. I indicated the address of the homeowner who is allowing her 2 large dogs to trespass on my property. I have emails to prove that I did contact ************** and he ignored me. The *** and Casa Bella have no problem with sending out letters and emails to homeowners regarding things they expect homeowners to do. They should at least send out an email or letter regarding this problem. They should also speak with ************** as he will probably not ignore them as he has ignored my emails to him.

If the problem continues, ***************** will be required to notify us again so a follow up letter and violation can be sent.

I just came into my home (May 21 at 7:05 pm) and I observed the homeowner (a young white male) with his two large dogs who were defecating on the lawn. After defecating one of the dogs urinated on the lawn. These homeowners do not make any attempt to steer their dogs to the curb or street to relieve themselves. Whatever letter the *** alleges was sent to these homeowners has done nothing to change their behavior. The *** is not doing anything to stop this behavior from these homeowners. I would like the *** to explain what right these people have to violate others' property.

This so called management company is an association and is not doing their duty that they are paid to do such as enforcing rules on owners that do not take care of their property in Yorke Townhouses in S E ********.Business response

To begin our company is not an association. Casa Bella is a management company hired by ***** of ********* of the association since 2006. **************** is not on the board, yet submits violations on neighbors daily. I do not take directions from ****************, but I'm instructed to enforce the by-laws and answer to the *****. Violations are sent daily to residents, but we're required to follow the protocol of the by-laws. If people don't follow the rules nor comply with the by-laws it then becomes a legal issue, which in turn causes the association money.
**************** expects instant cooperation from whomever he reports a violation on and blames Casa Bella when that doesn't happen.
We do weekly drive through inspections along with maintenance reports on units that need repair, and letters are sent accordingly.
It has also been reported by residents that **************** is parking additional vehicles in the community, and only one space is permitted per unit.
A high volume of residents in the community for which **************** resides do not care to follow the rules and it's a daily challenge to obtain compliance. Casa Bella is not the police department and again, we have to follow the by-laws.
Since Casa Bella does not perform directives from ****************, it is to be expected this complaint is closed since he is not considered our client, yet we continue daily to try our best to enforce the rules of the association.

*************************** ******************************************************************* ************** The Vistas (****** and **********) May 2, 2022 RE: Casa Bella Management Company ************************** Attn: ***************** ************************************************************* Hi ***,This is follow-up to our numerous conversations regarding my garage door. During your inspection you took pictures documenting there was an incline at the top of my driveway close to the garage door. The incline has caused a great deal of rust at the base of the door due the gathering of water, snow, and ice. The rust has also caused a small gap in the corner of my garage door. Please place the results of your inspection of my garage door and driveway in writing. I was initially advised the *********************** instructed you not put anything in writing. If so, please put that in writing. Per our recent conversation, you will be sending an asphalt company to come out and level the pavement in the driveway. Thus, acknowledging there is a problem. However, you will not pay for a new garage door because garage doors are the Homeowners responsibility. My garage door works fine. The problem is the massive amount of rust and the whole at the bottom. This was caused by the uneven and unlevel asphalt. Why would Casa Bella Management or the asphalt company not be responsible for the damage? Again, you have advised you are sending an asphalt company repair the damage. If you hired the company that paved the driveway incorrectly, why would you not be responsible to contact the company and hold them responsible for the subsequent damage to my garage door. I pay my association dues for these exact scenarios. You cannot keep saying the garage door is my responsibility if I did nothing wrong. I am formerly requesting you take responsibility for the cost of my garage door by enforcing your contractual agreement with the asphalt company. I should not be forced to be to get involved.Business response

Good Afternoon,
I dispute ************* claim against Casa Bella Property Management, Inc. We as a management company have no ********* to make any decisions or order any work from any vendor unless specifically authorized by the ***** of ********* of the association.
************** has tried unsuccessfully to explain the protocol and ********* of **** Bella to **************. ********* has been made aware of the problems regarding driveways and is looking into addressing the issues from several vendors ordered to obtain bids by the ***** of *********. Again, **** Bella's only role is to follow through with directives from the ***** of *********.
In addition, the bylaws clearly indicate the garage doors are the responsibility of the Co-owner and will not approve the replacement of the door as the responsibility of the association, even though ************** believes the damage to the door was caused by the angle of the driveway.
I encourage ************** to request a meeting with the ***** to discuss the issue as again, **** Bella has absolutely no ********* to hire vendors, arrange for repairs/maintenance or enter into any contract without prior approval and directive from the ***** of *********.
As a result, I request this complaint removed from my company profile for I cannot be fairly held accountable for something outside the realm of our contractual responsibility.
