Midwest Disability out of ********* is defrauding people. They stole over ***** from me. They need an investigation into their business practices. I asked them for help in February of last year. They had my SS# and email. They did nothing so I filed for disability on my own and in November was approved. Midwest disability then accepted over ***** for helping me. I called them and they admitted doing nothing, I have emails and letters saying they did NOT represent me. 3 months later I still don't have the $$ they stole.Midwest Disability Response

*********** As our prior communications detail, after reaching out to our firm, you completed an application on your own and were approved. Despite ** sending our representation forms to SSA in May 2023, they did not attach those documents to your claim nor recognize us as your representative until October 2023. You were approved in September 2023. Upon receiving that information, we agreed right away to withdraw as your representative and charge no fees. Conversations with you and your son in November 2023 support this timeline of events. We closed our file and withdrew our representation and fees to SSA within 1 day of that conversation. SSA still sent us fees, however, and we returned those to SSA in January **** via certified mail. As our communications to you previously indicated, it is now SSA's responsibility to provide those funds to you. You will need to keep in touch with your local SSA office to resolve the matter as we no longer have access to your claim or representation of your case. Nothing was stolen and the funds that SSA sent to us were returned promptly. We have benefitted in no financial sense from this case.Review from Lindsey G

They represent me during hearing properly they only listed my title, I have lost almost my entire work history for them not including my work duties, Poor representation, each time I called it was a different representative, I notified them of any documents received from SSA and completed them myself. I lost over 10 years of income. It took another law firm to get me qualified.Midwest Disability Response

Hello **************** We are pleased to hear your good news, though sorry we were unable to make that happen sooner. In reviewing your case with us 3 years ago, all work history and medical documentation were supplied to the judge. There are situations in which medical conditions that could help win a case are too new at the time and do not meet SSAs duration requirements. However, if they continue to pose problems for you, a new case later down the road would likely be more successful. Our sincere apologies for not providing the service you were looking foryour comments and concerns will be taken into account when reviewing our procedures going forward. All the best.Review from Lisa H

They are terrible, they never appealed my case, or set any actions toward my claim in the whole 9 months , they kept telling me they had my back but social security says they entered no paperwork or filed anything on my behalf. Never had a steady case manager to help move it along. Never filed the hardship form . They sure did talk alot just never did anything to help with my case.Midwest Disability Response

After reviewing the history of your claim, including documents filed, emails sent, and phone conversations with you, Social Security, and friends/family assisting you, our records show that there were several actions taken to appeal the active claim you brought us. However, due to errors with SSA's computer system failing to accept the appeal, a new application was required. Hardship letters were sent out in September 2023 twice and received and submitted to SSA. This was also verbally communicated to SSA in October 2023. SSA continued to deny any attempts to reactivate the old claim or move forward on it after contact issues with you due to lack of reliable phone access, through no fault of your own. A new application was competed in November 2023 due to the issues noted above. New hardship forms were emailed to you in November 2023 but not received and currently there is no mailing address to send these to. We have asked SSA if there is another option to get that information to them. We can appreciate the frustration you have felt given the challenges your claim has faced, as well as the difficult personal situation you are in. We apologize we were unable to resolve some of those issues sooner. Currently, the new claim appears to be moving through SSA's system in the ordinary fashion and we remain ready to advocate for your claim.Review from Leon Y

Almost no communication. I don't know how many case workers I had I think 3. If they said they reached out to me they didn't on my cell or home. I'd always return calls as well. Cos I would've answered. I had to call almost every time I needed an answer or give them the dates of ongoing issues. If you cannot use new issues why do you need to know about them? I only got to speak with the case worker once before court on the phone. Then only 10 min before court. Asked questions felt confident. She didn't even contest what they said I could do. Then I got a confusing letter saying they're thinking about appealing. I didn't know they were talking about dropping me. 2 years wasted 2 years wages gone. Your sorry isn't worth anything to me. Cos evidently you didn't care either.Midwest Disability Response

****************, Please know we take seriously any and all client concerns. We strive to make this long and often frustrating process an easier one for people! Your file history notes indicate ongoing communication between our office and you, our office and SSA, and our office and the judge's leading up to your hearing. The attorney that attended your hearing with you attempted to reach you three times on Feb 20 and was unable to until the day of your hearing. The reason is unclear; however, lack of communication until hearing was not for lack of effort on anyone's part. For any questions about paperwork, we always welcome questions to help explain. We certainly could have helped you understand the after hearing and possible appeal/withdraw process. Our attorneys and staff care quite a bit about our clients....if we didn't we certainly wouldn't still be doing this work for over 40 years! We wish you all the best going forward.Review from PAULETTE A

Hello ****************, We certainly extend our apologies for your experience. We always desire to make the process easier on clients, not more difficult. Sometimes, issues outside our control get in the way of that. In reviewing our 2-year history with your case, the notes in our case management system show many times when we had disconnected phone numbers for you. When new ones were provided we left many voicemails with calls not always returned. This could simply be an issue with cell service or connectivity and no one's fault in particular. Several notes document that we reached out to at least 2 family members/friends to obtain a working phone and address when we'd lost contact with you. When contact information was not updated on our end we corrected this immediately. We spoke to at least 8 different DDS reps between Sept 2021 and May 2022. In June DDS reported a backlog of cases when we called them with you on the line. At the one year **** of having your case (2021) you inquired as to why this took so long, but in ******* the average time for an Initial determination tripled in 2022 (nearly 225 days!) due to pandemic related issues that struck SSA hard. We have no control over the pace of their decisions, no attorney truly does without being unethical. Your case is still pending at the Reconsideration level since Dec 2022. In the end, we sincerely wish your experience in this entire process had been smoother, as we do for all our clients. We wish you the best in your fight for your benefits.Review from Sheila C

The lawyer I had and the staff were absolutely worthless !!!They don't get your Dr. notes and information over to social security like they are suppose to and they hardly ever returned my calls. I would never recommend anyone to them as I was so disappointed I hired them.??Midwest Disability Response

Hello ******, We are sorry to hear that our efforts did not meet your expectations. In reviewing the history of your case, it appears we had some delays in getting responses from two medical providers for records and in obtaining additional evidence from your Workers' Compensation claim. However, the *** received and reviewed all evidence prior to making a decision in your case. A Workers' Compensation claim can have significant impacts on any benefits you were entitled to. Additional Short Term and Long Term Disability claims can as well. The combination of these three types of claims often slows down the processing of information and payment. We strive to communicate regularly with clients, and I see that since the year you hired us, we have been in contact at least every 2 months during slower periods of waiting on Social Security for decisions, and at least 1-2 times per month leading up to your hearing before the ***. Anytime you needed assistance staff were responsive, even if not assigned to your case. Again, we understand this process can be lengthy and frustrating. It also matters a great deal to you, and all our clients, and therefore to us as well. We will continue to fight for benefits our clients deserve and we wish you all the best going forward.
