Fearing painting company was hired to do a full paint job of our new house. This included walls, ceiling, trim and doors. The company kept asking for money to "pay his staff" and asked for additional money to add more coats of paint and have more people come in to get the job done before we moved in. These extra people never showed, the job was not completed in time and is still yet to be completed. There are multiple places that aren't completed, prep work to include sanding of the doors was not done which was stated in our original quote. Due to the lack of sanding our doors are chipping. We have attempted to contact the company to schedule a time for them to return...yet he will not respond. We have also been threatened and harassed by an individual that was sub contracted out from Fearing painting company. The company failed to notify us of this man's release from the job while allowing him to have full access to our house by passcode and key.Business response

After reviewing the clients many complaints listed weve determined we are in disagreement with several topics that have been brought to our attention. We have visited the clients home as of 11-6-23 personally myself and the company VP to discuss the best way to move forward and to satisfy clients wishes. We will be reaching out today to schedule their final project critique. Overall explanation to the complexity of this project from the beginning is far to excessive on both parties to be specific therefore we respectfully decline to explain further. I made a downpayment in September of 2021 $4500 for work to be completed in October 2021 on the exterior of my house. At this time the only thing that has been done is powerwashing the exterior. The work was to include a German Schmear technique. I was told I was first in line this spring and have learned that the painting company has prioritized contractor work over mine. Weather has played a problem in this, but when the weather is nice, the owner chose to do interior work of other houses. I have cancelled the project and asked for a full refund which he has granted. He will not pay me for 30 days. I believe he has had my money long enough and I want it back ASAP.Business response

Mrs. ******** was referred to FPC INC. from a builder we have worked with for many years in the past. I contracted with Mrs. ******** on September 23,2021. Intended date of project planes were notated on contract as October 14, 2021. Client specified request of services to be performed which was to be a German Schmear finish, a specialty finish that FPC offers. Upon contracting I requested an initial materials/labor draw as we do on many specialty projects. That draw was 50% of the contract total in the amount of $4,500.00, check no. 1825 issued personally from Mrs. ********. I made Mrs. ******** aware upon contracting with her that the materials were a specialty product/finish and that they would have to be back ordered from ******* ******** *******. I also informed her in my experience that usually took a matter of about 2 weeks possibly more depending on the products. I further let her know what had happened in Texas during the freeze in February at a ******* ******** raw materials plant. Half a million gallons of raw materials had froze and that it had caused major setbacks in regards to paint materials all over the country. I explained to her that it caused quite a few problems for our company logistically speaking because materials were either not available for purchase or they were not arriving on time as specified by ******* ******** paint representatives. That unfortunately happened here in this case and Mrs. ********* specialty products were not (ALL) completely received until November 27th, 2022. At this time I had already been out to Mrs. ********* home to perform color consultations and to apply color samples to see which color Mrs. ******** preferred to go with regarding her German Schmear. The last color sample applied was on November 5th. I reached out to Mrs ******** on November 12th @ 11:30 am to confirm with her as a color had not yet been selected on Mrs. ********* behalf. I reached Mrs. ******** and she had selected “White Duck” a ******* ******** white base color. At this time I still had not received (ALL) of Mrs. ********* paint materials but 8 gallons of 30 gallons ordered and/or her H&C masonry sealer for her topcoat or final coat. That was completely out of our company’s control as I pleaded with ******* ******** in order to get Mrs. ********* project underway. I stayed in close touch with Mrs. ******** updating her on the status.
When (ALL) materials were finally received I was battling temperatures in November that were going to be very difficult to maneuver through almost impossible. I already knew it was going to be difficult to complete her project within 2021 due to the material specs for these specialty materials. Manufacturers recommendations of these products could not warranty or perform correctly in use below 60 degrees F. The fact that we warranty our projects for a period of 5 years I knew the only way around the issue was to void a warranty all together and I did not want to do that in consideration for Mrs. ******** and her project, let alone we have always stood behind our work for more than 55 years in this industry. Unfortunately, shortly after Thanksgiving I had fell very very ill with covid and was bed ridden for more than six weeks. I had let Mrs. ******** know this and had repeatedly apologized her project did not get completed. I explain to her that had I received materials in October, without any doubt her project would have been completed but with little time to spare. Through the winter I updated Mrs. ******** through until March. Knowingly as I was eager to get her project completed for her the likelihood of getting started in March were slim to none. I shouldn’t have got her hopes up even before May but I was eager to show her our work and complete her project. I text Mrs. ******** in April stating that the 2nd week of May the weather was starting to look consistent in hopes we could perform her project for her. There has been a lot of rain at the time and the company needed to perform a mold and mildew treatment on her brick. The treatment had to be performed while the substrates were dry so the chemical would consume the mold and mildew properly. The company performed the treatment at no charge which is a $700 treatment for a project her size. I believe the entire home was pressure washed as well, not just the brick. The remainder of May and partly of June was a complete washout due to rainfall. I let Mrs. ******** know that we had another interior project just down the road from her and would be performing there until the rain cleared out so we could perform her work. The company completed its interior work on this project down the road from Mrs. ******** in just a few days. Not to my surprise it rained for another 2 1/2 weeks straight almost everyday.
By this time I had scheduled interiors to do so of course I could keep my men and myself busy as it was raining. The company was scheduled by one of our builders from Joplin MO, one of our builders for many years, to perform 3 projects in Nevada, Missouri to include- Specialty Risk Insurance project interior/exterior and ******’s interior. These are very large projects. These projects were started June 8th of 2022 I believe and are currently ongoing scheduled to complete July 14th. My choice to complete these projects before coming out to Mrs. ********’s was one that was ethical in my belief. It was my responsibility to not leave these projects open ended not to add is a substantial amount of payroll and materials wrapped up in these projects currently and financially it was also the best decision to make for FPC Inc. My intentions were to go directly to Mrs. ******** after these projects were completed. I received a text from Mrs. ******** June 22nd requesting to come get her project going. I told her that I completely understand and that I must wrap up project operations for my builder in Nevada, Missouri before coming out to her project and getting started. I informed her we working just as hard as we could to get to her. Mrs. ******** then followed up with a text message shortly after that day stating “I thought I was first on your list, I’m just confused and frustrated” I explain to her as far as residential exteriors she was. We had not touched another exterior as we managed to do (ALL) interior work up into this time in the year. (Each and every year as painting contractors we are forced yo contend with the weather and manage our interior/exterior schedules accordingly. That is not an easy task whatsoever) I explained to Mrs. ******** I had to complete the projects we were on currently and that we would be to her. I explained to her that I did schedule her exterior project first but it had rained for almost 3 weeks when the project was scheduled, mind you with no end of rain in sight would be what the forecast was reading. As a business owner I cannot standby for 3 weeks and wait on the weather to improve. If I did I would have no business to speak of and that is the truth of the matter to its entirety period.
I further explained to Mrs. ******** as stated before, the company had not touched another exterior, not one as of this year, 2022. I apologized repeatedly for any inconvenience but 2 factors up into this point, completely out of my control was the culprit of Mrs. ********* frustration. One being her materials not arriving on time as I stated before and 2 the weather. I was willingly ready to perform her work the moment our operations in Nevada were completed as of this Thursday, , July 14 2022.
