Formal Complaint Regarding Illegal Repossession and HarassmentI am writing to formally report and seek resolution regarding a series of incidents involving an illegal vehicle repossession and subsequent harassment by [Financial Institution/Company Name, e.g., First Community Credit Union (FCCU)] and associated parties. I believe these actions are in violation of federal and state laws, and I request a thorough investigation into the *********** Information: account number Loan amount and monthly payment: $340.00,consistently paid $********* payments were ever missed, as evidenced by credit reports and bank statements.Payment History and Evidence Payment of $700.00 made on 9/9/2021 at ******************** .Credit reports confirm no missed payments, showing three loans with perfect payment history. **** default notices began erroneously on 7/28/2021.Repossession Incident: Despite all payments being made, **** repossessed my vehicle.Attempts to access my account online were blocked.Employees at both the ********** and ************ locations refused to provide account information or payment records, as documented in videos. They also refused to provide the vehicles location or accept my payoff offer.Harassment and Retaliation: Employees at both locations called the police during my visits, Following these events, police and ************************* were repeatedly called to my home.On Thanksgiving, officers attempted to enforce a ***** Act order without legal grounds.. The referenced loan was taken out by this member in August of 2018. The member was able to keep the account in good standing through May of 2021. However, this member did not make payments in June, July or August of 2021 resulting in the account falling past due. The collections department made numerous attempts to contact the member via mail and phone to setup payment arrangements. The member made two payments on September 9, 2021, which covered their July and August payments, to avoid the vehicle being ordered for repossession the next day. The member did not pay again after this and the vehicle was eventually ordered for repossession on November 11, 2021 and recovered on November 15, 2021. Over the next month, this member visited several credit union branches and had numerous lengthy conversations with employees of the credit union, including members of management, explaining the history of the loan, why the repossession was ordered, and how the vehicle could be redeemed. Most of these conversations ended with the member refusing the answers provided, inaccurate accusations against the credit union or excessive foul language. The credit union has not been in contact with the member since December 2021. A default judgment was entered against the member in **************** in January 2023. Worst Lender Experience - Avoid at All Costs!If I could give negative a million stars, I absolutely would. This has been hands down one of the worst experiences of my life. Six months ago, we purchased a vehicle through a dealer that used this lender, and ever since, it has been six months of absolute h*** dealing with this company.Its been one issue after another, and just when I thought it couldnt get worse, trying to leave this lender and go elsewhere turned into a complete nightmare. They have a phone system designed to trap youit recognizes your number and forces you into extremely long wait times. When you finally get through, youre met with disrespectful, rude, and unprofessional representatives.Their online banking is a literal joke, riddled with glitches and frustration. On top of that, they pile on charges and fees everywhere. Just paying my bill costs extraa $6.95 convenience fee on top of the card fee. Its one big gimmick designed to drain your ********** time, I made a payment at the drive-thru and was given a receipt, but the payment was never posted. Two weeks later, after they called me about a missed payment, I brought in my receipt and had to make another payment just to avoid penalties.I could go on and on about the issues Ive faced with this lender. This business is a disaster, and I urge anyone considering them to think twice. On top of everything, I was able to refinance my loan elsewhere and saved almost 3% in the process.Buyer Beware! Do yourself a favor and stay far, far away from this lender. The stress, hidden fees, and constant frustration they bring are not worth it. This by far has been the worst establishment I have ever did business with. I highly don't recommend them to anyone for anything. Their employees are very rude and unknowable about EVERYTHING! In my opinion they should be shut down. I would give zero stars!First Community Credit Union Response

I'm unsure of the exact reason for the review. Member has a vehicle loan with the credit union, the ********************** has sent numerous letters and made many phone calls, there was no response to any letter or voice mail. The vehicle is currently out for repossession. Member has been told recently the amount needed to stop the repossession. The amount has not been satisfied yet. If member plans on paying this Friday, upon receipt of certified funds the account will be current and the repossession order will be stopped.Review from Crystal H

Contacted member by phone on 4/29/24. Member had incurred several NSF fees due to initially being unfamiliar with how online billpay checks are processed. Member had already taken steps to avoid these fees going forward by obtaining cashiers checks to ensure funds would be available for payment. I'd applied for a consumer loan and was denied because of one open collection and they stated my income was too low. There have been issues with First Community Credit Union denying consumers because of being African American. I have a fair credit score and I'm sure there have been others that aren't African American have a fair credit score with an open collection on their account and were still able to get a consumer loan. I feel there is a racial problem with African American being treated fairly while applying for loans through First Community Credit Union.First Community Credit Union Response

The application was submitted for a $5,000 unsecured loan with the purpose of debt consolidation and building credit. The only active debt other than deferred student loans is a collection item which was reported June 2023. The level of the applicant’s percentage of debt to income and the open collection, the application was denied due to excessive obligations and collection action. There is not enough recent established payment history to overlook these factors for that dollar amount of an unsecured loan.Review from Mary Jo B

We moved to ******** a few years back and joined First Community since it was close and we could get debit cards immediately. We banked there for 4 years. I recently ended up filing for Bankruptcy. I own that and my mistakes with credit cards. After filing - First Community by company policy joyfully CLOSED every single account my name was on. Car loans - closed. Checking and Savings - closed. No warnings. My paycheck, my spouse's paycheck - all in limbo because they were set up for one account that was closed without our knowledge. Now we are scrambling to pay for food since our funds were locked up and frozen.FCU practices the art of cross collateralization, where if you make a mistake with one account, in this case my credit card, they take everything as collateral on it. They don't mention this tactic when you sign up for you auto loan or credit card or checking account. They just seize it all with a smile on their face.First Community Credit Union Response

