I have been a renter through breckenridge for about 10 months and have complained over 7 times now, in my lease it’s stated that no use of drugs including marijauna would be allowed. For months now I have come home to my house smelling of it and to the point it makes me feel nauseous I have a 6 month old son as well and it isn’t good for him to constantly be breathing it I’m especially since it makes me an adult feel sick. Everytime I call they tell me there’s nothing they can do, I’ve offered them come to my apartment to smell and they wouldn’t they just told me the same thing. They told me if I can figure out where it is coming from then they may do something. So now I have to do their job when they could simply come do that themselves. They also suggested me paying out my lease which is over 1,000 dollars and finding somewhere else to go.Business response

We had received some phone calls from ******* ********* about the smell of Marijuana around her apartment. We had issued a warning for the neighbor who admitted that they were smoking it, it is attached. If this is continued they will receive a fine next and if they continue to do so they will be given an eviction notice.Initial Complaint

I have a service animal for some of my health conditions. My lease states that I do not have to inform them if I have a service animal. They fined me $500.00 for the service animal. I was fined for someone staying with me and it says in my lease that I can someone stay with me for three nights. I was fined $500.00. They were not living with me. Third attempt my sister spent the night and they fined you $500.00 and the fourth attempt I was fined for having toys on my back porch in the amount of $500.00. I feel like they are pin pointing me and my mom. I think this has something to do with a minor altercation that happened with my sister. Also, my finance did not have tags on the truck but we parked the truck in guest parking and we received a message that the truck needed to be moved. I would like for them to stop fining me because there is no reason for me to be fined.Business response

On 2/26/23, Tenant applied for the unit and did not list an animal on her rental application and therefore, a pet was not allowed on premises. on 5/3/23, Tenant was given a warning for an unauthorized pet on property, After receiving the warning, she submitted the necessary paperwork that was needed and was allowed an ESA animal and she did the pet addendum in order for that animal to stay, no fine was issued. On 6/2/23, The Leasing Agent saw a maroon truck here multiple days. She spoke to him that morning and he said he was staying in F208 and they were waiting for money to complete an application. I told him that he can not stay. Tenant received a violation fine for having an unauthorized occupant. She paid that fine on 6/12/23. She has not received any other fines. Attached are the violation warnings/fines, pet addendum and their ledger showing the 1 (one) fine that they were issued.Initial Complaint

I was wrongfully evicted by this company. The lease provides that a visitor can stay three days (straight) with a resident. My daughter will come and stay with me for three days and her sister who lives here too, she will stay with her. They also charged me a fine, $500. There was an altercation with one of the office ladies and I think they are doing this because of that. I pay my rent and I don't bother anyone.Business response

On 10/27/22, the tenant applied for the unit and only listed her daughter, ****** a 14yo, that would be the only other occupant on the lease. Lease was signed on 11/17/22 for the tenant and her daughter only, it was made clear then that no one else was allowed to stay in the unit. On 6/8/23, the tenant was issued a fine for $500 for having an unauthorized occupant and said the occupant was being disruptive to the surrounding neighbors. On 6/29/23, the tenant signed a promise to pay for the $500 fine. On 7/24/23, the office had more complaints about the people that were staying there being very loud. Tenant was issued a fine for $75 for excessive volume. Tenant had told the office that her other daughter was just visiting from her apartment complex next door. On 8/2/23, the office called the apartment complex the daughter had said she was living in, they spoke to ********, the office manager at The Heights. They were told that the daughter was not on a lease at that complex. On 8/17/23, the office had more complaints from the neighbors about the noise coming from the unit, saying that it sounded like a daycare 24/7. Tenant was then issued with another fine for $500 for an unauthorized occupant. On 8/23/23, our leasing agent witnessed the tenant's grandson (who is not on the lease) running down the stairs naked. His mother was at the top of the stairs speaking to someone and not doing anything about her son. Tenant from another unit was also standing at the bottom of the stairs telling the boy to go back inside and to his mother. Tenant has been posted with an eviction notice due to the amount of lease violations the tenant has had. Attached is the signed lease, violation fines, the promise to pay for 1 (one) of the fines and the tenant ledger. Since then, the tenant has told us that she will be getting an attorney.Initial Complaint

Company charge me rent for a month and automatically took it off of my debit card and will not cancel payment they have also find me multiple times in the last 12 months for things that they have no proof of company is very corruptBusiness response

We are responding to complaint #******** from ********* *******.Please see the attached Lease, Lease violation warnings and fines and tenant ledger.********* paid his rent via an online portal with his debit/credit card. He set this account up himself and we do not have access to it. We do not have the authority to "automatically take" payments, those payments are generated by the person paying via debit/credit card..According to the lease agreement, page 3, section #**, only two (2) people were listed on this lease.Section #**, states any changes in occupancy requires written consent of the Landlord.Page 16, Addendum: Tenant Guest Policy- guests may not stay overnight for more than three (3) consecutive nights without the written permission of the Landlord.We received an application at our other property from a girl named ******** that applied and gave this address as the one she was living at. She was living there unauthorized. They were given a fine for this, which they did pay.Also, according to the lease, page 5, section 17A, Vehicles parked on premises must be in working order with the necessary registrations and/or inspections.The vehicle had flat tires and they had been verbally warned to take care of this and they did not. They were issued a fine for this as well, which they did pay.Please see the account ledger which shows the fines given, the payments they made on those fines, and proof rental payment was made via debit/credit card.They have vacated the unit and the proper move out inspection will be done. Any fees for how the unit was left will be applied to the security deposit. The disposition letter stating how their deposit was handled will be sent to them no later than 30 days, as allowed by the State of Missouri.We do not see where we are at fault in this situation.Thank you!
