I contracted with Shapes Construction to build glass window panels for a sunroom back in late September, paid them a $1300 deposit in early October, have tried repeatedly to make contact to check on the progress of the windows and have not gotten a reply since mid October.Initial Complaint

We hired ***** of Shapes Construction in December of 2021 to build a sunroom onto our house. He visited the property and gave us a detailed quote. A month later we received detailed architectural plans and paid the deposit. We were told that the delays were due to a hold up approving the building permits with the city. As of this week, the website has been taken down, my emails have bounced, and the phone is out of service. I called the city and no building permits were filed for my address. We went to to contract around April 26, 2022 with ***** ******. He didn't provided our signed contract for a kitchen renovation. He added the one he signed in ************ on 8-9-2022. Which was dated April 29th. The renovation included taking removing a wall between the kitchen and family room, demo and disposal, framing and drywall, electrical and mechancial, cabinets,countertops, backspalsh, exterior doors, french door hardware and labor, wood floor, reroute electrical and water in laundry room, and finishing trim and painting. The total cost of the project $57,835.60. The deposit of $22,000.00 was paid and cleared on March 22, 2022. Two weeks after the deposit was cleared, I called to ask what was the timeframe of the project. The attached project list was provided in buildtrend. I (*******) also asked for an itemized invoice for the cabients. He stated that no one has even asked for that. I asked serveral times for updates on when the cabinets and doors were ordered and no reply. We inquired several times about Mr. ****** license number. We have been without a kitchen since May 3. According to our timeline, we was suppose to be finished by July 8th. The worst thing has been no explaination or replies back from Mr. ***** ****** . He never replied until we mailed a Certifed letter on August 15, 2022. Mr. ****** presented himself as a licensed and insured. We were informed by the NC General Contracting Licensing Board that he was not lincensed. When he assumed we knew he wasn't, he stated he didn't need to be licensed and he lied and stated he asked if we wanted a permit pulled. We were under the impression that he was licensed and if we need permits pulled he would have told us. Mr. ****** did not pull permits for the electrical and plumbing work performed. As of date Sept 23. we haven't received our refund of $18,000 that we requested. This include all material and labor not yet spent and for material, labor charged for vent hood never to have needed.Business response

Unfortunately, our cabinet manufacturer went out of business during this process which was out of our control. However, we have since procured the services from other cabinet companies. We would be happy to discuss these issues with you further and hopefully come to a resolution.

I went to contract with ***** ******, President of Shapes Construction on February 3, 2022 for a kitchen renovation. The renovation included taking down a wall between the kitchen and the family room, demo and disposal, framing and drywall, electrical and mechanical, bench seating, cabinets and countertops and finish trim and painting. The total cost was $90,921.40 . Mr. ****** stated that we could complete the project in approximately one month. We agreed and I paid him an initial deposit of $43,670.70 to get the project started. By August 8, the project still was not completed even though I tried to make several suggestions about how we would proceed. Please see attached documents including a complaint letter sent to Mr. ****** with images of texts, emails, and pictures of damaged cabinets. The letter was sent to Mr. ****** on August 8, 2022 and I asked him to cancel our contract and pay me back my initial deposit $43,670.70 by certified check by August 23. I had already paid him for materials and labor for the work that was performed in my home. He did not reimburse me, but suggested that I "take the hit and cancel the contract". After the letter was sent, I contacted the company who built the cabinets and they stated that Mr. ****** did not order them until April 14. I had also found out that Mr. ****** and his crew were unlicensed in the state of North Carolina. Mr. ****** posted on his website that he was licensed and insured. Furthermore, Mr. ****** did not pull permits for the electrical and plumbing work his crew performed and stated that he did not have to have a contractor's license even though the contract was over $30,000. I now have to find a new contractor to finish the project and pay more money for permits and fees, wait approximately 10 weeks for my cabinets to come in and then have the contractors finish the job. From February 3 to today, August 23, my family and I have not had a kitchen. Almost 7 months.Business response