The response in this email is for informational purposes only, not to collect on a loan. When a member files a chapter 7 bankruptcy, the credit union has rights and the option to exercise those rights, in this case we exercised our cross-collateral clause, which was clearly identified not only in the loan documents but also the membership agreement. The credit union sent a reaffirmation agreement to your attorney for the ***** Civic loan and credit card, as we felt there was equity in the ***** loan. It was your choice to surrender the ***** Civic, in looking over your bankruptcy documents the Statement of Intention regarding the Civic was left blank. The representative of the credit union transferred money into a new account with just your husbands name on it (he did not file bankruptcy) because we were going to take a loss on the credit card, there are no holds or restrictions on that account. The ********************************************* does not enjoy doing this, it is a way to protect ourselves and limit loan losses due to bankruptcy.Review from Michael L

Yesterday I had a score of 746. I'm in debt for $3,471 total. I've been with FCCU for three years. I don't have a loan with them and I thought I would apply for a debt consolidation loan. This would allow me to only pay $75 a month over the next five years versus $250 a month. Keep in mind, I've never missed a payment. I even pay more each month. I rent a home I've been in for 10 years. I was denied and my credit score went down to 740. Shame on you FCCU. You call yourself a community credit union. I really don't see the benefit. I have been with this bank a long while never had any problem. I have this bank because of my grandparents too. They suggested it thats how you know its real Ive gone in the bank twice Ive had my card fraud small amount did a dispute. They did not return it. Kind of hurts my feelings cause I had proof I didnt spend the money and I know theyre good for their disputes and it was a small amount, but I needed it.Their customer service is absolutely disrespectful. I was asking a question they shouldve led me to the lost or stolen number and they didnt. So now I dont get to freeze my account. Ill just go there tomorrow. I dont have to freeze my account but itd be nice considering I dont feel like my info is safe.The moment when I called customer service and they just say no acting like Im a ***** to the point where I quote ask is there a reason youre upset with me for asking this question When I went into first community credit Union, I asked them to update my account information for the fact that I have moved in my account information was like three houses outdated, even though blah blah blah They still have not updated my information the way I needed them to the accurate information Im very upset that I dont make enough money to be treated right? Im just a debit card holder not a credit card holder. Sorry Im not good enough for your f****** bank. I mean Im still gonna use you because theres no point going to another bank its gonna be the same. We believe this is regarding a Door Dash transaction from ********** There are previous transactions from Door ************** that have cleared the account. Notes on the dispute indicate we sent a letter asking why this merchant previously cleared the account and is now considered fraud. There was no response to this letter, therefore 30 days later we closed the dispute for non-response. We have reopened the dispute and provided a credit of $17.92. Contact information was last updated on 7/27/2023 through online banking. We have no record of items being returned from the post office as incorrect address or undeliverable. If your address, phone or email are incorrect, please update this information the next time you come into a branch or you may also update it through your online banking.Review from Daniel C

this bank is a complete joke. Do not use them for any loan. My name is *******************. Im not scared to hide behind my words. Do not take out a loan with this bank because when you were in financial troubles, they will not work with you when my gap insurance did not pay off my loan, I asked if I can make a minimum payment, and they threatened to turn me over to attorneys.First Community Credit Union Response

This member purchased their vehicle through a dealership, utilizing First Community for financing. During the purchase process, they choose to purchase the dealerships GAP product. After the vehicle was totaled, the member discontinued making payments and defaulted on their loan. When First Community attempted to contact member to discuss the account, we were told on numerous occasions that the member would not make any more payments and were directed to talk to their insurance company. First Community received a settlement check from the members insurance company two months after the accident and still have not received a GAP settlement that the member said was coming. The member reached out yesterday to offer to make monthly payments that would be a small fraction of his contractual monthly payment, stating he has a new truck that he needs to pay for. The member was advised that per his contact, he will be required to make full monthly payments until the loan is paid in full and that failure to maintain his loan could result in the loan being charged off and being sent to an attorney for collection. First Community does not have policy provisions that allow members to alter loan agreements due to the collateral being damaged or deemed total losses.Review from Prince T

I would never do business with this institution again; they screwed me over.Had a car loan with them, the car was totaled and I worked with the insurance to get the loan paid off. They reported missing payments to the credit bureau even though they confirmed that they received payments from the insurance and gap insurance companies for the totaled car. As a result my credit score dropped by 60 points. What a shame! Closing all my accounts with this garbage institution where I was provided conflicting information every time I called them.First Community Credit Union Response

It is standard industry protocol that if a loan payment is not made in a timely manner; that the late payment will be reported to the credit bureau. We report late payments when the loan payment is at least 30 days past the due date. The insurance company and gap insurance have not paid the loan balance in full. We have made attempts to contact you via phone and mail regarding the late payment since it was 2 weeks past due. The loan contract you signed when you bought the vehicle states when the payments are due. The letter from your insurance company states the total amount they are paying and that you are responsible for the difference of the loan. We also noticed that you purchased an extended warranty. Since the vehicle is totaled, please cancel the extended warranty to receive a refund. Please contact us once the loan is paid off and we will discuss options regarding the late payment reporting.
