    On October 16, 2021, ***** ***** of Bosshog Custom Homes agreed to provide land clearing, tree removal, grading services to make the land level in preparation for building a structure, and the spreading of gravel at my property located in Woodland Lakes near Potosi, MO. ***** provided a contract which stated me would have the work completed by December 5, 2021 for the price of $2,500. On October 19, 2021, I provided ***** a check for $1,500 as an initial payment for the job. On or about November 14, 2021, ***** cut down numerous trees and left them laying where they fell. On or about that same date, ***** rented equipment, dug a hole, left the site in worse grade condition than when he arrived, left trees scattered over the property, and did not complete a single task he agreed to do. When I addressed these issues with *****, he stated the equipment he rented broke down but that he received a credit from the company so he could rent the equipment again, at no additional cost, to finish the job. ***** continued to say the job would be complete by or before December 5, 2021. ***** asked for an additional $600 to cover the cost of gravel which he would have delivered to the site. On November 18, 2021 I provided ***** a check for $600 for payment of the gravel. As of today, April 28, 2022, ***** never returned to the site to clear the trees, grade the land so that it was level in preparation for building a structure, nor did he provide or lay down gravel. ***** did not finish any of the work he agreed to and ***** has not made any attempt to make this right. On March 19, 2022 I sent a text message to ***** stating he had until 8am on April 4, 2022 to completed the work or he needs to return the money I paid him by 5pm on April 4, 2022. ***** has not completed the work and has not returned any money to me. I am seeking a full repayment of the $2,100 I provided. I now have to hire someone else to complete the work he failed to do.

    I am rejecting this response because:

    1) *****’ response of “I have tried contacting this customer many times and he has not responded.” is factually inaccurate. Phone records show that since September 24, 2021, ***** ***** and I have spoken verbally more than a dozen times and sent/received text messages more than a dozen times. Since the November 15, 2021, ***** has failed to respond to four text messages, as shown in the photograph above. More specifically the March 19, 2022 text message stated “*****, it’s been weeks and I haven’t heard a word from you.The grading, gravel, and tree clean up needs to be done by 8am on April 4th, 2022 per the terms of our agreement.The grading that you began needs to be fixed, finished, and level so that a structure can be built with the same setback as the neighbor’s structure and property.If you cannot complete the work you agreed to, please let know ASAP and return the money I paid you by 5pm on April 4, 2022. I will accept cash or cashier’s check.”

    2) Records show communication between ***** and I has been one-sided, that being ***** has not responded to text messages or phone calls as of November 15, 2021. (See photograph.) One exception is that on January 14, 2022, ***** and I spoke on the phone and he stated it was too cold outside to work on the project and he was waiting until warmer weather.  Despite the fact that he chose not to work when it was warmer, I gave him the benefit of the doubt and waited until there were more than 5 weeks of warmer spring weather and he still did not attempt to to work on anything as of March 19, 2022.  That’s when I sent the aforementioned text message asking for him to return the money I paid him.

    3) ***** has a history of making excuses why he cannot work on the project or have it completed by the time he agreed. Previous excuses include, but are not limited to, trees are too “green” to use a chainsaw to cut them, grandmother sick/passed away, he’s affected by covid, and its too cold outside.

    4) Lastly, *****’ one-sentence response does not adequately address any of the issues raised in this matter.

    Based on the aforementioned, I am seeking a full repayment of the $1,800 I provided as I now have to hire someone else to complete the work he failed to do.
