    Dear sir or madam,In December 2021, I wrote the final check to Sierra Custom Homes for its work as the general contractor on my newly constructed home. That day, during the discussion prior to writing that check, I stated that I was dissatisfied with how several items in the house had turned out, a state of things that resulted primarily from the company's lack of supervision of its subcontractors work. I had hired the firm for their expertise. Had my expertise been in construction I would have been my own general contractor and would not have needed to pay Sierra its 15% fee. That list of items primarily included, but was not limited to, the following:1. installation of the hardwood flooring on part of the main level and the entire second floor showing many visible nail holes and excessive gaps;2. a cast iron bathtub in the second-floor bathroom that was damaged either in shipping or installation;3. ascetically unappealing, uneven installation of the kitchen backsplash tile;4. ascetically unappealing pattern of the primary bathroom shower tile that resulted from a miscommunication with the tile layer. The project supervisor had left the site and did not participate in the discussion; it should not have been my job to communicate with the companys subcontractors.Since that time there has been a range of other issues, some of which the company rectified, but others it ignored. The most egregious of these is the fireplace, which I cannot use due to an odor emanating from it that causes migraines. Apparently, that problem cannot be fixed without installing a new brand and model of fireplace. The subject of fireplaces that caused migraines was raised in the planning stages of construction. Sierra was paid for its expertise. It was its job to know or find out what issues various fireplace brands and models might have. It was not my job to know the materials and appliances. During our discussion in December 2021, the company president *********************** and I came to an agreement that he would have the following subset of the problems redone. His promise to rectify these three issues was witnessed by his business office manager, ********************************1. Replace the upstairs bathtub with the same Kohler product. ****** and I discussed several times whether the new bathtub had arrived, before I finally found out it was never ordered, indicating that the firm understood my expectation was that the company would replace the tub with a new one, not ************* it.2. Re-install the kitchen backsplash tile. Discussions with the site supervisor seemed to indicate that he was attempting to re-work the spacing of the tile used for the kitchen backsplash, but that did not result in its re-installation in my home.3. Re-install the primary bathroom shower tile;Please note that I did not request that the hardwood floors be redone due to the greater expense.In the year since that time, Sierra has reneged on its promises. It chose to repair the upstairs bathtub, leading me to believe that was a temporary measure so the tub could be used until the new tub was installed. However, a new bathtub was never ordered nor installed. In addition, neither the tile in the kitchen or in the bathroom shower were re-installed.In May 2022, two Sierra employees came to my home and asked me what I would take in exchange for that work not being completed. My preference at the time was that the work be done. As it was still not done by November 2022, I requested that, in lieu of the promised works completion, I be compensated in the amount of $10,000, but I have received no reply from the company. In November 2022, a Sierra employee said to me, But you have a beautiful house! As if that was sufficient justification for not completing the work *********************** promised to see done in December 2021. It is true that I do have a beautiful home for its price range, and that Sierra oversaw some very good work on many things. However, some things went awry, and **************** made a promise to see that those three items listed above were redone. I would like Sierra either to keep its promises to re-do the three items above or compensate me monetarily as requested.Sincerely,***********************
