    33rd Company has been my property manager for two rental properties since about 2014.Prior to that they managed the rental of my residence when I was out of the country from 2008-2014. In 2020 when we had a switchover of tenants 33rd Company used a preferred vendor to replace old carpet with new vinyl tile in the family room of our property at *****************************************************************. About a year later we were notified that the tile was coming loose and that the subfloor may need to be replaced. We replied that since it was 33rd company's preferred vendor, we would like them to check on the warrantee on the flooring and also investigate why the vendor had installed it if the subfloor would not support this type of flooring. We have never gotten a response to our questions although we have emailed and called at least 3 different individuals multiple times over the course of the last year. I would like someone to call me from 33rd company who can provide with information concerning the preferred vendor. This person should also be able to clarify what responsibility 33rd company has when a preferred vendor does not do satisfactory work for the property owner.

    I hired 33rd Company for rental property management of a townhome that I rent out (380 *************, ******** **) in November of 2021. They found a tenant for my property and began the lease on December 15th of 2021 and charged my account for the leasing fee (one month's rent of $1,775.00). There were additional charges for maintenance ($285), coordination of repairs ($25) and the monthly management fee of $99 per month. After these deductions to the account, according to my calculations, I was owed $2,267.28 in February. The 33rd Company disburses funds on the 15th and I expected to have that amount put into my account. Instead of that, they withdrew $1,362.72 from my checking account via an ACH withdrawal. Having no notice of such a large withdrawal beforehand, my bank charged me an overdraft fee of $12.50 to cover the charge. I sent an email to the property manager, *******************, as soon as I was alerted to the charge on 2/17/2022. He sent the following as a response: "Hello *****, I apologize, I'm working with accounting to fix the problem. I'll keep you posted." That was on 2/17/2022 and that was the last that I heard from 33rd Company. I have sent 3 emails to ****, 1 email to the business manager and 1 email to the company via the website. I have called and left 3 messages with **** as well. I have received no response to my messages or any follow up on the problem. I use the rental income to pay the mortgage on the townhome so not having any rent along with the $1,362 charge to my account is starting to become a real financial burden that I wasn't counting on when I hired 33rd Company as my property manager. At the start of my agreement with 33rd, I specifically asked if I would have to pay for any charges (i.e. the leasing fee) and was told that any charge would be taken out of the rent and not my bank account. I would like my money returned and start to get paid the rent that I am owed.

    Dear BBB **************** Representative,

    Thank you for providing us this complaint, and also allowing us an opportunity to respond.


    The rent was unfortunately not paid timely for ******* and February from the tenants occupying this property, and the tenants did not pay rent by check as required when the *** collection did not occur.   We cannot distribute rents to the Owner until and unless it has been collected successfully from the Tenants (cleared funds).  As such the Owner did not receive a distribution thru normal schedule as no funds had been received or processed.   The Owners account did not have cleared funds to distribute.  The property was on-boarded correctly, including the property groups, so there should have been no problem collecting rent as scheduled. 

    Once this was issue was discovered, the Owner was notified that we would investigate the issue with accounting and rent collection. The tenants were also notified that we would pull two-months rent by *** out of their bank account. We did not receive any responses from the Tenants, but the funds withdrawal for rents did in fact clear.   At that point, the Owner was notified that we successfully collected the past due rents, and processed a distribution to the Owners account.     

    This matter has been resolved. We cannot control the timing and payment issues of in place tenants.  They are obligated under the lease to pay, and we did notify the Owner of the delinquency and remedy which took time to correct.   As such we do not believe that this issue represents a chargeable complaint to the company.

    We also request that the property managers name be removed from the complaint as this matter is not a personal one but a complaint against the company, and the employee does not wish to have their name published in this complaint.

     I am rejecting this response because:

    The issue is still not resolved. I thank the Better Business Bureau for helping to move things in the right direction and to get a response from 33rd Company, however I am yet to be reimbursed for the $1,362.72 taken out of my checking account and receive the rent money that I am owed. Additionally, I have not received reimbursement for the $12.50 overdraft fee. The full owner's statement will not be available until March 10th so I have yet to review what 33rd Company has for accounting on my rental property and 33rd Company has promised to pay out on March 15th but at this point I would like to hold this complaint open until those events actually occur. Thanks again for your help!
