    I placed a $4,000 deposit with this company to perform services on my lawn. However, the owner, a year later when he was going to perform the services informed me that he could no longer perform the services. The owner claims that he is a victim of identity theft and that he no longer has any money to return my deposit or complete the services. He claims that he has laid off his entire staff. However, the business is still in operation. I would like my deposit of $4,000 returned.

    The only reason we are not doing this job is because of the home owner ,do too there is a barried oil tank in the area of excavation that the home owner did not tell me about i found out by a previous owner family member of that there was a barried  oil tank and when I brought it to the home owners attention he said he new about it and to give him a estimate to take out so I did and he turned it down so the job was not done do too his end and I am dealing with identity fraud so witch I lost funds, I told the owner that we don't give back deposit do to we buy material with it witch we had and it's written in our contract. I would work with him and it would take some time to give the deposit to him identity theft is not fun and is nothing to mess around with. The home owner saw me on the rd with his Porsche and tride to run me off the rd and taking the front end of my car off  and also causing multiple car accidents and then got in front of me and was swerving all over the rd slamming on his brakes causing more accidents and when we came to a light it was green and he came to.a complete stop and ran out of his car and yelling at me and swearing at me .at a busy intersection. So.this got was not my fault it was n I t completed it was the home owners

    I do not accept the business's response as a resolution to my complaint because: the business is unlawfully withholding my deposit because the owner does not have the funds. I demand a refund of my deposit, as entitled.

    i am not unlawfully with holding deposit it state in our contract the deposit are nonrefundable .the job was canceled by the customer not but us ,do too there was an berried oil tank that the home owner knew about and did not tell us ,i found out by the previous home owners relative and the home owner said to give an estimate for it so i did and they turned it down ,i said even though we do not give deposits back as stated in contract .i would work on giving it back to them but it would take some time do too i got hit with identity fraud that I'm dealing with and i lost a lot of money and there nothing i can really do to get it back .   "even thought  the customer tried to threaten my life and running me off the road in his Porsche and threating me at a green light " .witch i should be calling the cops on i am not .i will give the deposit back but it will take some time .i am trying to keep my company a float right know and just barley making it week to week and i had to permently lay off most of my company thank you

    I do not accept the business's response as a resolution to my complaint because: 

    1) owner is made a written commitment on multiple occasions to refund the deposit via email and in this this written dispute. 

    2) the owner has failed to refund any of the deposit even though the owner has claimed on multiple occasions over the course of 5 months that he would refund the deposit. 

    3) due to the written commitment the owner has made to refund the deposit, the owner is now illegally withholding the deposit. 

    4) the owner has not refunded any part of the deposit. 

    5) the owner has not submitted any payment plan for the return of the deposit or made any steps to indicate the deposit will be returned, despite the owner claiming that the deposit will be returned. 

    6) the owner is still liable for the return of the deposit.

    Spent $13,000 for Shampney LS to purchase and install (25) 5 foot blue spruce trees. Trees were simply all thrown in holes with out fresh soil, crooked and all of them are dying but can’t get Shampney to even respond let alone fix them. Had another landscaping company out to assess the situation and they stated the trees were not installed correctly, they are also not the correct tree for this installation and the work was extremely shoddy. These trees are watered each day for 45 minutes as you will see from the greens all the way around the trees. Tried calling and texting them many times with no responses.

    I Dave Shampney the owner of Shampney & Son's Four Seasons Landscaping LLC have been communicating back and fourth through emails and text about the trees. We plan on going out and looking at the trees and coming to a solution to make both parties happy. As mentioned in the text message the tree look like they were being over watered. When doing this project the customer(****) said that he was going to mulch these trees himself and has not done that which is also another reason why the trees look the way they do.

    We never received the BBB complaint until August 17 around 1:46pm. we had been in contract with the customer before we received this complaint.

    In an email with the customer I had offered to come out and take a look and see what the problem is so that we could fix this issue and got no response back.

    We will come out and look at the problem and have it fixed as long as the customer is ok this.

    I do not accept the business's response as a resolution to my complaint because:

    In the 3 weeks we have been waiting for Shampney LS to assess the situation with this poor installation, we had a few other well-known LS companies come to assess the situation and all came to the same conclusion. It's simply an extremely poor installation. We have hired a well-known, reputable LS company to make the necessary changes and replacements, fully documented as we will pursue Shampney LS through the courts once the total amount of damages is achieved.

    Thank you, BBB, for help and assistance with this matter as the intention of going this route is to resolve the issue before legal action is necessary. You may please close this case out as we have no further desire to play these games any longer as I have been advised not to share any more information regarding this case. Thank you..