I am rejecting this response because:Mr. ****** has presented himself to be a licensed and insured contractor, which the North Carolina Licensing Board for General Contractors stated that not only he and his company were not licensed, but the workers who had performed the work in my home were not licensed. I asked him and his assistant to provide me with his contractors license number at least two times. He stated he did not have to be licensed even though the contract was over $30,000. According to ******* ****** NC Local Government Law, "In North Carolina the penalties for contracting without an appropriate licenses is a Class 2 Misdemeanor punishable by up to 60 days in prison and up to a $1,000 fine." The General Statues Chapter 87, Article I 87-13 states that [the] "Unauthorized practice of contracting; impersonating contractor; false certification; giving false evidence to Board are subject to penalties." In addition, Mr. ****** did not "pull permits" for the electrical or plumbing work that was performed. According to the North Carolina General Statues, it is required that construction work be performed by an appropriate State licensed contractor who is responsible for obtaining the permit. Furthermore, ***** ********, the Product Specialist of ********* Cabinets informed me that the cabinets were not ordered until late April; however, Mr. ****** stated that he had ordered them earlier. We went to contact in early February. Mr. ******, when asked, did not present me with documentation stating when the cabinets were ordered or the invoice. When the cabinets did arrive in late July, they were not the quality that we had contracted, they were damaged, many were not the right dimensions, and some were not the right color. Mr. ******, upon examining the cabinets, which had been installed in my home during my absence, agreed that the cabinets were not the quality we expected, in fact, they were made of particle board instead of the plywood based cabinets we ordered. Mr. ****** stated that he was going to have the front of the cabinets refabricated and painted the right color; however, the cabinets were made of particle board, not plywood.
I presented several options to Mr. ****** on how we might go forward, but Mr. ****** did not want to agree to those terms. Mr. ****** also stated that his lawyer would be contacting me. I asked Mr. ****** to present to me what he believes was equitable and also provide documentation that concurred with his calculations. He did not.
We went to contract on February 3, 2022. It is now September 13, 2022. I still do not have a kitchen. It has been extremely difficult on my family and costly to me to not have a kitchen in place. Mr. ****** has deceived me and other clients by unjustly claiming his accomplishments and qualities for his financial gain. He stated in an email that because I was more fortunate than others, that I should just "take the hit" [money] and cancel the contract. There is one other family, the Palumbos, who are in the same situation as we are, and who have asked for a reimbursement and cancellation of the contract.
Mr. ****** stated in his response to my complaint, "Shapes Construction always stands behind our products and
installation. We would be happy to discuss these issues with you further and hopefully come to a resolution. We have many different options for cabinets, electricians, plumbers for you to choose from so you can get the kitchen you want."Mr. ****** has not stood behind his product, and he did not respond to my requests to come to a resolution that would be amicable. I do not want to work with a fraudulent contractor and quite frankly do not trust him to be in my home. All I want is my initial deposit back of $43,670.70. Again, I have paid him for his material and labor.

Our license is for Commercial and Residential construction which has reciprocity in North Carolina. Pulling a permit would have never been an issue had you confirmed during our first meeting that you wanted Shapes to pull permits for your project. You specifically indicated that "you did not want those people in your house" as there were other areas you did not want them to inspect. However, we procured the services of a licensed engineer to address other construction applications on your property.Thank you and we look forward to speaking with you.

I am rejecting this response because:1. I did not state I didn't want you to pull permits nor that I did not want "people" in my home. All projects that needed inspections and permits were done. Another example of your untruthfulness.
2. You did not provide your NC License even though we asked for it many times.
3. You did not stand behind your product. You gave us inferior products, which you confirmed were not the quality that we ordered.
4. You did not provide the invoice for the cabinets nor the date ordered even though we asked for that information.
5. You have not responded to my emails, texts, or phone calls.
6. I asked your several time to call me to discuss.
7. I don't understand why you would steal money from us. I need to go forward with getting my kitchen done and I need that money.
