    I was searching for an accessible vehicle. I was looking specifically for a VPG MV-1. While searching I found two that were located at this dealership. I contacted them and asked specifics about the vehicle. When I was provided the details about the vehicles located on the website it was discovered that neither vehicle would suit my needs. **** then sent me pictures of another MV-1 that he stated was "ready to go". I specifically informed **** that I needed a vehicle with a power ramp as I will be on my own and did not have the capability to use a manual ramp. He informed me that the ramp was in working order and that it was powered. **** did not have a posted Buyer's Guide on the vehicle and at no point made one available. I asked specific questions about the vehicle and was assured that the vehicle was ready. **** informed me that I needed to have the money sent to him. I had my bank send ***** dollars of the purchase price. I informed **** this was a loan and the of the loan is to have a fully accessible vehicle and that is what I was signing to. He informed me that the vehicle was in working order. I ordered a cashier's check for the remaining balance of $7600 which would be payable upon delivery. **** then rushed delivery. I informed him that the check had not been received and he delivered the vehicle. When he delivered the vehicle, he did not provide a Buyer's Guide or any warranty information. He delivered the vehicle without a dealer temporary plate. In fact, he left the previous owner's license plate on the vehicle and asked me to "ride out the registration" which I did not want to do. The vehicle has been parked since delivery. I drove to the post office to try to pick up the cashier's check and to the car wash and for food. When I went to get in the vehicle the next time to pick up the check the vehicle ramp would not deploy. I asked **** about it, and he stated he did not know why it was not working. The vehicle was returned.

    I did deliver the vehicle to her in ******* *****. She test drove the vehicle and tried out the power ramp it was all in excellent working order. She then signed the original purchase order and also the buyers guide and was given a copy of it as well. She did not give me the downpayment of $7,583 as she agreed. She said it was sent to her PO box but she didn't have it but would send it in a day or two.

     I am rejecting this response because:
    **************** has the vehicle. He misrepresented the vehicle and did a bandaid fix on the ramp. The ramp worked once and never worked again. The Buyers a guide was not provided prior to him requesting funds from my bank or prior to any paperwork. **************** agreed to rescind the sale of the vehicle and has been misrepresenting everything from day one. He put in writing three times he would refund my bank and when they contacted him for the refund he cursed them out. He knows that he misrepresented this vehicle and that the ramp DOES NOT WORK therefore it is not accessible. **************** requested I get the vehicle back to him and I did and now he is refusing to refund my bank. He has been deceptive from the beginning and every step of the way. The dates are incorrect his paperwork. Everything was recorded and there are witnesses to this deception.

     I am rejecting this response because:

    USAA records all calls and have sent the calls to their attorneys as well as mine. Every conversation and transaction with **************** has video/audio and paper evidence To include his knowledge prior to trying to sell this vehicle that the ramp was inoperable and other damage and repairs that were made that he did not disclose. **************** has possession of the vehicle and the funds which adds to his deceptive business practices and poor customer service and lack of care. **** gave him the information to return the funds per his request to speak directly to them and he refused. **************** has illegally kept funds for a product he has in his possession and has essentially stolen from USAA and myself.
