    We bought a unique painting along with others at auction on 6-8-24 in ********* ***** put on by Park West Gallery. The painting in question (See Change) was purchased for $4600. When The painting was received. It was not the one that we had purchased. Park west did a bait and switch and sent us another unique painting of the same title from the artist. We sent that painting back and now.Parkwest cannot find the original one we purchased. Then we said we wanted our money back. At the auction, we were told we would get 20% collector's cash for everything we purchased. Which was $5786 collectors cash. We used about $1600 in collector's, cash. Now that we're trying to get our $4600 back for the painting, they're saying the $1600 that was spent from collector cash will be deducted from the $4600. Now ******** is saying that if you have to spend f25,000 to get collectors cash, now we're under that amount with the return of the painting. At the auction $25,000 was never mentioned. We were told it was on all purchases.

    Weren't told about final sale policy. Tried to stop the sale ************************************************************* notes, only to be told they couldn't cancel the order until it gets loaded in there system 10 days later. Within 4 days the order was processed and shipped. Every step of this process was deceptive.

    purchase was made on approximately 11-15-22 artwork -$1000 artwork-$1000 shipping-$600 framing-$400 these are approximate prices art work was delivered by ***** and signed for by a ***** employee (not the resident of the house). the ***** employee forged my signature on all the deliveries. the packages were stolen from the porch before the resident could retrieve them.according to *****, only the sender (PARK WEST) can file a claim on the missing packages i have contacted parkwest (by email) when the deliveries were made to let them know that packages were left at the residence without proper signatures (because i was still working) and i have asked parkwest several times to file a claim with ***** and also have them a different option, which was to give me permission to file a claim on their behalf.Parkwest has refused to do any of the proposed options.Park west checks the tracking number on the packages and they say the delivery was made to the property and they refuse to go any further with the claim.-all the packages that were supposedly delivered needed a "direct signature" from the recipent -all the packages that were supposedly delivered were signed for ILLEGALLY. the driver forged my signature.-the packages that were supposedly delivered were done while I was at work. Nobody else lives at my residence. I am single -i have provided Parkwest with proof that i was working at the time of all deliveries -parkwest is the only one who can initiate the claim not me, and they REFUSE to do so

    Dear **************,

    Park West is in receipt of your letter dated October 17, 2023 and we appreciate the opportunity to respond.

    In February 2023, ******************** informed ********* that he did not receive two pieces of artwork, NAJA Nature's Sanctuary (Promo) (Promo means Promotional no charge to the client for the artwork),(framed)and BELE Moment Bleu (Promo) (framed)) that were delivered by Federal Express to Mr. ********* correct address. Park West replaced those pieces and marked on the Federal Express notification to send them appointment delivery.  ******************** notified Park West that he was not home at this time and Federal Express forged his signature.
    On March 3, 2023, ******************** wanted to know what was going to be done for those pieces that were not promo pieces. (At this time, ******************** only received one piece of artwork). Throughout April and May, the two promo pieces were held at Federal Express.  Federal Express either tried to deliver or reach out to the client to set up appointment or pick up at their fed ex facility. The two promo pieces went back and forth between Park West, Federal Express and ********************. During March and April of 2023, ******************** stated again that the fed ex driver forged his signature, and he wanted ********* to file a claim on his behalf. 
    On May 10, 2023, ******************** sent an email that he did not want anymore art from Park West Gallery and that he will file a complaint with the BBB. ******************** wanted ********* to send him verification of the signatures on the packages that were signed for and the date and time. Instead,he was sent a list of the artwork name, the date it was shipped and delivered along with the tracking number. ******************** could have gotten that information via the tracking numbers he was given.
    ********* did not file a claim on behalf of ******************* as his artwork was delivered and sent back and delivered again costing Park West extra shipping charges.
    Its important to note that all clients are sent a notification from Park West and Federal Express that their artwork is shipping. If ******************** was not going to be at home, he could have informed ********* and we would have held it for 16 weeks or he could have made other arrangements.
    ********* has been in business since **** and has an outstanding reputation because it makes every reasonable effort to resolve any and all client concerns. We are confident in what we sell and the value we deliver.

    While on the Norwegian Star cruise ship I attended an art auction with my mother. My mother had booked the cruise and the room was in her name. When I sat down with the gallery manager I signed up for the park west credit card and requested my purchases be charged to the card. I filled out all the paperwork and signed everything. When the paintings started arriving they were addressed to my mother instead of me. I asked about this and was told the account was linked to the room which was purchased by my mother so the account under which the paintings were purchased also belongs to her as do all my paintings which I signed for and paid for with my card. While on the ship I verified my information was in the system. I believe when the power went off on the laptop it defaulted back to my mother. They had already had to fix they paperwork 3 times at this point as the prices and payment method were wrong. The auction house refuses to transfer ownership to me without written consent from my mother and additional payment for the paperwork to be changed. I do not feel I should have to pay for their mistake. It is clearly my signature and my credit card on all the paperwork. If something happens to her prior to this being corrected I will be required to continue paying for my paintings but will not be able to prove they are mine.

    I was on norwegian cruise line and thought to get some art work at *******************. I was told by the seller that it was authentic work embellished and hand signed with a DNA signature from ****** ******* himself, and not ****** ******* studios. It in fact was from ****** ******* studios and was not signed by ****** *******, but was printed on with the rest of the print. I would not have bought the work knowing it was a fake copied signature and what I was told I was purchasing was not what I was told I was buying. It was only when 1 of the 2 pieces came in the mail that it showed that it was printed on and is not authentic nor made by ****** himself just his artisans. I spent $4,300 and I would like refunded for it all and if it requires going g to court that all costs are covered by them. And if possible I would like some compensation for being lied to and pressured into purchasing a work of art. I asked for a refund and they said no. So I am here seeking legal help to resolve this fraud.
